I'm looking for Lithium batteries now for my camper. Absolutely will never consider DCS for any product ever, and make sure everyone I can in my various clubs and service organizations know that no one should give them a penny ever.

People are allowed to critic products, people are allowed an opinion as long as the critic and opinion is fair, is just, is honest and above all is constructive but it becomes more of a problem based on who the person is that has made the critic or opinion. It's all based on what's known as the 'weight factor' as in how much influence does the person have over the subject matter that involves the product having the critic made upon it. Meaning is the person experienced in the 'field' the product is in. The 'weight factor' can be explained as thus:- A non experienced, non specialised person, basically just your average Joe Blogs makes a video saying x product is crap and people should not buy it. Then comes along an experienced person who has spent years working with x product and has reviewed many other products says x product is crap and people should not buy it. Applying the 'weight factor', Joe Blogs has no weight factor because he/she is just a nobody really who is venting their anger/displeasure at product x but with the experienced person, their weight factor is high because they have experience in the 'field' the product is used in thus customers are going to pay this person more attention on their critic/opinion than they are on the Joe Blogs nobody. This is why it is extremely important for those who are experienced who are reviewing a product pay extra care and attention to wording used in their critic. If Stefan Fischer has actually made an honest, fair, constructive review of DCS battery then he has nothing to fear because courts take a very dim view of companies using the legal system to silence negative critic of their products. Even if Stefan was not able to afford legal costs he can still use the media to attack DCS for using the legal system to silence honest and fair criticism of their products because he would be able to claim that a company with money is bullying a product reviewer into silence because the company did not like negative review. Such media attention would do DCS a lot more harm than it would taking Stefan to court. But this could all be a mute point if DCS legitimately feel the review was wrong on numerous counts but if DCS are trying to use bully tactics here knowing their case is flimsy the court Judge will see right through their ploy, dismiss the case and award costs to Stefan. Therefore DCS need to make sure they have a solid case against Stefan because if they don't they will get hit hard in costs by the court.

Crazy that I found this after finding out an English company named DCS is suing a youtuber for defamation over a negative review. What are the chances?

Won’t order from DCS

Just saw some U.S. interest from Louis Rossman discovering DCS quietly diluted their warranty terms but incorrectly stated they had not updated. Not a bunch I'd buy from. When I broke my Cannondale bike frame, did they wriggle ? No, they unquestioningly gave me a new one. No guesses on what brand my next bike was. How did DCS expect this PR train wreck to go?

I found out about this from Louis Rossman despite following many 4x4 channels. DCS are now well known by electronic and computer enthusiasts across the entire planet for literally all the wrong reasons.

Its a bit crazy this is happening. This is a way different area to what happened to HardwareUnboxed a year or two ago where Nvidia tried to direct thier editorial direction, was told no and tried to basically cancel them. Then all the major tech youtubers came out in defense of them and Nvidia backpeddled within almost 24-48 hours. That was a win for independent reviews at least for GPUs in PCs. I hope this one gets dusted under the carpet and doesnt go any further. Should it go further I will definitely look forward to Luis Rossmann's take on it.

And this video itself, could be seen as defamation of character, far more than Stefan's reviews are. You talk about a company. He talks about products. Be careful and thoughtful when naming the company involved.

In my experience, defamation of character can only be applied if is directed to towards an individual or group of individuals. One cannot defame a product or even a company. If this was possible sites like Trustpilot and Product Review could not exist. And no one can be sued for an opinion. If this was possible, we'd be living in North Korea. He didn't review the company, but products the company makes. Its an opinion based on his experience - and his alone. If they think Stefan's review will hurt sales, wait an while. This action may do 100-time more harm than any review could. Now everyone is talking about it. Who is going to talk about their products with this threat hanging over their heads? And should the business fail because of it, they will blame Stefan. When they pulled the trigger themselves.

The best way to help is to write a real (paper) letter to the company, letting them know what you think of their actions. They will get a pile of mail at their office that they can not ignore.

DCS needs to grow up or get out of the game. I will not be buying any DCS products. Where there's smoke theres fire.

I don't think DCS understands what defamation is. If something is true, it can't be defamation. I've been using Li-ion battery technologies for a long time. I design and make my own battery systems, so I understand some of the issues. Li-ion technologies are very sensitive to temperature related issues, for example charging them at elevated temperatures or below zero C can have detrimental effects on their longevity and that's without going into other issues such as balanced charging. LiFePO4 batteries are safer because they have a much higher thermal runaway temperature. This does NOT mean that they are any more tolerant of high operating temperatures. I would not consider them suitable for under bonnet use except where a cooling system is incorporated into the battery case, and that would become extremely expensive. I have no problem with ruggedised battery cases designed for high vibration and partial immersion, but temperature is something that can not be easily mitigated. The claims for under bonnet lithium batteries should therefore be approached with a good degree of circumspection. There's a reason why no major car manufacturer has adopted Li-ion technologies for under bonnet use. Li-ion is superior to lead-acid technologies in many ways, but this is not one of them.

For this reason, I have subscribed. I'm not the least bit interested in 4x4s but I have VERY interested in freedom of speech.

Sounds like they have a lawyer in the family or in their close friends/connections with all the suits they seem to be tossing around.

I would have thought the first step would be to work with reviewers to improve the product or at least understand why he came to that conclusion. An instant emotional response proves either they know something is wrong with their product, or they lack maturity.

Pro tip: Under Australian law, only companies with fewer than 10 employees may sue for defamation. Large companies cannot sue in this way. So only a small company can sue for defamation. Also, truth and opinion are two key defences for defamation. (Toyota's unable to sue you for defamation, for example.) Honest opinion is how restaurant critics get away unsued after a negative review.

I cannot understand for the life of me, why they think that someone would lie about the poor longevity performance of their batteries. The fact remains that their product was also tested by a reputable company who now no longer use and endorse DCS batteries due to the results of extensive testing. Their product failed miserably and they admitted that by default as fact, by replacing those faulty units. Any company that decides to take legal action against a person who points out the flaws in their product, instead of using that data as a learning curve to improve and grow, is a company that is destined to take a high speed nose dive into oblivion. The data that was collected will no doubt be used as proof that their product is faulty, that the review of said product was true and factual, and will inevitably vindicate the defendant in their inane and pathetic case for defamation against an honest person who is helping the community by pointing out their product's flaws. I watched that video review, his results clearly showed the flaws in their product and they have the audacity to sue him for it. I really hope they go through with this, because the man is providing documented evidence every step of the way of their low and underhanded tactics in an attempt to silence the truth. We will no doubt be amused after he posts the results of his court appearance on the 30th July. Their name is going to be drawn through the wringer. I hope they have fun paying for all of theirs, and his legal fees associated with their knee-jerk reaction to the truth. They deserve to be out of business.

What a dog act they are doing. Stand by the quality of your products. They could have provided a better video of how to test their batteries but they decided to deceive customers with their warranty. The truth, is the truth, is the truth. Keep your chin up guys. If DCS are going down this path, DCS is probably partaking in deceptive business practices.

Reminds me of the foreign companies from Asia that would go after vape reviewers and have total meltdowns using official brand accts via comments lol they can't deal with criticism at all and they will just lose it, i have a feeling we would of seen that had they not persued legal action

IANAL, but: a corporation can’t sue for defamation unless it is an “excluded corporation”. An excluded corporation includes a not for profit or a company which employs fewer than 10 people. Large corporations can sue for a related category called injurious falsehood, but I'd be surprised in they could win a case for a negative product review, unless the review was intended to harm the corporation. I would say this won't impact online products reviews, except when they are distributed/manufactured by an excluded corporation, in which case their products will never be see on CZcams again. Lose lose.

I wish I could be a fly on the wall in the corporate meetings at DCs with all these videos dropping. Whoever made the call to start litigation has to be completely out of touch. It almost always goes this way. I feel this should he taught in both business and law school.

Incorrect. Those in the US have the first amendment to protect their free speech, so they would get laughed out of court or rejected entirely from anti-SLAP laws. But yes, shit like this makes it difficult in Australia.

There is nothing anyone can do or say to “defame” DCS that could be worse than what DCS is doing to themselves.

If this court case is successful the final outcome will be that if you even go into a restaurant and don’t like their food for example and tell the staff or review it online ie Google reviews you could be sued for defimation. Common sense has to prevail in this case as everybody’s thoughts and opinions are just that, they belong to the person expressing them, not to the company or business that is being reviewed. Just like art, food, clothes, cars, houses and the list goes on, everyone has differing thoughts and feelings towards them. To be honest, this line of thinking/expression must be defended no matter the cost involved, otherwise it’s a slippery slope indeed!

We need and must have independent and impartial reviews to inform and let us (the consumers) decide if a product is suitable for our intended use, or Not! I have purchased too many products only to find they fail prematurely or do not perform as expected during my use or find the product description misleading leaving me out of pocket often with no re-course as many retailers and mfrs will not repair or take the faulty product back. A much more constructive way for us all is for manufacturers to use the reviews to improve the products and eliminate identified defects for the benefit of us all. If DCS or other manufacturers find a way to silence independent reviews such as Stephan or others who carry out similar unbiased and independent reviews on our behalf we will all be worse off. We can then look forward to SWITCHING OFF CZcams as an independent source of product information or services as any remaining reviews will be completely owned and strictly controlled by the manufacturers or their distributors. There are already plenty of those type of reviews online !

Allegedly the Lawyers are the only one's to win in this case, P-ss Poor response from the Battery supplier, like everyone says, take the criticism/testing onboard and improve your product, its not F-cken rocket science. Just allegedly Stoopid as F-ck! Personal Opinion.
