I honestly feel he's never been given a fair shot, that King of Kong documentary came out and misrepresented stuff to make him look like a clear cut villain so the film could have more drama and ever since people have just shat on him. I'm interested to see how this goes

Mitchell's family have actually cut him off from the restaurants and hot sauce. A few years ago they all had a massive row (apparently over Billy's wife) and Billy lost a power struggle to his own parents.
@Lassi Kinnunen apparantly he got caught somehow (I don't know how they did it) using an emulator and not the true arcade machine to get his high scores.
They will know him like people know Todd Rogers. The biggest cheater in the universe.
I met Billy Mitchell last year in Ontario, California along with Walter Day at a Retro Gaming Expo. Both men came off as fake and condescending, especially Billy.

Honestly the arcade DK high score scene is bigger than ever. There's a TON of unnecessary drama of course, and I fully agree with you there, but lots of the people are normal... it's just the drama that ends up being shouted from the rooftops.

True, if this does go to court (I'm doubtful a judge would want to waste time on this) it's going to require many people with in-depth knowledge about how various technologies are used in video games and how they can be exploited. Things a lot of juries and judges are just not going to know or understand.

I actually saw and met Billy Mitchell at Free Play Florida last year. Seemed nice enough. Was very cordial to people who came up, but something seemed off about him. Kinda insincere?. What is really interesting is that the dude presents himself exactly as you'd expect - American flag tie, thumbs-up in every photo, tons of hot sauce promotions everywhere.... Seemed like everyone was going out of the way to not mention anything about Twin Galaxies or his cheating allegations.
Oh, well. At least his hot sauce is pretty good, apparently.

He actually earns next to nothing from the hot sauce as of 2016. He had a huge falling out with his family and lost control of the restaurants and the hot sauce. He now earns like 1% of what he used to because they pay him to be a "brand ambassador" but he doesn't earn royalties like he used to, and the hot sauces he created (the spicy honey mustard, the bbq sauce) they stopped selling so he doesn't earn anything.

His entire livelihood, persona and notoriety is built upon the fact that he was really good at video games 40 years ago. It's all he's got and he's trying to protect it until his last breath. It doesn't make him a good guy but I get it, you know? It's all he's ever been and will be and it's been taken away from him. The saddest part is cannot accept that he's the one who took it away, not twin galaxies. He's a lamentable and sad character. Someone will make a great movie or documentary on him one day.

How good was the evidence against him?
My understanding it's seemed like good evidence, what's going to be the real question will a judge understand it.
The footage has been tested by many and appears he did not use real hardware to set records. If you emulate you can fudge the score etc. Basically his "record" video had artifacts in graphics never seen on real arcade board hardware. So pretty clear cut8
The opening cutscene in Donkey Kong, where he stomps on the girders and makes them slanted, plays incorrectly when played on Mame. It's a very distinct difference compared to when played on an actual arcade board. It would be very easy to prove in court that he used Mame footage.

Billy doesn't have a leg to stand on given even his own expert couldn't find a way to make the "girder finger" happen on actual arcade hardware. Though I was very nearly put on a murder trial jury last year and tbh if I have to do jury duty I'd much rather be on a frivolous slander lawsuit than that 🙂

If he hasn’t cheated, and can somehow prove that, his defamation suit has legs because this video alone shows that people have assumed him to be guilty based on Twin Galaxies’ removal of his high scores.
It’s a 100% fact he cheated, you can compare running Donkey Kong on a real arcade unit vs MAME and you can literally tell during the opening of the game that he used a MAME emulator because the opening scene runs differently on MAME vs real arcade
The fact that he couldn't, for longer than a year, shows he has zero legs to stand on.

There’s strict guidelines on using MAME vs real arcade hardware, trust me he has no angle, he’s been trying to pass off his record as being played with a real arcade unit when it’s been proven to be a fact that he was using MAME which your not allowed to do for world record scores, there’s actually separate categories for some games/systems when using an emulator but for people who take this serious, it’s original hardware or not at all
Libel is defamatory remarks by written word of caught on tape (evidence of, basically)...
And slander is simply hearsay, He said/She said basically, no evidence of it. Usually NOT worth suing over!

No, his records are from videos he recorded, if you actually look at what he’s done in tournaments and in live setttings he’s not very good compared to the very elite players

You migjt want to look at mitchell apparenly suing youtuber apollo legend a staple of the speedrunning comunity whos analysed mitchells previous records and proven them to be fake. Hes also had several videos striked by mitchell himself
My prediction is BM gets past the anti slapp because of the nature of the evidence against him. In simple terms: there isn't simple evidence against him like a picture of a mame watermark, or someone testifying "i put the wrong rom on this hardware." - Without something simple they aren't going to throw out BM's lawsuit. Then the question is does TG settle instead of go through the whole procedure to probably win. The best move for TG is to say "The previous runs didn't meet our current standards and are disallowed, Mitchell can still submit new runs." That would take away his best grounds to sue him on which is the lifetime ban instead of the disallowed runs.

Well your prediction would be very wrong because there’s video evidence that proves he was using MAME, there doesn’t need to be a watermark or some kind of identifier because the game is the “watermark”, the game runs differently on MAME vs real arcade and it easily been proven, go watch a video, it’s a fact he used MAME not an opinion
@@PatrickThomasBrady I think you didn't understand what I said on first reading. A quick search actually says I was right and in october the slapp ruling went in mitchell's favor. That doesn't mean mitchell would win the case in court.

It has been disprove through evidence that his claims to fame were fraudulent. The entire lawsuit is going to be a pretty lopsided if he doesn't bring many counterpoints to the opposition, like not altered footage or anecdotal evidence.

So cheating once will disqualify you 100% but i have yet to see any evidence he can get those scores again. He may be a decent gamer but his whole persona is built on being the top scorer of these games. So no he is a liar and should be treated as such. That said our fucking president lies more than billy so who the fuck knows in this world
He won't have to prove malice I don't think, that's a constitutional standard for speech that's about a public figure and I don't think he's that famous. You have to be like a public official, or else the standard is usually whether you have pervasive power and influence in society (think someone like Bill Gates). You can also put yourself out as a spokesperson for a major national issue, like if he were a nationally known abortion activist or something. The idea with malice generally in defamation is we want media outlets and regular people to be able to talk about national news without every major figure in every story suing every other person in America every day. So we protect you if you talk about Trump or Bezos or whoever but probably not so much if it's little Billy from the arcade 40 years ago.
But overall this is right that truth is an absolute defense and they're going to put a bunch of mame science on trial, and it's going to be weird and there's no realistic way Billy should win.
Edit: that's not to say twin galaxies won't try to make him sound like a public figure to make his case harder, you may well read filings where they claim that. But I don't think that part of the defense is going to fly if they do try it.

Mame is an emulator for arcade cabinets and allegedly Billy got his newer scores on that not the original cabinet
The MAME allegations were presented when it was observed that the loading of the game in his WR recording was similar to the game running on the emulated system.
The rules on his WR was that he needed to have done it on ORIGINAL Arcade hardware or the footage will be disqualified. He broke the rules and still got the record (which he recently lost).

In the 90s, you never prove scores with video. You prove them by performing at public events, in the mall, in stages and with organizers. The guys in the documentary "King of kong" made a inaccurate representation for the drama. It's like the Hitler movie or something. TG took that movie and its promo materials to show that Billy's records are fake. That is why Billy's evidence is filled with the names of the organizers at his public events... including Funspot owner who claims they never buy or use any modified arcades because it's illegal for their business and billy performed at an event they publicly announced and promoted.
So yeah, he's gonna win the lawsuit in my opinion.
He’s not winning anything, it’s a fact he used MAME, this has been proven with videos, go look it up, it doesn’t matter what these people say because most of them are in his little click that helped him do all this, they can’t prove it’s a real machine and it’s very easy to prove he was playing on MAME
@@PatrickThomasBrady Actual truth is different from legal truth. There is a concept called ownership. Namco is the owner of the game, so what they say goes. They can make a 3 year old world champion if they want to. If they certify that it is original hardware, you can't do anything. The court will also not accept a reproduced video without accounting for the whereabouts of the original. So the videos will not even been considered because TG can't account for the original which passed hands all over at their negligence. Check "best evidence rule" (Federal Rule of Evidence 1002).
@@ruselorivaasentista309 that’s true, I can’t act like I know the legal nuances that goes into something like this, I just know that I could make a video that proves he wasn’t using a machine beyond a doubt, and I’m no expert in emulation vs hardware, but if his videos won’t be considered then that’s hard to prove either side, I thought Namco weren’t involved in record keeping anymore and TG was essentially considered the expert or presiding body when it came to confirming and documenting these records
@@PatrickThomasBrady Pacman and DK are not esports. Namco is not an esports company. Namco did some game rankings as part of a marketing function. Also part of their marketing function are public events. Because it is part of the same marketing function in the 80s and 90s, authentication standards aren't really that high. They can definitely certify original hardware without actually checking if it means gathering attention to sell toys. However, they remain owner certifications, along with statements of the technicians and organizers of the public events.
TG never communicated to these video game companies that they were keeping high scores and making a business out of it. At most, TG is a fun fan-made leaderboard company. It does not derive any authority (or license) from the owners and any document made by the owners (for whatever purpose) carries more weight than to what they have to say.
