Elie Mystal, justice correspondent and columnist at The Nation, discusses the recent rulings by the Supreme Court and what is still to come.

Elie Mystal then joins, diving right into the diligent delays in SCOTUS’ refusal to take on Trump’s immunity case as a perfect example of the differing approaches to a justice’s reign between the conservatives and the liberals, with the former insistent on getting what they want, getting paid, and getting out of there, while the latter gets hung up in symbols and institutionalism. Mystal then looks to the recent Supreme Court decision to strike down the Trump-era ban on bump stocks, parsing through Justice Thomas’ decision to weigh the legality from the perspective of the gun, rather than the shooter, before briefly running through SCOTUS’ recent rejection of a challenge to Mifepristone, and what it can teach us about where this far-right Court is looking next. Wrapping up, Elie, Sam, and Emma unpack the future of the Supreme Court’s attacks on the Chevron Doctrine and the administrative state.

Elie's anger & outrage was a welcome consolation prize to the insanity. It feels like many mainstream commentators don't see or fully understand the horror of the current SCOTUS .
I honestly wouldn't be surprised if they plan on granting Trump full presidential immunity but they're just delaying it as long as possible so they can make the decision right before the election or at a time where it will be too late to challenge it.
When they do there will be no Supreme Court lol
2 side everything but also do it with civility....
They don't care. Everyone who could draw attention to it has a stock portfolio and the truth has never improved a portfolio.
They don't care! Being rich sort of pushes you above the fray and out of the chaos! 🤷🏾♀️🤷🏾♀️🤷🏾♀️
I wish more people in power would listen to Elie Mystal. 😞
Absolutely!
Elie is consistently one of my favorite guests everywhere. But especially on the Majority Report.
I like him so much!
He always brings the goods with receipts. Always.
Elie is one of the greatest mind in america right now.
Agree.
Listen to Elie. Always listen to Elie.
Biden should have stacked the court when he had the chance. Playing fair with people who don't play fair is a self-inflicted wound!
Was he legally, and, constitutionally able to do such a thing? Correct me if I'm wrong. I was under the impression POTUS judges have a lifetime appointment, and, the only time a President can pick a POTUS judge(es) is when one retires, retires, or dies.?
President Biden, especially now that the President has NEWLY GRANTED powers, should Expand SCOTUS - while he still CAN!!
Time is a-wastin'.
Exactly. Day one in office was when Biden should have acted instead of looking for McConnell for partisan decisions.
FDR was going to try to stack the court and actually got one justice removed I believe. Google it
@@carlostherocker6822Congress and President have some powers to rein court in Google FDR AND WHAT HE DID Having Congress on your side is probably necessary
This guy knows his stuff. I like him.
Glad to hear his criticism of Ruth Bader Ginsberg.
I’m convinced they aren’t writing most of it and that they have people at the heritage foundation and other organizations writing these opinions.
Absolutely - that's been proven for SCOTUS as well as for bills brought up for vote in both the House and Senate. These scum have been shaping our laws for decades.
Especially Thomas's opinions. His opinions are cartoonish.
Love to see and hear Elie Mystal anywhere speaking truth to power!
Thank you Ellie Mystal 👏👏👏
Such a great conversation. Elie's the GOAT!
Didn't watch, how many times did he blame ypipo?
He's smart as hell. He definitely knows what he's talking about. He needs his own podcast.
Love Elie
Most masculine leftist
I have a big problem with Elie Mystal! He has not written enough books! And... Where is his weekly podcast?!!! He needs to be in more places!
I hadn't realized the R's had the court since 1970. This absolutely explains why progress has been stymied again and again. Now that R's are no longer conservative, the SC mirrors the party- which is GUANO cuckoo and ethically deficient. The shit has hit the fan and we (normal people) are caught with our mouths open.
We'd better resume wearing MASKS, for that reason alone!
The idea about Thomas and Alito both tipping the scales for another Trump Presidency that would allow them to retire sooner than later has eerie overtones of what happened in 2000 with the Supreme Court giving the presidency to Bush. Justice O'Conner was ready to retire to help care for her husband who had Alzheimer's, plus found the whole recount effort "messy". But her main motivation was her own personal desire to be able to retire knowing a Republican majority and president was in place. So here we are, 24 years later, and the hole is being dug ever deeper. Yikes!
Idk why people don’t understand that this is why you must vote Biden.
The Supreme Court is not going to be expanded. Then that will just keep happening over and over.
We can try to expand court with Congress and president in lockstep cooperation
Alito seems to think we are under 1600 English law because he based his roe versus Wade reversal on an English judge from the 1600s . That alone should have disqualified him
Elite-0 seems to be minus quite a lot of marbles
Elie is a national treasure. Love seeing him more and more these days (although it usually means the Supreme Court is causing trouble)
This country is so depressing
This is embarrassing. Does this mean we democrats are not as strategic nor smart? Dang!
Lack of strategery. You also cannot underestimate the passion of a cult.
The Democrats adhere to norms that the Republicans have long shed. In other words the Dems do thing that no longer make sense because the Reps forever take advantage of acting in bad faith.
I really like Elie whenever I see him somewhere speaking. Well spoken, good reasoning and with the right smack of sarcasm on top.
Elite you’re awesome as you usually are. Thank you for sharing your thoughts and your all you do.
I love how this dude explains things, it's very informative and funny.
Elie got me into constitutional law. Top 10 guy of all time
Remember when congress passed a toktok ban in 15 minutes after AIPAC told them too? Meanwhile on every other issue...
I remembered when the US government stopped monies to UNRWA because of an unfounded report that a dozens of UNRWA workers were involved in massacre eight months ago. For a country that has surveillance on certain peoples by video, cell phone, etc., never provided any evidence to support the claim....
Listening to american 'politics' is really depressing, omg.
Roberts: "Do you have your written descent?"
ALito: "My wife ate my homework"
Alito: I did not have time to write my decision on whether Trump has immunity because my wife and I were out shopping for swastika flags. (joke)
BALANCE THE SUPREME COURT:
13 circuits = 13 SC Justices

UPHOLD THE BEDROCK PRINCIPLE:

I mean, you may have meant it as a joke... but are you sure this isn't what actually happened? LMAO

Elie is indeed speaking through truth.

The phrase recalls an old "Honeymooners" classic episode.
How tragic that RBG didn’t give up her spot. The dems never fail to disappoint me.
History will laud her for the good she did, but she also has a HUGE asterisk named Amy Coney Barrett to consider.
I'm an Australian but went to college in America which is in part why I watch this stuff.
There's an interesting parallel with Australia.
Our Left (the Australian Labor Party) also never fails to disappoint.
I'm an engineer so I put this in engineering terms (sort of).
The Left have good ideas but are hopeless project managers and their projects fail.
The Right have bad ideas but are good project mangers and convert their ideas into reality.
We get a lot of British and European news in Australia and I see the same thing happening all over Britain and Europe. I can give examples of it from Australia if you want. Irrespective this seems to be a trait of both sides. One side has good ideas but can't implement any of them while the other has bad ideas and implements them with ruthless efficiency.
@@dolemites_chain Its a money thing for some and a power trip for others, but by far the worst are the ego trippers because they can't be bought to do what's wrong and they can't be persuaded to do what's right.

Love Ellie he should be on supreme court main judge or Attorney General
Eli has elected not to have a law license. He's not restricted therefore in giving his opinion or excoriating anyone about anything. He can't be threatened to keep him quiet. He and David Cay Johnston.
He's too ethical for what would be his "colleagues".
Emma, the appropriate response to what's up is usually just what's up 😆
😂 it turned out to be a great segue 💙
Elie is excellent!
04:47 The liberal side needs to develop a well-mentored group of young justices, legislators, and executives. Relinquish the hunger for singularly talented rock stars.
Yes. This. More mentorship & less gerontocracy.
It's crazy how we don't invest in our own bench, basically because they think it's job security. I remember when AOC beat Crowley and it seemed like he was the only person Pelosi was mentoring to take over as House Speaker. 😂😂😂
Yupp lol@@debbiedoodiedandi
David Souter is probably the only exception to a conservative politically motivated retirement.

Why are they still being called "conservative" justices ?
They are radicals. They are not conservatives.
They're neither conservative, *nor just*!

Good video Elie Mystal! I subscribed so I will not miss any. Thanks!
If Trump wins I would bet good money that we will see Aileen Cannon nominated to the supreme Court
Clarence Thomas is a monster.

So I’m with Elie on constitutional violations.
Dudes ... Stop acting surprised by what the court does. When people tell you who rhey are, believe them!

Ok Alito and tomas want to retire. They kno drumpf is the worst rep candidate at this time, but they have no choice. But, they absolutely do, they just want the world to burn. I have no deal with the devil, leave the rest of US alone.

What is wrong with the criminal Supreme Court?
As someone from the UK that whole conversation about the supreme court and bump stocks has REALLY opened up my eyes to a big reason why there hardly ever seems to be any meaningful movement towards sensible gun ownership. I really am fascinated intellectually but utterly disgusted morally by finding this out.
I have no issue with sensible and reasonable gun ownership-im a Scot that grew up in the countryside so there were pheasant shooting, farmers with guns for pest control, we have sports shooting clubs so I don't believe in "banning all guns". I just believe there's a sensible way to go about them- unfortunately guns are fetishised by a particular portion of America yet if Australia can change (who from what I've read and people have said online to me had much the same attitude with some of their population) the US can. But as I said after hearing about the supreme court and bump stocks and guns in general, I'm not as optimistic as I was
Elie's such a good guest.
Not familiar with Mr. Mystal, but what a great interview. I learned a lot
Someone noted that if USA had a popular vote for President the only Right-wing appointed justice would be Thomas. I'm not sure if that's right but it would be 2 or 3 tops. McConnell also fixed-up this mess for MAGA yet he got booed at RNC.
Elie is right... Dems gotta be smarter, meaner.
Elie is the best, but I can't help but looking at him and thinking he is Keenan Thompson with white hair
think about it. Gorsuch is a judge that is in possession of stolen property/ postion and profiting from that stolen property .
Sam, you can call me an ammosexual, and I don't get the bump stock thing. Totally a stupid decision for a stupid gun mod.
Bump stocks are garbo.
Is it really one press of the trigger fires multiple bullets? I don't understand how that is not automatic fire.
It's not even arguable to be semi-automatic.
What does it matter how the gun mechanism works? Is it firing 250 rounds a minute? Then it's automatic.
@@komninosm you misunderstood, it is one pull per bullet, but with a bump stock the whole trigger mechanism jiggles with the recoil so you can keep automatically pulling the trigger without moving your hand. It's really dumb and actually makes the gun less reliable to create this automatic effect.
@@jsquire1331 i see. So the whole gun moves while your trigger finger holds still.
That's stupid. All this contraption to evade a ban on full auto. It's like arguing in bad faith.
Elie, I recall in 1986 that the Court released its (foul) decision in Bowers v. Hardwick on July 6th.
Apparently there was something not banned that did the same thing. So maybe, while galling, no actual harm was done this time.
We just need an ammendment to the constitution setting:
Court = 9 justices
Term limit (tied to seat, not justice in seat) to 27 years. (Results in each term of a presidency getting usually 1 judge plus appountments resulting from death/resignation)
Chief justice is the judge who has been on the court longest.
If a judges dies/retires at 21 years into tern, a new judge is appointed to complete the remaining 6 years of term only.
Nobody can be appointed to the court more than once.
Thank you, love Elie!!
Alito and Thomas use their egos to snub their nose at ethics and corruption. Obviously the elephants have had more favorable outcomes than the donkeys, and that is very unfortunate.
“.. exactly like me if not worse” had me ROFL
It is very easy to be "efficient" when yo do not have to follow any rules. Nobody ever thought we/it would come to this. There needs to be a constitutional amendment to account for what is happening here. A limit on years of service and an ethics committee of overseers.
1:51 I love Mr. Mystal's intelligence. He reminds me of hank McCoy, one of my favoriute X-Men. I wonder what comic book character Sam would be tho, given they both wear glasses, LOL 😆!
Thanks , now I can’t unsee it

@@knkosi1 sounds good. I liked you in Mall Cop by the way
It doesn't actually make any difference whether the President is Republican or Democrat. The genius of the American ruling class is that it has been able to make the people think that they have had something to do with the electing of presidents for 200 years when they've had absolutely nothing to say about the candidates or the policies or the way the country is run.-.Gore Vidal
"This is why we lose." I agree. Where would we be if RBG thought about others rather than her ego or if people would of just held their nose and voted for Hillary.
Or if the Democrats actually decided to do something about SCOTUS
The dems have acted for the last 25+ years as if there hasn't been a concerted effort by Repubelicans and their owners to seize power and rig the political system so that they never have to give it up.
At this point the conclusion that Dems are in on the scheme is difficult to avoid
@Summalogicae right technically they had the votes to expand the court from 2020 to 2022. Now we're prob gonna lose the senate and even if biden wins, he won't get a scotus pick until Democrats get it back
Or the filibuster, which is dead the second the GOP takes the Senate again.
"Is not this simpler? Is this not your natural state? It’s the unspoken truth of humanity that you crave subjugation. The bright lure of freedom diminishes your life’s joy in a mad scramble for power. For identity. You were made to be ruled. In the end, you will always kneel."
- SCOTUS
Consider the gun's perspective! Humans are so self-centered,
they fail to consider that guns have a purpose for their lives. What right to actualization do they lack that we take for granted.
This at 5:00 is one of the things that pisses me off most. RBG thinking doing planks will make her immortal (plus Hillary not adequately campaigning in swing states) is going to result in, at the very least, 80 years of social rights and at worst, the death knell of our democracy.
I LOVE ME SOME ELLIE MYSTAL 💖
Does everyone have goldfish memories? Hating on RBG for not stepping down is so idiotic.
McConnell already refused to fill the open seat for her last year - she couldn't step down or there would have been one less liberal justice and only 7 justices total for all of 2016.
She had the chance prior to the midterms
I'm growing my fro out starting today.
@Sam & company. The linguistic debates are an obfuscation. Instead of arguing over the semantics of what a “machine gun” is, we should articulate the issue. The manufacture and sale of high rate of fire, high capacity weapons should be made illegal. Also, the sale of devices that can be used to modify a weapon to make it high rate of fire high capacity, including bump stocks and large ammunition clips should be made illegal. Prohibit the sale and manufacture of these capabilities. Do these things to achieve two ends, first, stop the proliferation of these weapons, secondly go after the manufacturers instead of the gun owners, then use buy backs to get as many weapons out of people’s hands as possible.
BS court corruption
The bump stock use can be duplicated with a rubber band you don’t need the bump stock
Atencion!! Litle ladys in conservative circles have a diferent meaning!!
Supreme Karens!
Praying for meteor, haha?
8:37 disagree. Respectfully. Identity as only vote motivator was a huge mistake of Sec Clinton, IMO.
With a Trump presidency we just might get Supreme Court expansion.
I hate to tell Sam but fully functioning Bazookas, tanks, anti-tank guns, and flak guns are legal in United States. However, you do need a federal license for them (Class 3 Firearms). With tanks, they must not be imported, and ammunition must be registered with the Feds. Same for large caliber ordnance.
That explains why few people have em that’s a form of gun control
@@qjtvaddict Yes, they are regulated but it's still a myth that in the US heavy weapons - like tanks and large caliber ordnance - cannot be owned by the public.
Too bad with chevron the democrats won’t pass a law stating you can’t dispose of anything but pure water into waterways and same with air just as a fuck you to the Supreme Court.
Welcome to "democracy," where a minority have all of the say and the majority are told that they have to support the preferred candidates of the minority because there are no other "reasonable" options.
People need to stop deluding themselves. "Democracy" is an umbrella term only because people have been trained to think that a ruling aristocracy "but with elections" is democratic for anyone but the ruling aristocracy. If the people themselves are not part of the decision-making process itself then the term "democracy" is entirely meaningless for them...but it means a lot for the people at the top.
Republics are trash systems barely better than feudalism, no matter what excuses people use to defend it from a more democratic system. All they've got is baseless claims and thought experiments that demonstrate terminal ignorance.
Maybe it's a Supreme Court Justice and you're taking payoffs in very large quantities you should probably pay the taxes Anna collude with your benefactor to withhold your taxes from the IRS especially doing this over a long period of time because the penalties and the finest add up and multiply on 4 million over decades this could be 60 million
Their argument that you have to be a skilled person to make the bump stock work counters their that its from the weapons perspective argument.
Japanese > mandarin, the only place where those languages are predominantly spoken are their countries, I have no interest in going to china
Sam, why do you have a sidekick on the show? Emma is looking very uncomfortable. She always has to struggle to get even a word in the conversation.
What is "Christian Nationalism"?
It would be awesome for our country and the judiciary if Alito and Thomas came to their natural ends during Biden's term.
