    Now I want to start selling baked items at a farmers market in California. I think a class a license would be best for me at this point, that way I’m able to get customers AND money to fund my insurance, rented kitchen, and class b license in the future. When I go on this specific farmers markets website it asks for a couple licenses. What other licenses besides food handlers card do I absolutely need? Are you leaving anything out? What options do I have?

    Hi!!! I'm new here! For selling brigadeiros, a Brazilian chocolate fudge, would you recommend taking a Food Processor Course (FPC) or is a Food Handler's Permit (FHP) sufficient? Also, would you suggest a Class A permit? Thank you for your guidance.

    ive asked this questions on all kinds of sources including the States website, but no one seems to be able to answer, here it is, can sell pre cooked meats that you buy at the grocery store, things like precooked bacon and turkey sausage?, how about eggs? im wanting to sell things like a breakfast muffin, that includes, precooked bacon and a fried egg, and cheese? TIA

    • @CottageFoodsLaws
      @CottageFoodsLaws  Před 3 měsíci +1

      The rules around selling pre-cooked meats, eggs, and other food items in a food truck or similar food service establishment can indeed be complex and vary significantly by jurisdiction. In California, the Department of Public Health (CDPH) along with local county health departments set and enforce these regulations. The question you're asking touches on several areas: the safety of selling pre-cooked and potentially hazardous foods, the requirements of different food facility permits, and the specific regulations around eggs and meat products.
      Pre-Cooked Meats and Eggs
      Pre-cooked Meats: Generally, selling pre-cooked meats like bacon and turkey sausage is permissible if these items are handled, stored, and reheated according to food safety guidelines. This means maintaining the correct temperatures, avoiding cross-contamination, and adhering to best practices for food safety.
      Eggs: Selling dishes that include eggs, such as a breakfast muffin with a fried egg, is common in the food service industry. However, eggs are considered a potentially hazardous food because they can harbor salmonella and other pathogens. Therefore, strict guidelines exist for their storage, handling, and cooking.
      Class A and Class B Permits
      In California, the distinction between Class A and Class B permits typically refers to the Cottage Food Operations (CFO), which is different from food trucks or food service establishments that would serve breakfast muffins with precooked bacon and fried eggs.
      Class A permits allow for the sale of cottage foods directly to consumers without direct inspection of the food preparation area by the health department, while Class B permits allow for both direct and indirect sales (e.g., through stores) and require such inspection.
      Food Trucks and Similar Establishments: Selling prepared foods like breakfast muffins with eggs and meat would generally fall outside the CFO classifications and instead require a permit specific to food trucks or mobile food facilities. These permits have their own set of guidelines and inspections to ensure food safety.
      Important Considerations
      Local Health Department: You should consult your local health department to get the most accurate information for your specific location. Regulations can vary not just by state but also by county and city.
      Food Handler's Certification: It's likely that you and your staff will need to be certified in food handling, which covers safe preparation, handling, and storage of food items.
      Food Safety Practices: Regardless of the type of permit, maintaining high standards of food safety is crucial. This includes temperature control, avoiding cross-contamination, and proper sanitization practices.

      you would need to rent a commercial kitchen get a business license from your city or county depending on where you live, LLC, Food Business Insurance, and then distribute the food from the commercial kitchen at local events or deliver the food you cant legally bring them home and then sellf rom home.

      no and yes... California has a law that allows "restaurant" style foods to be sold from home with certain limitations BUT the city or county you live in has to approve the law locally otherwise no you would have to work from a ghost kitchen

      In 2019, the California Health and Safety Code was amended to establish a "Microenterprise Home Kitchen Operation", also known as a MEHKO, as a new type of retail food facility. Local governments must also approve the establishment of MEHKOs. If MEHKOs are authorized by the Los Angeles County Board of Supervisors, the Department of Public Health - Environmental Health Division would be able to issue a permit to an individual to operate a mini restaurant in their private home within the jurisdiction of the Environmental Health Division (this would exclude the cities of Pasadena, Long Beach and Vernon, which have their own health departments). State law requires that MEHKOs limit the number of meals that can be served (the cap is set at 90 meals per week and 30 meals per day), limit the revenue that can be earned yearly ($100,000), and it dictates how certain foods can be prepared. this may help I just released it: GET YOUR COPY OF MY NEW "CALIFORNIA COTTAGE FOOD BUSINESS BOOK" www.amazon.com/dp/B0CSRQ1QTX
