Well here is someone that REEEEEEEEALY doesn't need to be in possession of a firearm. Call 911, then fire when they knock? Beyond stupidity. If the robber was at your door, why in the f@ck would he knock politely? And to drop the charges? His rounds have nowhere to go other than into other apartments in the complex. AND the guy admitted to the police that he had been on a methamphetamine bender for the last few days, and only surrendered after the police called his phone and convinced him that SWAT was going to show up if he didn't. This guy must have been the reverend that married the police chief, the judge's daughter, and the DA's mom to walk away with zero charges. Mind blown 🤯
There HAS to be some sort of mental deficiency for them to drop charges. Like they found him unfit mentally and had him admitted to psychiatric care or something along those lines. That would be a reason why they didn't specify why charges were dropped. Just from a medical privacy standpoint.
So it was okay for him to shoot into the wide unknown when the officers came to his door and the charges were dropped? That just doesn't make any sense to me. Prosecutors and judges are too lenient these days.
They likely dropped the charges if he was found not competent to stand trial. The prosecutor can refile them later after the suspect is rehabilitated to sanity in a mental hospital. This happens a lot actually.
This is why Departments train officers Never Stand in the door as it’s a kill funnel. Always knock from cover , using a baton or a flashlight so even if a round strikes it it will only knock it out of your hand. The first officer was super close to getting blasted though that door .

A legal presumption assumes a fact is true without any evidence until the presumption can rebutted by evidence. I don’t believe any presumption applied to this case. The charges should not have been dropped… if “people are trying to break in”, the “castle doctrine” (or self defense statute) in NM would not allow you to shoot at someone thru your front door, windows and walls, for knocking on your door. In NM even if you encounter an intruder INSIDE your home, you do not necessarily have the right to shoot them, they will look at the totality of the circumstances and whether your life was _imminently_ in danger or not. Mr Lane was in the midst of a days long meth binge at the time and no one had been breaking into his apt, he was experiencing meth psychosis. The charges were likely dropped either due to him possibly being declared not fit to stand trial due to chronic meth abuse affecting his ability to function mentally, or bcuz of a controversial rule in NM that had gone into effect shortly after this incident, called the Case Management Pilot Program For Criminal Cases, which at the time period towards the end of last year was responsible for at least 35% of criminal cases being dropped in Doña Ana County.
The issue is not the firearm. The issue is (major one) is the "charges were dismissed". The use of illegal drugs (and now legal ones) is a far greater threat than any firearm. The fact local governments in NM fail to uphold the laws and impression these criminals is a close second.
