  • The statute of limitations in Florida is a law that restricts how long someone has to sue another person after a claim occurs and a legal cause of action arises. The statute of limitations is 20 years for judgment recovery and unpaid property taxes, but 5 years or less for all other causes of action. The purpose of the statute of limitations in Florida is to encourage people with a valid claim to timely file a lawsuit.

Are the Florida statute of limitations regarding debt the same for businesses as they are for individuals (5 years from the last date a payment was made)? We have an old vendor (phone service) harassing us for money we do not even owe. We cancelled our service with them and ported our numbers to a different provider five years ago. Since they continue to harass us for a debt that we vehemently dispute, perhaps the better approach would be focusing on the statute of limitations? It has been more than five years since any payment was made to them at this point. We started getting these calls maybe a few months ago (and emails, often times several a day in addition to rather detailed phone messages being left with employees). I don't think it's legal for them to be contacting us this frequently either, is it?
