How to Deal with Difficult Tenants | Happiness Clause

  • Here is an example of a Happiness Clause. Obviously you should modify it to fit your needs. This one informs them that the lease will not be renewed, while that may be appropriate in some cases, I don't think most situations call for that.
    "Home is where the heart is. We believe that everyone should absolutely love their home and that's the standard we've set for our company for the past ten years. Unfortunately, sometimes things aren't a great fit. We've noticed that you've experienced a consistent pattern of dissatisfaction with your home and our company's service.
    We'd like to make that right. Effective immediately, you have the option to end your lease, for free, at any time, with a simple 30 days written notice and ending the lease at the end of the month. This offer will remain in effect until the final move out date of August 31st. This also serves as your official notice that your lease will not be renewed at the end of the term.
    We'll continue to uphold all provisions of the lease on our end - including your ability to live in the home the entire duration of your lease term, should you choose, and providing you with the same level of maintenance and service that we do our entire portfolio. We hope that this option provides you with flexibility and peace of mind."
    Here is a second example:
    "I want my tenants to be happy in their home. You don’t seem happy and haven’t been for a while. So you can terminate your lease in the next 30 days for no penalty and we can go our separate ways. However, if you stay, this issue is deemed to be resolved and I won’t be addressing it again."

    We typically keep our rents about 10% below market rents. And we remind the tenants of this when they move in and at each renewal. That for the most part, keeps the petty complaining to a minimum.

      Rental margins are usually only 5-10%. You must own outright to be able to afford to drop rents that much. Many landlords would only break even like that.

      @@joevarga5982 sounds too low. if your gross yield is 10% and your rental margin is 5% , that means that your net yield is just 0.5%. Better buy some bonds or stocks.

    These type of tenants I've had and they are usually spoiled by their parents when they're small and expect everything to be just perfect, over the years I've modified my screening and then that has helped thank you

    That was a great video. I think happiness clause is really important too for tenants who are renting a room in the same house with you. Nothing worse than living with an unhappy tenant

    You have very good info. Thanks for making these vids. My difficult tenant thinks she needs to complain about something everytime she pays the rent. I'd go over to see what the problem was and it was nothing. One time she called me because one of her light bulbs went out. Seriously. But she pays generally on time and keeps the house very clean so there's that.

    That riser could be the plinth for a birdbath or scupture. Put potted flowers around it so they won't get dug up. Make it a feature. Maybe she could figure out how to clean the tank without disturbing the grass.))) Company would be thrilled to know.

    I have a tenant that I've inherited from prior managers.. she's been on property for some 12 years. She's a real complainor on everything. Blows up on every silly little thing.
    I had to remind her to clean up after her dog, so she'll turn around and accuse me of having cats that are pooping in the yard.. i dont have a cat, my husband is allergic. She lies to my face all the time. She's told me the previous manager promised her new things like blinds, and they're in the shed. I asked him about it and he had no idea what I was talking about. She was supposed to get a pest control inspection, but lied to them that she was out of town, but there she was hanging out in the patio. Yep she's a slob so the previous manager had to deal with her roach issues. It was so bad he said they were just raining out of her pantry. I had to deal with her bed bug issue, she wanted to accuse me of bringing them into her apartment. She likes to twist every I say, and thinks she's entitled to everything. She's even threatened me. Thankfully she does address the issues that come up, but man I have to exercise patience. And she's a busy body, she's going around telling other tenants about bed bugs and the owners this and that. She's way out of line considering all the problems she's caused over the years, and she has an amazing deal on rent. You will not find below $900 in CA. As a reminder, just because a tenant pays rent on time, that does not make them a good tenant. Theyre doing what they have to do to avoid eviction or late fees. (Just saying cause she thinks she's a good tenant for being here 12 years). Her complaints stem from, yes she's been in the apartment for 12 years, there's bound to be some wear and tear, but who's tearing it?! As I mentioned she's a nasty dirty house keeper. But the blame of course has to be pointed on someone else. Well that's my story to share. Yup such a terrible place to live, when you have a 1 bedroom with a backyard for under $900. All in all anyone else would have been able to take her apartment and keep it nice, and been happy to have a deal like that. (Just saying that as an example, we would definitely reno that unit when she's gone). If she ever leaves, but the bad ones never leave. 😢

    For "difficult" people, have a stack of business cards for other apartment houses. Remind their lease ends soon. Be friends with the other landlords. Find the complainer somewhere else to live. Share "lookers" with other owners. I like BOTH your letters. Haven't needed in 30 yrs..... But ya never know. THANKS

    What you could have done about the riser for the septic was tell her you will color math the riser as close to the grass as posssible with spray paint or a custom match paint from an automotive paint store. than offer to help her remove the extra dirt around the riser. she had every reason to be mad about that. also after you painted it tell her to plant dirt and grass on top of it or use fake grass. this shows you're ingenuity and willingness to make her happy, instead of saying "i'm sorry you're not happy", if someone said that to me I would be even madder. it's like saying, I'm sorry your just crazy deal with it"

    Some people like to complain. I've had some potential tenants who were like that and we moved on. Listen to how they,talk about their current landlord because that is how they will be talking about you.

      Yes, that's a really good point. If they have never been happy in the past, they probably aren't going to be happy now.

      Not necessarily. We had a bad landlord in the past. We never were late on rent or anything, we kept things clean, we didn't ask for anything except big things like when the AC broke or something like that. When we moved, he tried to make us pay for him to replace 10+ year old carpet. We stopped him from doing it by showing him the law in our state. We told our current landlord this story, and he wasn't phased. Good for him because we've been here a long time, always on time, not complaining unless it's something big. The rent we pay is well below market value, but we're low maintenance tenants. I do get what you're saying, and it's probably true, maybe even most of the time... but it really isn't always true.

    The riser can be painted camo style, other ground covers are better than turf. Ground cover vines, junipers, jasmine ..... are easier to work with than turf.

    Talk about weird house layouts, I bought a rental where the bathroom is between both bed rooms so if a tenant or guest needs to use the restroom they would have to go through one of the bedrooms, lol.

    We had something to the Happiness clause about 15 years ago but eliminated it as it was there way of getting out of the rental agreement. i.e found another rental that they believe is better in rent rate or wanted to move out to save money.

    Hi yes you are right I do have a tenant. She does pay. However, she is very difficult much older and hates it when I tell her to move her car. I am too weak. She wants things done her way. She was to move out in 3 months. However, I had to give her another year to give her time to find another place. Now I am not sure if I can live with a stranger. I hope to learn my lesson. Landlord has rights. I rented an extra room, however, she is expecting too much. It’s hard to be firm. At least I was able to pay the property tax. Still trying to find a regular job. I always end up with the retirees who are fussy. I feel like the tenant is the landlord and I feel like it’s her property. We didn’t sign any lease or rental agreement. I hope she would listen. It is hard to have a difficult tenant. Hard to be firm at times. I always have to apologize. She is on disability and I feel no control . She wanted to park her car inside my back driveway. I don’t want to live with a tenant permanently. This is a single family home. Thankyou for sharing your tenant and landlord. What if I was not happy with a tenant. Now I have to deal with a difficult tenant. She is ok. Not sure if I can give her the happiness clause. It’s hard. 👍😞I am the unhappy landlord. I only gave the tenant good credit for at least paying. I don’t want to be used. I gave her an extension for another year she seems more happier than I am. This is still my late parents home. I almost had a lawyer. It’s too expensive to hire one. Hopefully she will listen to me as her landlady. I regret renting. At least I was able to pay the property in SoCal. My situation is a bit different the realtor just brought this lady without pre screening. She is a good tenant not the type I want to be friends with. I rather sell and downsize.

I am in California looking to invest in rental properties, but here they are so expensive. Living little room for return. So I have been looking into buying out of a state.     Hello. New subscriber. I own 30 homes. Been doing this for 25 years. Because of the EVICTION MORATORIUM, I have changed EVERYTHING i do with the renters. Like, i dont give year leases anymore, only month to month. And i got a happiness clause too...but its MY happiness that gets measured, not theirs. This is a good video to get a lord of the land thinking about stuff. God bless private property rights...

    Hey, I liked your videos and I just watched a video on how you find your tenants and how you screen them. You didn’t mention anything about their credit score and that’s the only thing we landlords can discriminate on And I think it’s legal. What do you think?

    I think I'd let the tenant know in advance that you're going to be tearing up the yard and installing a riser so she's prepared. I don't think I'd invite her to move out. If she complains, you also might asking her what she would like you to do. Maybe she'll have a valid solution. Maybe she'll realize that you're right and say "OK, fine". Maybe offering her a 50% rent discount or something for all the grief might make her happy.
    Installing a septic tank where you need to dig to get to the lid is asinine, really. I installed a riser on a tank at a home I owned once. The riser was a corrugated rigid plastic tube about 2 feet in diameter that could be cut to length with a hacksaw so that you could make it flush with the ground. They make tough plastic lids which screw to the riser with 3 wood screws. The lid was green so that it wasn't so obnoxious. That concrete lid IS an eyesore.

      She did know ahead of time. She just didn't complain until the guys got there to do the work. This tank is a concrete tank so it has to have a concrete riser. I have plastic tanks that have the green plastic risers that screw in, but that's not an option that I know of for concrete.

      @@ItsMandy Oh, I didn't know you told her in advance. It sounded like she was surprised that they were there. She really had no business complaining to the workmen, then.
      My tank was concrete and I used a plastic riser, no problem. I've never heard of anything like "the riser has to be concrete for a concrete tank". I don't see any technical reason for it. Maybe it's a local regulation or something.

      @@ItsMandy I wonder if the septic contractor just told you that the riser had to be concrete because they used mortar (concrete) to seal the riser to the tank and that's just how they've always done it.
      When using a plastic riser, you also buy a special plastic flange ring that allows you to use an elastomeric "rope" seal (made of butyl "rubber" or similar) between the flange ring and the top of the concrete tank. The seal comes on a roll. You wash the dirt off of the top of the tank, lay the seal rope on the tank in a big circle, set the flange ring on top and squash it down. It's so easy, you can do it yourself.

      Hi Jason, I'm not in Arkansas right now. I am back and forth a lot, but my husband and I live in Tennessee for the next few years for his job. I also don't have any properties available for rent right now. I have a couple I'm working on, but they wont be ready until this Spring and I've already had a number of people wanting to rent them when they are ready.

    As a renter I learned never put effort into a home that’s not yours. She’s doing all that work to make the home look nice but it’s not hers. She can buy a house and do all of that. Take care of the home but no do not put effort into a home that’s not yours.

    Hey Mandy, I may have asked this question in the past but I'm not sure. I have a house that I am prepping for renting, and I'm curious. I absolutely do not want someone who is going to mess up the property.
    Would you consider it unreasonable to request to view their house after giving them a viewing or looking at their application? I live in Kansas and couldn't really find anything strictly prohibiting it, but I know it's kind of rude. I figure if they're willing to let me see their house in it's normal state and it's not awful I can trust them a lot more.

      I have a mentor (former police officer) who likes to sign lease agreements at their candidate's current residence (place that they're moving from to yours). This way, you've scheduled something in advance and it's not harsh to be welcomed in while you're secretly checking them out.
      Also, when a prospect views your unit, you can walk them out to their vehicle and you can (secretly) check how they maintain interior of their car (if it's their car).
      These tips are not 100% indicative of a person becoming a bad tenant, but it could reveal insights to the overall picture. Remember, you just have to provide a "legit reason" if eventually you turn down their application.

      I've also heard of a landlord who meets at their current residence to sign the lease. I think it's a good idea, but it feels like it would be very difficult to back out of the situation and once the lease is signed you can't back out anymore. The guy I know says if the house is really dirty he either leaves before even going in or pretends to get a phone call and then says, "I'm sorry apparently there has been a mix up and my business partner already has the unit rented to someone else." So in my opinion, while I would like to know if they are clean or not, I think the situation would be too awkward and I don't really want to put myself into a situation where I have to lie.
      This is what I do instead. If they are local you can drive by their current address. Look up their social media profiles. If they post a lot, chances are you can find pictures or videos with their living conditions in the background. Call their current and previous landlord, ask if they took good care of the house and kept it clean.

    Hi Mandy! I wonder why you had difficult tenants in the past since you know that tenant prescreening is the most crucial part, which must be done right before deciding whether or not you put a tenant in your rental property. With that said, you must have done an excellent prescreening and then why the tenant turned out to be a difficult one. I am not critical or doubtful of your content or anything like that whatsoever. Still, I am curious why it ended up in a bad situation for you instead since you'd done an excellent job prescreening the tenant(s). I wish to know how this happened with a well-done prescreening. In other words, I am about to become a new and inexperienced landlord of my first rental property soon and want to understand why what happened to you happened. Thank you! :-)

    She thinks there's an issue BEFORE tank problem hahahahaha. Wait till it overflows and she can't flush or use her sink. She'll be out of service for days and have to move to hotel till its fixed.... and interior piping cleaned. YUKKKKK Her cost since she refused service.

    "How to Deal with Difficult Tenants" so let me guess you also know how to deal with difficult landlords since your one yourself? Also you have a privileged position as a outright owner [of some places] so you should be able to be neutral and honest.
