Feels like there's a lot of information missing about this collision. Even if they do locate the other driver they'll have an incredibly hard time proving DUI without either a Field Sobriety Test, Breathalyzer Test, or blood test. They can't get him for fleeing the scene because he evidently didn't and was released from the scene by police. They might be able to get him for an open container violation, but I think that's a Class C misdemeanor in Alabama with less than a $100 fine.

So they don’t know if he was here illegally. If they thought he was drunk, wouldn’t he be arrested for a DUI?
