Judging the Justices: Epstein and Yoo on the New Originalist Supreme Court

In what has now become an annual tradition on Uncommon Knowledge with Peter Robinson, law professors John Yoo and Richard Epstein join the show to opine on a newly minted Supreme Court. For the first time in decades, today’s court is dominated by a majority of originalist justices-justices who believe the Constitution means today just what the document meant when it was ratified more than 200 years ago. The professors discuss and analyze Dobbs v. Jackson Women’s Health Organization (the case that may overturn Roe v. Wade), the court’s ruling on mask mandates, voting rights legislation, and other cases to watch. The professors also reminisce about the time the current president of the United States waved a book authored by a then unknown law professor on national television during Clarence Thomas’s confirmation hearing. As usual, our yearly show with professors Epstein and Yoo is the closest you can get to law school without having to take the LSATs.

If Roe had been decided in 1972, I might not have had the courage to have our son. As a couple, my husband and I were not really ready to start a family because he was still studying and his visa was about to expire. In addition, my uncle’s wife told me that my father had suffered from epilepsy and I should not have children because they would also suffer from epilepsy. She claimed that epilepsy skips a generation. I was hysterical after hearing her on the phone as my husband arrived to calm me down and assure me that his mom in El Salvador would help us with our child if he/she had health complications. On Sunday Dean Dimmick of St. Mary’s Cathedral in Memphis, where abortion was still illegal, visited the confirmation class. I helped an elder of the cathedral with the class but it was a preteen, totally unaware of my pregnancy, who asked Dean Dimmick when life begins. Dean Dimmick chuckled and his rosey cheeks became even rosier but he said that the Episcopal Church (at that time) had declared that life begins at conception. That was my first encounter with a personal God. I took the experience with a leap of faith and everything worked together for our good and for that of our marvelous son, now 49 years old - a fabulous son, husband, father, friend, student and professional. I have boycotted, opined, signed petitions so no woman would be so tempted again to kill her own baby. Our son and his sister, born at seven months and weighing only 3 lbs 15 ounces, were both doomed to be terminated by the doctors who examined me; but our children and their children are our treasure and so much better than we.
I love listening to John Yoo. The way he sprinkles humor in with erudition is top notch.

22:27 I also disagree with John. You don't leave a person's constitutionally protected god-given (natural) rights, freedoms, and civil liberties up to a democracy where the majority can vote to severely curtail the minority, which in this case is a defenseless one, the unborn human child. Our constitutionally limited federal republic was created to defend against the tyranny of mob rule and popular opinion (democracy) as well as the tyranny of big government.
Watching Peter and John wrestle with Richard is just soooo much fun! It makes for a good show.
I always enjoy listening to Richard Epstein's short appearances on the John Batchelor show.

After watching this, I immediately viewed an episode with Robinson interviewing Epstein from five years ago. In that episode, Epstein threw a Latin phrase at Peter, "May justice reign though the heavens may fall." I don't know if Peter was throwing it back at and Epstein forgot, or if it was just coincidence, but it was a great call back!

I thoroughly enjoyed the 3-way discussion of these 3 men, but throughout, I could not help but wish that Peterson would follow up this event with 2 separate discussions, one with Epstein and another with Yoo. Throw in some discussion about why they agree and disagree with each other.
Of course, very interesting and educational. But I don't think I've ever heard Peter Robinson interrupt so frequently. Of course, if he hadn't, it would have been an Epstein monologue. Always the best program that I can find!

Sheesh, just read the Constitution. The best stability is that EVERYONE can read it and understand what it means. Instability is a Hammurabi Code that only the elite can decipher.

abortion: it's not about when does *_LIFE_* begin (that is obviously before or at the point that the egg is fertalized) ... instead it's about when is the organism a *_HUMAN BEING_* ... why do people talk about when life begins?
Yoo seems political, rather than focused on the law and the Constitution. I don’t see a true fidelity to principles.
