It's a dark day in America when we have to ask an assistant labor secretary if she believes in capitalism.
I worked 1099 for years! One of the reasons we like it is because we make up our own rules!
If you make an independent contractor an employee then they can’t compete!!! Also we would have some of our commissions taken away! Some people are independent contractors because they want to KEEP the majority of the money they make!
For God’s sake! Just say NO and move on. Make the fact that you’ve never owned a business irrelevant. Not doing that makes her unacceptable.
It’s because the state & federal governments get more taxes from payroll employees.

As a former independent contractor for 33 yrs, the goal is to strip from you insurance, benefits etc as well as keeping you under contract so you can’t work for anyone else. It’s a total joke

The problem is that many employers are ONLY getting independent contractors from these "Contract" companies, so they do not need to give the worker proper benefits, but they can work them as employees. What I'm seeing is that this is hurting low income and entry level workers who only get the contractor job and no benefits. I don't know if other regions and people are seeing this, but this happens a lot in manufacturing in this area. Unfortunately, it easily becomes a scheme where companies abuse this tactic. It's also easy to say "it's your choice" but if all the companies in your area do this to save themselves money from benefits, then the choice is gone. You end up being stuck as a contractor with minimum wage and no benefits.
This does not excuse the woman from answering or being dishonest. She should easily be able to say what I just said and answer questions properly. Maybe there needs to be another solution, but being deceptive and not answering does not help the situation.
I'm conservative and not big on government limiting options, but we need to be careful. Corporations and companies are only interested in making money. They do not care how they injure their employees or "contractors." They just want that money for the board and etc.
To my mind no job should be open to illegals, but if this is used to give illegals jobs, then of course this is just corporations getting cheap labor, which is why they want the illegals. We need to enforce the laws and end this issue regarding illegals.

I used to be an employee and an independent contractor at the same time. I worked for a national drugstore chain at night as a shift supervisor and during the day I was an amateur sports official. I did it for 10 years until my knees gave out and I could no longer officiate. Every penny I earned as an official was money earned as an independent contractor. I had to pay income tax on the money plus both the employee and employer share of the social security taxes. In one lump sum during tax season. There was no sick time or vacation time. If I did not want to work games for a week I simply told the assignor to take me off the schedule. Independent contractors choose to be that for the freedom to decide when, where, and for whom they work. Donuts to dollars that this woman does not know that every actor in Hollywood and on Broadway is an independent contractor. The old studio system used to take advantage of actors. I can guarantee you that if employers start to be required to treat independent contractors as employees, all hell will be break loose.
Why do they always thank them for a question? Happens all the time.
Because each questioner has 5 minutes total. The witnesses are taught to use tactics such as talking slow, having the question repeated, and thanking the questioner for each question to eat up the time.

You should not be considered a contractor if you can only work for one company. Amazon, FedEx Ground., etc. These are examples of companies that will always have work but not an actual contract job. Contract jobs are for a specific job and time to complete. There is nowhere you can refuse the contract and later down the line except one. The government does this with outside contractors, too, but at least you get some assurance when you contract with a city, state, or federal government. They all walk a skinny line.
