How to Deal with Difficult Tenants | Happiness Clause
Here is an example of a Happiness Clause. Obviously you should modify it to fit your needs. This one informs them that the lease will not be renewed, while that may be appropriate in some cases, I don't think most situations call for that.
"Home is where the heart is. We believe that everyone should absolutely love their home and that's the standard we've set for our company for the past ten years. Unfortunately, sometimes things aren't a great fit. We've noticed that you've experienced a consistent pattern of dissatisfaction with your home and our company's service.
We'd like to make that right. Effective immediately, you have the option to end your lease, for free, at any time, with a simple 30 days written notice and ending the lease at the end of the month. This offer will remain in effect until the final move out date of August 31st. This also serves as your official notice that your lease will not be renewed at the end of the term.
We'll continue to uphold all provisions of the lease on our end - including your ability to live in the home the entire duration of your lease term, should you choose, and providing you with the same level of maintenance and service that we do our entire portfolio. We hope that this option provides you with flexibility and peace of mind."
Here is a second example:
"I want my tenants to be happy in their home. You don’t seem happy and haven’t been for a while. So you can terminate your lease in the next 30 days for no penalty and we can go our separate ways. However, if you stay, this issue is deemed to be resolved and I won’t be addressing it again."

    amazing information! A good property management charges 10 percent plus the comissions they get from repair people. The other type of property managers that charge 5 percent you really don't get good things. They do what they want with your property, meaning your money. They will always do the short cut that MEANS MORE MONEY FOR THEM. They do not answer all phone calls when the property is listed. The clauses in the lease are very poor and the do the lease simple leading to future problems to the landlord. So far i haven't had a good experience with realtors or property managements that charge 5 % and sometimes with the ones that charge higher.

    One thing that I've done for years is I have actually contacted the prior landlord as a furniture rental company Whether I'm selling something on an option I contact them that their renter has listed them as a credit listing I didn't ask them would you co-sign for them I have got all kinds of answers but usually whenever there's a trouble tenant in place they tell you the whole story and it has very very fruitful and useful don't know if it's totally legal so please use care thanks so much for your videos😊

    These type of tenants I've had and they are usually spoiled by their parents when they're small and expect everything to be just perfect, over the years I've modified my screening and then that has helped thank you

    I have and I do require that they tell me where they live and they agree that I can come through and do an inspection of the property. In one property, the daughter wanted to move in next door to her mother in a duplex of mine. I was reluctant but got the interior inspection and allowed her and her cat into my duplex, and after about 3 years I helped her and walked her through buying her own home Doing a walk-through inspection of a rental Can tell you whether you do want them or don't want them Your screening criteria is one thing that should be posted in multiple places inside of the unit in the window and on the back of the application if they don't sign that for me, that file is not considered your video is great

    This is a solid video. TAKE HER ADVICE LITERALLY and this is why. If a previous landlord had at least an 80% positive ex-tenant, you will hear it in their words and voice inflection. And this percentage goes up with the percentage the tenant was awesome. The more positive they are about a tenant, the more positive and OPEN they will sound and the more positive things they will say. I have told other landlords "to ink the deal before they get away" on my great ex-tenants. You do not forget your great tenants!!! The opposite is also true. If they had an average or worse experience, during this conversation it may show up as hesitation, they will say they don't remember or need to check their records, apathy, boredom, indirectness, change the subject, say something cryptic like going off topic and talking about people with poor character, excuses like fax/email their permission for me to talk to you haha. Or if the landlord is glowing but then contradicts himself by saying something ridiculous like, they were great tenants and I only had to repaint and recarpet the whole house when they moved out. THIS IS LANDLORD CODE FOR READ BETWEEN THE LINES AND DO NOT RENT TO THEM. Sometimes this is because your state lawn ties your hands or worse yet, you fear retaliation. Another tip is if they are not first-time renters, like college students, but they already have co-signers ready to "alleviate" the risk of putting them into your property. Management company's share very little, so weigh anything negative they say more heavily than you would a private landlord.

    Sorry I am 4 years late on the comments, but just fyi "Per Annum" and "Per Year" are the same thing...neither variation means simple versus compound interest. One is more formal and the other is more informal, however they both are used in contracts and both of them do not mean compound versus simple interest, they simply mean "Per Year".

    Question for the community...I have a friend that received a 30 day notice to vacate (after she submitted a complaint of possible mold in the apartment). She found a condo for rent and the new landlord wants to contact the current landlord as a reference but the current landlord refuse to assist the tenant. They have ceased ALL communication with the tenant. Is this legal? What other options does the tenant have in this situation? Any recommendations and suggestions are greatly appreciated!

    All of those things that you can't ask are the number one things on every FB marketplace ad in my area. Same with most online places. Sure it is banned and illegal but almost every ad I saw online while looking for a place broke those rules. Vegans only. Female/Male only. No mixed couples. No children. That is just what i can say and most likely not have this comment buried. It is a lot worse that that. West coast of Canada.

    What I don't like is landlord will charge you the application fee and get to write off the expenses in relation to screening you so it's pure profit for them. There needs to be a law where landlords are forced to refund the application fee if they deny you the rental.

    3 x the rent income is ridiculous these days. Most people are prepared to pay at least half their income on rentals, because rentals are so overpriced these days. I've paid as much as 3/4 of my income on rent when I was between jobs, and I NEVER missed a payment. There are also no-fault evictions, where tenants are evicted because the landlord kicked them out in order to do a few minor upgrades and double the rent. And the day is coming when you won't be able to discriminate against people with pets.

    My tenant had poor record of on time payment. I thought I would give them a chance, but they started paying late every month right after a few months they moved in while they bought 2 new cars during the time. It never charge them 10% late fee per contract. It has become later and later. I have not received half of previous month rent yet. People way of thinking can be hard to change.

    The truth is, when your landlord sucks at his or her job, he or she can turn the tables and blame the tenant when the tenant hasn't done anything wrong. The tenant can keep a place nice and neat, and be told in court, they live like a slob. The judge tends to agree with the landlord, and or property manager and before you know it, as the tenant, you are out on your rear.

    Sounds like you have always been rich. Coming from parents that are veterinarians, being a chemical engineer, and then buying up properties to rent out. It's just a business for you and it is just about money for you

      The problem is she is actively taking advantage of others and acting like she is doing them a favor. I can't see running a housing business and that being good for the renters very often but she acts like it is a good thing for them which we all know it is not!!!
