@AnuragKumar-df3wi police received a oral complaint from swati and Sanjay narrated the same incident is on the record. So police is very much right to take statements of all the person who were present in CM house at that time.
It depends of the person who complain, this is not a murder case that police will investigate without FIR. You have to file FIR first
