      You need to study the original covenants used to set up this body originally, and the ways in which they might have been updated or modified in the interim.
      You also need to do a FOIR for ALL documents relating to this current process, as well as ALL COMMUNICATIONS between ALL interested parties.

    The head of the Malvern Hills Trust governance is a Worcestershire district councillor, representing the Green Party - Professor John Raine.
    I have never seen such poor governance - it is nonsense.
    Professor John Raine should resign from the trust, in disgrace.

    I took part in a government consultation and received a email saying it was being suspended as soon as the election was called. This is another example where local and national government/authorities want us to pay for, but not be able to scrutinise or question. Democracy is slowly dying in this country; we need change.

      more like a water grab, there are 33 springs on the Malvern Hills, one closed around 5 years ago due to it's path proximity to houses sewage systems on the hill... Pepsi desperately wanted the Evendine Spring source as they got water from far down it's path and sold it as Malvern Hills water, but it would have had to be filtered due to an overland/underland path to it's factory 5 miles away...

      We all voted against Waitrose being built in the space where there was a natural reserve, with protected trees and rare butterflies.
      80% of inhabitants had said no to Waitrose and yet it got built!!!!!
      Who let this happen?
      It's always Waitrose which gets build next door to Somerfield !!!
      This is happening across our country!!
      How our planning department gave the permission for two supermarkets to be meters away from each other?
      When Matalan submitted a planning for their shop, they were given a go ahead on the condition Matalan won't sell food, as this would be in direct competition with Safeway!!
      And the very same planning committee had allowed Waitrose to be built about 10 meters from Somerfield!!
      This is really very serious matter and it should be investigated by the appropriate authorities!!
      It's possible to find the article in the Malvern Gazette in which the planning department is quoted talking about the direct competition.
      This is so blatantly wrong!!
      Something illegal had occurred here.
      All internet sleuths desperately needed to find the guilty people.

      This type of thing is happening even at local parish councils, where they take a precept and do things locally without consulation etc. Example in ours has been printing up leaflets and promoting ideoligical minority groups with the 'dosh' from the majority.

    I used to work for metal box in the 80s and early 90s and spent A lot of time in Worcester as that's where our training school was located. Its totally wrong what they're doing in the Malverns. Its typical of the local governments and their quangos to make land grabs totally criminal. Using local poll tax monies to carry out what ever they want. Hopefully the people of Worcestershire will win. The Malverns is a beautiful part of the world and the public should be able to enjoy it.

    What is the structure of the Trust? What does the Trust Agreement contain? Who owns the land? Trustees have no power to act outside the parameters of the Trust Agreement. Only the Grantor/Settlor has the power to edit the Trust Agreement. On the limited information mentioned here, it appears what the Trustees are attempting to do is a breach of fiduciary duty. Depending on the severity of the breach, the Trustee(s) can be charged with theft/embezzlement and be sent to prison.

      Who are the named beneficiarys of the trust, surely if the electorate are the beneficiarys and therefore could as a group apply for the trust to be dissolved. I'm not an expert in law but surely a trust can be unwound as well as created, it's just less common.

    Just checked my facts, And Welshpool Burgess Trust sold off 40 acres for development for millions. Trust was set up in about 1760, for the betterment of the community, but incomers sneak in and screw things up for their own vanity. Happens everywhere I am afraid.

    A similar thing is happening in Australia, National Parks are locking gates to stop recreational drivers from using the park tracks, but on one site bulldozers have carved a massive new track into the hills. This track is for the construction of a wind farm, destroying a huge tract of land in a pristine area of the Glass House Mountains. Our Federal Minister for energy has just announced a multi billion dollar wind farm to be built off the south coast of New South Wales, this is total lunacy. We have total ban on nuclear energy in Australia, the head of the Federal opposition has proposed to build small nuclear reactors on the sites of the now disused power stations in each state.

    WAKE UP PEOPLE!!!!!!! The Malvern Hills are unique because of how it is and how it has been managed for the last 140-odd years... I used to work for a charity with a similar set-up to this - Some funding from local coffers to provide LOCAL SERVICE and we were constantly on our guard to ensure we followed our charter and never overreached our purpose. We were responsible to the ratepayers and had to justify our existence to them by providing the services we were created for.
    800K quid on a draft bill? I would question whether that in & of itself is a legal or justifiable use of funding? The thought of that landscape being fenced in, turned into some horrible money-making entity for Council and other vested interests was NEVER the intention of those who set aside this area for the benefit of LOCALS and visitors, alike. If you don't stand up against this kind of tyranny, then England will be gone forever...

    These people have money and power. If they don't get their way at the council local level. They go to government to lobby/challenge decisions at the local level. There are often conflicts of interests, undeclared, which they are supposed to do. What happens they win by overturning local descisions. Thus ensues the frustrations and anger. There is no democracy in the UK.🤬🤬🤬

    I took at the website of this ‘independent company’ that has been hired to conduct this survey. I would say that looking at the language used on their website the independent term used is very questionable. They talk about working in partnership with their clients, they ‘get under the skin of your organisation’ to provide insights to answering the questions that a business is grappling with. They use the terminology of consultants and that does not make them independent. They are working to put into place what an organisation is trying to achieve. Looking at the questions posed these can easily trip up people into responding to the survey with the desired answers, thus making the outcome being in favour of the organisation. No independence there.
    I would recommend that all who view this presentation complete the survey and use the answer technique that has been suggested. People need to stop these useful idiots who are committed to destroying our freedom and democracy. Do something to support the group fighting this insidious attempt to remove public scrutiny and oversight.

    The MINUTE "Councils" talk about fencing Common Land - you know there is nefarious intent afoot - I'd be looking for Green Energy installations, turnstiles, restricted access, paid access, etc. etc. Flat out: tell 'em to s0d off - it's the thin edge of the wedge and have they nothing better to do with their time and funding than interfere with resident's rights enshrined in law and Practice for over 100-years. How can we get Councils back to their original intent and purpose? It's something else which makes my blood boil. G'd on you Geoff for highlighting another SCAM and Massive Council Overreach...

    If the question that you want to answer isn't on a questionnaire, write it in with your answer. Should sufficient residents do so, it can probably not be ignored. Do so and publish it online to prove the residents' resistance to this whole thing. Hey, there's an lection 2 weeks tomorrow, ask the candidates what they would do about it! Good luck.

      we have not done so for about 20 to 25 years not since the earliest days of tony 'the liar' blair when he got into power this country went from a democratic power into a type of limited socialist state i think it refered to as a socialist democracy wwhich has aspects of a democratic governance but also has aspects of a socialist state.

    Best wishes on this. My grandma on my dads side was from the area and my parents and grandparents on my moms side spent much of their free time in and around Malvern including camping. If they take power like this we have to assume that it’s not good for the paying residents.

    Walked up the Malvern hills a couple of times whilst
    being at the Van fest. Hanley swan was a good place to end up in.
