Sorry, the APC has claimed them at various times , including the Rivers State Chairman of the APC. You don't have that right.
Meanwhile, they do not have to join any party after leaving the PDP. Nigerian constitution does not make it mandatory for citizens to join political parties. The fact on the ground is that they have publicly renounced the PDP at several fora including via a sworn affidavit at the Federal High Court Abuja where they claimed they defected on the grounds of a non-existent division in the PDP. PDP does not have to expunge their names from the PDP register to give effect to their sworn affidavit. The affidavit is complete in itself and of itself proclaiming their dissociation from the parent party from which they got elected to their positions in the state Assembly. Having thus abandoned their membership of the PDP, they have automatically abandoned their PDP mandates and have their Pdp owned-Assembly seats vacated
How lawmakers defect from one party to another. It is very clear. Lawmakers defect from one party to another either by a letter to the speaker of the house or to the senate president to read on the floor or by oral declaration in the house.Secondly, a lawmaker must openly declear his defection before a membership card issue or register. Martins and co are no longer lawmakers as far as the Nigeria Constitution is concerned. Judges should based their judgements on the Nigeria Constitution, not anything outside the Constitution.

There was motion, discussion and acceptance that was passed on the floor of rivers house of assembly where the 27 members decamped from PDP to APC. They can't destroy that document, the tv declaration and other actions they took as members of APC since then till date.
That declaration has not been reversed and can't be reversed until final judgement of this matter up to Supreme Court.

Dr. Ikokwu....I don't agree that APC needs to claim them. What's important is they have defected from PDP, even if the defection is to their home or to nowhere, the important thing is they don't represent PDP any more and cannot hold a seat on behalf of PDP.

There has to be education and awareness in the northern Nigeria for the country to move on. The Northerners where known as been truthful to their belief and content with their lifestyle. The rogue leaders have been trying to keep them like that, but now there's a wave of change and awareness thanks to the social media and the leaders are scared of this change. The legislators did not approach the court in the circumstance. The other side approached the court to say they are no longer members of the house. The Fubara team lost the case that they were plaintiffs. Who is a member of a political party pls? What are the requirements? The law is clear. The provision of the constitution on defection is clear. No emotions can change it

See, it’s not our business whether or not they informed their party before the said defection. The defection was duly announced on the floor of the house of assembly and the new speaker did the needful consequen. In the eye of the law therefore, the argument will be between them and their old or new party, it doesn’t change and cannot change the action already in reaction to the information/notice of defection that was clearly given on the floor of the house during plenary. The law does not require an investigation into party’s activities in relation to defecting members before their departure is accepted. The judge in is biased or maybe ignorant of the facts of the case/the law.
Educated ode, court in Nigeria and anywhere doesn't work by emotions. If I go on TV tomorrow and I announce I am the chairman of PDP, did I contest? Was I chosen?
