California Child support has been the worse thing ive ever faced... This system screws the child and the father on child support ....even if the father spends more then half of time with thier child. They still have to pay child support to the evil mother... The father then has his own expenses and is left eith very little or nothing to spend with the child during his time spend with them... I don't agree that mothers are almost always primary. I am a child custody recommending counselor and i almost always recommend something like a 2 day/2 day/3 day and rotating holidays, shared school vacations and joint legal custody. Children usually need and want both parents and i think they do best with both, assuming theres no abuse or other risk factors. In my experience many parents, especially mothers, have no idea how important the other parent is to the child. They forget the child is not divorcing either of them. And i can tell if a dad is motivated by child support. They usually aren't although mothers often accuse them of wanting parenting time to minimize child support. Fathers love their children just as much as mothers do very often, in my experience as a mediator, attorney and clinical social worker. Just my opinion.

This is so untrue I had my son took in from me buy a wife that beat me got arrested and put in jail fought the cops right in front of my son I didn't press charges she took my son for me before and didn't want to ever let me see him again the California court systems for custody has been so unfair and unjust to me and my child my wife filed custody for my child I had custody and was working on getting us equal time because I believe a child should have a mother and a father as long as he is safe but that's not what my wife wanted so after getting out of jail for punching me in the face 10 times in front of my child and fighting the cops in front of my child 4 months later without talking to her child for six months while he worried about her cuz he seen her go to jail I was told she was in a rehab by her parents 7 months 7 months after getting out of jail I show up at my 4 years old son School to pick him up and she's there with child custody papers from the court they tell me I have to leave and I can't have my son after he's been with me for his whole life and she's always been absent she takes my California organ that day I was never served until that night after she picked up our son by a certified server I find out she's been going to court for the custody hearing and I've been missing all of them the person that claimed he serve me even went to court and testified that he serve me and she me smoking pot with my four-year-old son and another 6 year old date and time and he said he served me I have records from the school that Richie was in school at that exact time we go to the address that was given for this person the address takes us to a halfway house they tell us they haven't heard of him they had another address on the paperwork for him we went to it it was a motel we went and talked to the motel manager they said they knew him they said he didn't have a vehicle he couldn't have made it to my house because he walked and that he's a drunk and he just went into rehab a few days before all I had to do is get my chance to cross-examine him and ask him how he got to my house if he doesn't have a car and driver's license and if someone took and then we wanted to question him I subpoena him to the court which I don't think it would have made it that far because the manager of the motel that knew him well said that he really didn't have anyone that had a car or new to me people he was just a Wonder the manager of the motel said he would testify for me I got a lawyer that did nothing while trying to get me to pay $3,000 to someone that she knew for an evaluation on the very first day of course she ask the judge to give me anger management classes what she said would help me that they used against me later my wife's intern it wasn't even a lawyer it was an intern she was using I don't know why the judge or my lawyer didn't give me my rights to cross-examine the witness I had many other concerns some that involve my son safety do to my wife's brother that is violent and I had to talk to my son on the phone and he was crying because her brother message Adam and sprays you in the shower with cold water I went tell the judge and for that the judge decided that I should have my phone calls listen to and did not take my concern seriously I didn't have the money to keep going to the anger management classes after 3 months I didn't have the money to keep going to the anger management classes after 3 months and with my case going down the tubes I couldn't afford the hour drive through classes and the classes so I stopped going her intern use that against me and said that I'd stop going my classes I told the judge that they were voluntary and I couldn't afford it I asked the judge I said where's the proof that I have an anger management problem that the court shouldn't be able to force me to take classes for something that they have no evidence against in fact they have evidence of just the opposite in the police report for my wife but me and the police and I never once yelled or got angry I just walked away with my son to try to avoid her as she pulled the phone out of the wall busted through a window in her Rampage to try to attack me while I had my son in my arms crying because he seen her bust my face up and it was bleeding and he was saying mommy hit daddy it was a nightmare for both of us for months because she didn't even call him to let him know she was okay and I begged her parents to please have her call I have police records I have written documents from Child Services that said they didn't want him going out of state or being with her after they had a conversation with her on the phone they felt that she needed to be in counseling it came to my house looking for her they gave me drug test they checked the house they felt my son was safe with me and she had took off 2 days before they showed up at the house and I had no idea where she was I had no phone number for her I didn't know anything of where she could be and I can see her for months Norton my son if I had custody of my son right now where I knew that she couldn't take him and keep him and where I would never see him again then I would give us equal time with him too much on two months off too much with her too much with me or whatever worked for Richie because it's an about us It is insane the amount of times she refuses to follow the order, I filed contempt charges years ago but did not fill out the paperwork right and her lawyer demur it and it got thrown out. I went through 5 supervisors trying to get her to show when court said I needed to do 10 visits. She refused to even respond to them for over 18 months, in which my old lawyer has proof. I hope anyways. I have evidence she lied on court papers to get a TRO, lied about why she did not come to visits or why people could not supervise anymore, she bribed me at one point to sign away my rights. I have begged pro bono services to help with no one returning calls or not getting back to me I am guessing because it has just become a mountain of issues. I know for a fact though if she loses the contempt, which with all the proof I have I do not see it possible for her to get out of this, I can get lawyer fees, and she makes more then enough money. I am here because I am desperate. Please any help you can give I will take or advice. Thank you.
You can go to the court’s clerk office and have copies made for a nominal cost. Except for thinking, planning, and research notes, all the documents in your attorney’s file are legally yours including all the originals, even if you owe him a million dollars and never paid a cent. This include any letters between attorneys or others. The Calif state bar will back you on this.
As a grandfather, my wife and I raised our three granddaughter's since they been born, now their mother wants custody, she only visited two times a year, still married to son, but not togther, she had two more childern from new boy friend, going to court to fight for custody, son approve us with kids. Should we be okay?

All you have to do is walk in to the clerk's office and ask them to show you all money judgements against you that are signed by the judge and the clerk of office that has been entered in to the record of it has not been signed and on the record then it's a void judgement and you do not have to COMPLY.
what if, i (the father) opened the custody case and the mother never responded to the subpoena after 36 days and i entered for a default case, what happens then? does the parenting schedule i wrote down become the schedule set by the court i have my daughter 70 percent of the time
I'm sorry but in my case the California courts have failed me my son and my wife as far as I'm concerned because someday the effects of not having both parents is going to catch up with my son and I hope and pray God be with them if anyone is interested in seeing a case where the California court systems have failed under the weight of all the evidence after raising my son for years Social Services come looking for my wife and they find me and they find me to be a good home for him and now after 4 years all of a sudden I'm not fit to see him at all and still there is no evidence that would that would bring such a ruling my wife was supposed to be seen a psychiatrist that was what she told the judge and yet she's not in fact when she went to the psychiatrist to get a evaluation for the court I couldn't believe it the psychiatrist said that she was a mess and that if she showed up on a regular basis that he and her maybe up to work out some of her issues to where she can maybe get control of all of your problems and yet the court scene that as I guess a good thing if she would have went and the psychiatrist said if she got custody of my son he should be going to counseling to because of her issues and neither one of them are going and I can't do nothing I am stuck knowing the kind of treatment my son is enduring now I don't think my wife is dangerous but I do think that her brother that has been very mean to my child and other children that I have seen and to my wife you can't let him do that to children not that it's her responsibility to control him but children should not be around him and my son lives in a trailer with one bedroom her mom her and that brother that when I told the court I didn't want my son around my wife said he didn't live with them and he does what the California courts when it comes to custody has failed not just me my wife my family their families my son was Society and I believe that with the right lawyer I could probably get her to I will be fine as long as I the mom does not contest..if she does show your prove she will probably just get visitation rights..
If she abandoned the children then she won't get custody.

case you would run out of California Screaming and that isn't even everything I the courts I've done and if if you seen all the people working evidence and things that I have that has been wrongfully done by the California court systems you would think how could this possibly been a mistake that the courts made I could become a foster parent I could actually qualify to be a foster parent my parents were foster parents but yet I'm not allowed to be around my own son without supervision and he's not doing his reading and his math and all things that I worked with him all the time on the few times I get to talk to him he said he doesn't read or do math like we used to anymore and he should be able to least write me a letter by now he sits and plays video games now all day with her brother's kids and he has a three-year-old daughter that is suicidal I asked her and them how could a three year old girl be suicidal I still don't know the answer I'm afraid to I hope this will help
