    Just for the record, In Wisconsin, it is unlawful to apply the brakes unless there is a legitimate reason to do so. It's amazing how many rabbits and squirrels have tried to cross a highway since this was enacted.

      Having someone on your rear bumper is a legitimate reason to slow down. It's not safe to be doing 60mph with another vehicle 5 feet from your bumper.....so you have to slow down. If you slow down a little quicker than the person behind you is expecting that is their fault, not yours!

      @@gregbarry5875 As a former professional driver AND a former Driver Education Instructor, I can say that you are using flawed logic. Being tailgated is NOT a reason to slow down. Even if this happens in the rightmost lane. You have an obligation to do everything possible to AVOID a crash. Hence, maintain your speed. If your in the a leftward lane, then maintain your speed, signal, and move to a lane to the right. Don't be another "headache" on the road. Sudden and/or abrupt speed changes are dangerous and can affect many drivers at the same time.

      @@beksbrat When I had Driver's Ed a long time ago, they taught the "Fundamental Speed Rule" which said you have to drive the appropriate speed for the given conditions. For example if the roads are snowy, the posted speed limit may not be safe and you are expected to slow down. I am saying that driving at 60mph with someone right on your tail is not safe and you are obligated to slow down.

      Probably not. People who do that are hyped up either on caffeine or energy drinks.
      Some are just type A hyper active people.
      A woman where I worked did that EVERY day on the way to work. She finally hit somebody who braked for a deer that ran out. Six cars stopped to make sure the cops got the story right. She tried to blame the guy she hit. Six people were willing to make statements that she was tailgating and that they had seen her tailgating numerous times. Cop got the message. He found three more things with her car ticket her for. It cost her a bunch of money and her insurance about doubled. She was dumb enough to whine about it a few months later.

    I remember doing something similar to this some years back.
    It was mid winter. Snow thick on the ground. I was taking a shortcut through a park. Lighting wasn't great. I was driving for the conditions.
    Saw the lights of a car behind me, in my rearview. He got closer and closer.
    I pulled over slightly to let him pass.
    He didn't.
    Instead, he planted himself on my ass. And then put on his main beams, blinding me until I lowered my rearview.
    He stayed like that for a bit.
    Finally, I had had enough. I reached over and flicked on my rear fog lights.
    Which would have looked to him like I had braked hard.
    So *he* braked hard, and spun off the road into the snow embankment.
    Where he got stuck.
    I might have laughed as I drove away.

      Brake checker is not the victim. He should go to jail for attempted murder. The tailgater should get fined for bringing both of them in a dangerous situation.
      But the brake checker purposefully initiated the crash.

      @@audieconrad8995 I had a tailgater once that got mad after I started slowing down (did not brake check) and after he passed me on double lines he slammed on his brakes several times in the next couple of miles and nearly wrecked us. I had two littles in car seats at the time and he obviously didn't care. I have no sympathy for anyone who pulls any stunts on the highway and acts like stupid children.

This only shows me that the guy in front was not intelligent enough to remove himself from the equation. He had full control over whether someone was tailgating him or not. He could have just pulled over to the right and let the tailgater go on and be an idiot somewhere else but he had to cause an accident that could have cost the lives of everyone in the tailgating vehicle.       @@blueeyedlady8973 ... Not when someone has a bone to pick with you. The tailgater in this video had motives other than impatience; no-one is that aggressive unless they're itching for a fight. Speaking of which, you are aware that driving is a privilege and not a right, yes? Because when you uphold that privilege, you're bearing responsibility of yourself and your fellow drivers, should something directly or indirectly happen because of you. What if this guy had to apply the brakes for something legitimate? If it wasn't a break check, the tailgater would've plowed right into the rear of the leading car; it would've done serious damage, killed the tailgating driver and their front seat passenger, and possibly injured everyone else.
      There's a point to be made with this crude method of road-law enforcement, and it's a point that was once voiced in a Reddit thread for this particular video: If all you can do is swerve after being break checked like that, you're way too close.

    I love this.
    My personal favorite way to deal with a tail gate who is pissed that I'm not speeding however fast he/she wants the road to go is to literally start slowing down in 5 MPH increments. Drives them nuts.
    Best reaction to this ever was the guy who got so focused on shooting pass me when I had slowed down 25 MPH and getting back to his preferred speed quickly (likely had the pedal floored), he completely missed the cop in the emergency crossover lane. Got pulled over in just a few miles.

      US highways/interstates are DESIGNED to be driven in the right lanes, left are for passing/overtaking PERIOD, which is also coincidentally the LAW in nearly every state.
      This isn’t about how you FEEL about others speeding, it’s about safety, PERIOD. Fast drivers shouldn’t be overtaking on the right because you’re upset they’re speeding-the safer of the two traffic violations.
      Get over yourselves.

      I usually turn my lights on and slide to the right or left from a couple car lengths back. I make the poor assumption that folks at least glance at their mirrors.       To be fair, both drivers in this video are idiots. 3 mistakes are made here, in order of severity:
      1: The front car should have gone to the right after passing the truck. Dont let an arrogant idea of "I drive the speedlimit, i don't need to move over for someone who is speeding" lead you. You are not the police.
      2: Tailgating for obvious reasons. Keep your stress levels in check and don't drive dangerous because of it.
      3: The breaktest is the worst by far. The driver is purposely causing an almost certain crash. This is inexcusable. If you really, really feel the need to let the tailgater know your feelings, use your windshield sprayer or ease of the gas and slow down gently. (although i don't recommend the latter either since it will likely cause more aggressive and dangerous behavior from the other car)

    I had somebody tailgate me like that when I was already about 20 mph over the speed limit on the freeway. He wouldn't go around me either. Suddenly there was a piece of lumber laying in my lane...I swerved, he hit it and rolled a few times, off into the desert. And no, I didn't do that on purpose, it was just a case of instant karma.

      I have high beam LEDs on the rear of my car that a previous owner installed. They’re linked to the reverse lights (they did it because they were parking against a wall), but it also has a toggle switch. Perfect deterrent for tailgaters. Sad to be selling it.

      @@astromec6303 What if you ARE already in the right lane, the left lane is clear, and they STILL tailgate you, because they are too lazy to change lanes and pass?
      What do you recommend in that situation? I ask since it happens to me nearly every single day (and keep in mind, I'm already speeding by 5 miles per hour, so I'm not going obnoxiously slow or anything).
      Side note: I almost never brake check in those situations, because I don't want to get killed. I just give a big, sarcastic wave that I know they can see, and keep scooting along.
      But, I'd be curious to hear your thoughts on that particular scenario.

      @@astromec6303 One more thing. You mentioned those people should move to the right as that's the law. Yet, there are ALSO laws in place that state cars are to remain a specified distance between themselves and the car ahead of them for safety.
      So, you can't complain about the front car breaking the law by not moving to the right, without ALSO complaining about the tailgater who is ALSO breaking the law.
      Both are breaking a law, not just one.

      Stephen Pain - since you are jumping in here, I think you must have meant to cite what state has a 10 year penalty for a brake check, which was the original statement. "Many states...?" Actually, all states have traffic laws about reckless, as well as increased penalties for bodily injury. But a 10 year sentence would be associated with serious felony charges, not a traffic offense like a brake check.

    April 4, 2019----When I was a kid, our neighbor Cho Cho Charlie installed wiring/switch for his brake lights for people like this. When a tailgater was on his ass, he simply hit the switch, brake lights came on but brakes were never engaged. Of course, this was back when everyone had a dial phone, phone book, etc.

    Seeing videos like this always remind me of one of my favorite moments as a driver. It was just pre-rush hour and the freeway was crowded but not yet slowed, with the fast lane traveling faster than the others. I was in the fast lane, with the shoulder on my left. I was giving myself reasonable space for the speed - about 6 car lengths for the 65m.p.i we were traveling. The guy behind me didn't like that "wasted" space, so he was on my ass. This went on for a mile or so when I noticed the car ahead of me swerve on to the shoulder to avoid a pallet on the road.......
    I waited until I was almost on it, then went on to the shoulder myself. The clown behind me didn't have time to swerve and ran over it. In my rearview, I could see him pull on to the shoulder and stop. Looked like his right front tire was flat.

      Yeah, only get that close to another vehicle if you also are using your turn signal to get into the next lane very shortly after (and even then, your nose shouldn't be inches from the other car's butt). I've had people tailgate me when I'm doing 15 over the speed limit on a interstate that turns off shortly into another interstate. 15 over, and we're all getting close to the exit, you need to hold your horses.
      Once I'm on the next interstate, the exit I need is on the right so I'm happy to go slow and remain in the right lane and they can zoom ahead in the left. But I'm not moving over for 60 seconds just to need to get back into the lane again when I'm already risking a ticket just to let someone impatient pass. Not just that, but traffic for that exit can be thick and I've seen idiots bully semis to nearly keep them from merging in for that off-ramp. Getting over to the right can often mean squeezing back in is going to be a pain in the ass.
      Normally, I'll get over and let them risk the ticket (and I've seen glorious justice when an officer catches them). But that particular area is just stupid to rush someone when it's not that long of a stretch before the interstate breaks off and we all need to be in the same lane anyways.

    Drives me nuts when people follow so closely. I'm a commercial driver and see at minimum 3 accidents a day, usually caused by people tailgating or attempting to cut someone off. The average following distance I see on the freeway is less than 0.5 seconds. Even in my personal vehicle I would never leave less than a 3 second following distance. I've never had an accident, but my following distance has saved me more times than I can say.
    Please be safe out there people, if everyone drove legally we would cut down traffic jams to almost nothing. 2 seconds isn't worth someone's safety or life.

      Well to be fair the driver was in the left as traffic was merging into the right lane from the exit, there was nothing wrong with them being where they were. Driver riding their ass was a moron. I know, because I tend to be aggressive like that, but not that damn close on a highway. You drive in front of me at the speed limit or faster, I'm good and won't fill your mirror.. You drive 1 mph under the limit and I will be passing you as soon as I safely can. lol Or if you are one of those that can't keep their speed consistent and constantly force others to adjust because you keep slowing down and speeding up. Use your damn cruise control if you have no sense of speed control. Or driving distracted.

      why do you call it a slow lane, both lanes can be driven at the speed limit. it is not a slow lane. along with tailgating, peoples knowledge of the highway code is very lacking. a lot of drivers think "what they perceive" as the slow lane, is not for them, but just for lorries. like tailgating, lane hoggers are the danger on the roads. the car in front, was not a lane hogger btw. he was approaching a slip road joining the motorway, and with a slower moving vehicle about to join, he stayed in the left lane. the tailgater should have been aware of this if he had given himself enough room. but because they have no regard for other road users, any action in front of them makes it impossible for them to react safely . pure idiot in my view.

      I called it a slow lane because that's just the way I describe it as it's common for slower vehicles to drive on the right side of the road. It's not a literal definition of the lane. Kind of like a figure of speech.

    That video was such a nice way to start my day. I did that to a guy years ago, when traffic was moving at a decent clip, but it was a solid line of cars in the left lane, and plenty of cars in the right lane, where I was. A guy in a pickup was lane-surfing and ended up behind me. He was right on me, but kept his eyes on the left lane, looking for his next swerve, as his girlfriend worked on her long, curly brunette hair, which she had all pushed up in a bunch above her head. When it became apparent he wasn't going to give an inch of distance between us, I did a brake tap, which the girlfriend saw first. His pickup jolted hard because he finally hit his brakes, but the best part was seeing his girlfriends' hair come down avalanche style in front of her face. He found his opening in the left lane in that exact moment, and then he drove past, window down, swearing, gesticulating, the whole thing, while I looked forward only. I figured I he was capable of anything, so I didn't want to aggravate him any further by egging him on.

      The lead car just passed the truck at a smart clip. He also no doubt saw the overpass and realized someone might be coming down the ramp. He was ok with being in the left lane. The tailgater should have backed off.
