    If the employee is promoted between submitting the form 9089 and receiving the labor certification and the promotion is just one level up from current position with minimum change in job duties, does the employer need to start the process from scratch? Also if the employee chooses to defer the promotion, until what stage should it be deferred (i140 approval)?

    Hi, my Employer filed H1 Amendment for moving to new location (in regular process not premium) and its in processing with uscis since 2 months. Its not approved yet. I have 12 months left for H1B Visa maxout. Can my employer initiate perm process without waiting for H1 amendment to be approved. My employer not ready to upgrade my H1 amendment current case to premium processing.

    what to do if the dol doesn't give PWD for 12 months, is there a way you can track PWD? can the employer contact DOL about the PWD, I know you can track Perm but how to track pwd?

    Is there a case number or a way to track the perm/ labor application once filed after job recruitment process similar to how we can track the pwd on the flag website ?

      Unfortunately the DOL does not share specific details about where your case is in the queue other than their general processing times found at flag.dol.gov/processingtimes. Even in the perm portal where the application is submitted, the employer can only see major updates, which they will also receive directly via email. For example, when a perm application is submitted, the status simply says "Analyst Review."

    Hi,
    Can PERM still be filed for a foreign applicant if employer's recruitment process hired a couple of US workers along with that foreign employee because the position requires multiple employees?
    It's a position that requires about 10 engineers.

    I am not sure whether 2 months is enough for the recruitments as cool off period itself is around 30 days after the completion. Most of the employers were taking at least 4 months for that.

      Hello, thank you for your comment. At a minimum recruitment takes 60 days based on certain required recruitment time periods that must be followed, including the 30 day "quiet period." The recruitment period can definitely last longer than 60 days and often does because among other things, employers may still be conducting interviews/receiveing resumes even after the quiet period has concluded. Employers cannot file a perm application on a beneficiary's behalf until all recruitment is complete and they have determined through its recruitment efforts that there are no able, willing, minimally qualified, and available U.S. workers for the job opportunity.

    Hello sir, They filed PWD for my husband on Jan2022, we are still to get the result. We have visa till March2023. Will we get perm approved by then or if perm goes for an audit by chance when will we get notified about that. At how many months will we know if our perm is in audit.
