How to Stop a Garnishment
zhlédnutí 1,6KPřed rokem
To stop a bank account garnishment, a judgment debtor should file a claim of exemption, gather all documentation in support of their exemption, and be prepared to prove entitlement to an exemption to the creditor's attorney or to the judge. A creditor can serve a writ of garnishment on a bank regardless of whether the money in the bank is exempt or not. The bank can, and should, freeze the acco...

Are the Florida statute of limitations regarding debt the same for businesses as they are for individuals (5 years from the last date a payment was made)? We have an old vendor (phone service) harassing us for money we do not even owe. We cancelled our service with them and ported our numbers to a different provider five years ago. Since they continue to harass us for a debt that we vehemently dispute, perhaps the better approach would be focusing on the statute of limitations? It has been more than five years since any payment was made to them at this point. We started getting these calls maybe a few months ago (and emails, often times several a day in addition to rather detailed phone messages being left with employees). I don't think it's legal for them to be contacting us this frequently either, is it?

I have gained valuable knowledge from your videos. However, there is a lingering question that I would appreciate your insights on. My wife and I jointly hold the title to our Florida homestead home. According to my research, in the State of Florida, if a married couple takes title to this property at the same time, it is assumed that they have taken the title as "Tenants by the Entireties", even if the technical title is listed as husband and wife. I would like to confirm if this assumption is correct or if there are any other factors that I may have overlooked in my specific case. Is this true? If not true, should we have the title changed to "Tenants by the Entireties"? We don't have consumer debt, just the mortgage on the home. Would it be a good idea to maybe put the title into a Land Trust for estate planning (2 kids, one is a minor) and some level of anonymity?

Meaning if I buy a cheap piece of land in Florida that I want to use at a later date and it is not even worth much. I rented out to various people, for whatever storage etc. Something happens to them or their guests. Like they fall they get hurt from something on a fence or anything.
