My Daughter is UK Born. I beleive she will be eligible for Bristish citizen at same time when i apply for my ILR.
My query is: can she stay outside UK for more than 6 months until she is eligible for British Citizenship.
Yes, she can
Hi,
I am a paid member of your channel. So based on that i am rasing the below query.
My Tier-2 General UK visa is granted on 25th March,2020 and valid until 15th April,2026(as the company agreed to extend 1 year). Unfortunately, due to covid restriction I’ve continuous absences.
Absences Calculated :
April,2026 - April,2025 --No absence expected
April,2025-April,2024 --No absence expected
April,2024-April,2023--No absence
April,2023-April,2022--No absence
April,2022-April,2021--Arrived in UK on 13Aug,2021 ,so the absences are from (12 Aug -15 April,2021) which is less than 180 days.
As ILR counted backwards, Based on this calculation, I will spend 4 years and 7months in UK. Am I still eligible for ILR?
Your feedback will be highly appreciated.
Thanks in advance.
Hi
Thank you for being a valued member and for your query.
Based on the information you've provided, your qualifying period for ILR will start from your date of entry in the UK, i.e. 13 August 2021, since your absences from the UK since the date of issue of your visa outside UK, i.e. 25 March 2020 till your first date of entry in the UK on 13 August 2021, is more than 500 days. So, your qualifying 5 year period would be from 13 August 2021 to 12 August 2026. (I am assuming your first visa was issued as an Entry Clearance application, i.e. Outside UK)
@@visasolutionsuk Thank you for the quick reply.
I read on GOV.UK site that ILR counted in backward date i.e. in my case it would start from March 2026 to Aug 2021(which is 4 years and 7 months). As per these dates I would be 5 months(which is less than 180 days allowable absences) short in completing my 5 years. Does it not enough to qualify for ILR?
Does date of Entry matter in my case as I have total 6 years of Skilled Visa?
Thanks
Kapil
Yes, entry date matters in your case, since you don't have the option of using your date of grant of visa.
@@visasolutionsuk Hello, My employer agreed to extend the visa for 2 years i.e. until 24 March 2027. But for my family they would like me to initiate. Can i submit my family visa for 1.5 years(as after that they will be applicable for ILR in August 2026) instead of 2 years to save IHS cost.
Also can i submit my ILR in August 2026(after completing my 5 years) or do i need to keep on hold until 28 days before my visa expired in March 2027.

Hello,
My wife is on Skilled dependent visa and is staying in UK from 2.5 years. Her employer is ready to give her sponsorship to become Primary Skilled Visa Holder.
My query is: Do she need to stay more 5 years to get the ILR? Or she will be eligible after more 2.5 years? As i am not sure if her counter will reset to zero years after changing her visa type from Dependent to Primary.
Yes, it will reset, she will have to complete 5 years as a Main applicant
Hello sir .. first of all thank you for sharing informative video that really easy to understand… I have one question about my own visa

No, Dependants have to apply for the same period as the main applicant, so they will also have to apply till 24 March 2027

Thank you for the information, helpful! I had one question - If I travel outside of the UK for office work / business travel and stay outside of the UK for more than 180 days each year... I am on a skilled worker visa.. will I be eligible for ILR in that case ?
I am mostly out of the UK on business travel and have to stay overseas for many many months.
Also for festivals + holidays I also visit my hometown in India - that is also included. Can you please help to share your thoughts on my question above. Thank you!
Strictly speaking, as per the Immigration rules, To meet the continuous residence requirement the applicant must not have been outside the UK for more than 180 days in any 12-month period. There are some exceptions, but to advise on the exceptions, we will have to take further details during a consultation, please book a consultation with us.
Hi Sachin do you mind sharing the ukvi link which states this immigration rule change in terms of absenses confirmation not being a requirement?
The new rules are under Appendix Skilled Worker at www.gov.uk/guidance/immigration-rules/immigration-rules-appendix-skilled-worker
Thanks for link; however i cant find where it says it is jot required thanks

Hi, on a skilled worker visa, 180 days are allowed to be absent from UK each year and one can still get ILR without any issues.
Now the question, consider I work remotely from outside Uk for 3 months and do draw salary from UK employer during this period.
Does this affect ILR?
Once we are outside UK, govt does consider it as absence. But what if we draw salary working remotely from outsiders UK. Does this affect ILR ?

UK Skilled Worker ILR - I don’t have confirmation of absences from my employers?
Hello Sachin,
I came to UK in September 2021(visa name at this point of time is skilled worker visa) and have been to India and stayed there for a month or so for few times till now.
Do i need to submit these absences when I file for ILR ? The change of rules which you said will apply to me or I have to submit the absence letters?. I had to work from India for a month or so when i went to India due to some family issues and employer does not know it .
Please let me know.

Hi, I am British citizen and my wife's initial visa period was between 20/10/2017 to 03/07/2020, during this period, she ended up staying outside the country from 28/08/2018 to 19/06/2019, 295 days due to family circumstances. Her current visa runs from from 23/02/2021 to13/01/2024. is she eligible to apply for ILR with the fact that one of her trips was for for 295 days. please clarify,
We have successfully done similar applications, mostly she will be successful in getting ILR if we are representing her with the application, we may need some more information about the family circumstances and if there is any documentation to prove that, it would be helpful for the legal representation.
