The Stingray: How Law Enforcement Can Track Your Every Move

  • RALEIGH, North Carolina (WTVD) -- You could be just about anywhere and data on your cell phone can be scooped up by law enforcement without your ever knowing. It happens all the time.
    The device that makes it possible is called a "cell site simulator." That's the generic name; Stingray is the most common brand name.
    Initially developed for military use, Stingrays have made their way into local police and sheriff's departments around the country. Months ago, the I-Team sent open records requests to every law enforcement agency in our viewing area and learned that three agencies close to home have been using cell site simulators: the Wake County Sheriff's Department, Durham Police Department, and Raleigh Police Department. A spokesperson for RPD told the I-Team they stopped using theirs when the software needed to be upgraded.
    The ACLU's Mike Meno has been watching Stingrays spread into local law enforcement for years.
    "Like a lot of militarized technology and surveillance technology, this is something that was developed overseas and it was developed for one use, but then it comes back home and is used against our own citizens. It's used here in the States. And the government will say, 'We need to keep this confidential,' but we have constitutional rights. We're supposed to have checks and balances," he said.

    I am a victim of sexual assault committed by a retired state trooper. I reported it and was approached on the street several times by other retired officers wanting to know what I intended to do in the case. I was baffled how they knew where I was. I suspected my new iPhone. I now know. They also knew my conversations as they were repeated back to me. I live in fear due to this abuse of power I am a victim of a life changing crime and these Criminal officers are getting away with stalking and intimidation. Why hasn't this been a news worthy issue. Police abusing there authority to protect a criminal.

    It’s gone further than law enforcement, here in Oklahoma. When Covid set in here, and things were shutting down, etc, if you were tested positive for Covid, the next day you got a call from the health department asking you questions about your symptoms, where you’ve been, and around who else. I had no symptoms, felt great. Two days later I went to a different location and tested negative. The next day I went next town over, and tested negative. I assumed I had a false positive the first time, since I tested negative twice in the same week.
    Next day I was at Walmart and my phone rang, it was the health department asking me why I was not at home quarantined. They knew where I was at, tracked my cell phone. Told me first time is a warning, second time I’ll be fined up to $1500, and jail time. Misdemeanor charge.
    I found out they were trying out this device in 4 counties here, and mine was one of the four. I was shocked, but I understand that they are trying to prevent the spread of Covid. Several people were fined for this reason, and I’m sure this is the same device talked about here.

    Researched this device over 10 years because of my own experience with someone misusing it. Everyone told me I was crazy and it was impossible. Now it’s finally coming to the light. Here we are in 2023 I can only imagine the upgrades that have been made. agencies have to sign NDAs to even purchase the device, that alone says a lot!     "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized." - Fourth Amendment to the US Constitution
    They intercept and track ALL cellular telephone calls within range. That is clearly a violation of the 4th Amendment. That seems like police are on random fishing expeditions not limited surveillance conducted according to a search warrant. A search warrant must restrict them to tracking and bugging a specific telephone number not scanning every cellular number within range.

      Absolutely is. I just retired after 20 years in the Army and hearing domestic US police talk like this violates everything that freedom stands for. Police are not the military and have no business conducting any type of operation like this whatsoever for any reason. It is indescriminate and violates civic liberties of anyone within range. It is extremely prone to being used wildly inappropriately and due to human nature absolutely will.

    The biggest problem is it should be the other way around. We need the decent people surveilling all government employees. The job of police is to solve crimes, not look for them and there isn’t a crime unless there is a victim. The patients are running the psych ward and they’re evil people with very bad intentions.

    My Predator next door neighbor started stalking my kids to school & every where they went, from the moment we moved into our house 17+ yrs ago.
    There's been additional harassment & illegally listening into my house conversations, recording my house phone, frequently trespassing, gaslighting, harassing & vandalizing our property. It became obvious to me that didn't matter who moved in, these activities & wicked behavior were already ingrained habits. This nonsense was premeditated long before I bought this house & it doesn't matter where I go or if I move. I just have to continue living with this targeting harassment.

    To anyone who isn’t aware your smartphone is listening to every single word you said regardless if making a call or not, especially if you have any sort of google backed app on your phone such as CZcams, google maps etc… a friend once mentioned to me that his neighbors recent got an above ground pool. We talked about it for 2 minutes that day and I never looked anything above ground pool related before or after that convo. For a week straight I was getting ads on CZcams for above ground pools. Another time I was hanging out with my neighbors who are both English and Spanish fluent but only speak to their family in Spanish. For about a week straight all of the commercials CZcams would run were in Spanish, even the commercials I had seen that were the exact same only in English. Never looked up anything Spanish language related. I’m not saying it’s logging and storing word for word convos but it definitely is listening for key words and analyzing my convos. Be careful what you say out loud. Someone/something is definitely listening

    The only way a “StingRay” can force a cell phone to connect to it instead of the cell tower is to have a stronger signal. I wonder if the StingRay is in compliance with FCC guidelines. But, like any criminal organization, laws need not apply.

      That's not how it works. Cell phones can connect to multiple towers all at once. Up to six even with the older technology (3G) and they do by default anyway.

      There is something called a capture effect. A cell site is not very powerful by design, it can't be since it has to balance a fine line between the transmit power of the signal and the receive signal. A cell phone has comparatively very low power. Some of them are extreme low to facilitate longer battery life. So if the cell tower had too much output power, the phone would be able to hear it but the site would not be able to hear the phone. Since a cell phone by design locks on to the strongest signal it sees any device that is closer to and gets captured by it even if it a weak unlicensed part 15 low power device it will be able to capture your phone. Stingray will not work if you are very close to an existing cell tower and the sting ray device is away from it. Criminals have gotten wise to that and many stand right in the main beam close to the tower so that other devices can not capture their phones.

The secracy is there for a reason they dont want you to know that they have the tech and can use it without the courts even knowing. Where are these devices located? at the police department or do they have them in a locker somewhere at the courts house? When the cops take them out their cases and turn them on who's watching and doing the oversight that they are using them accordingly to the letter of the law. Who's policing the police?? do you realy think they get a warrant every time? Warrants are only needed if you want what you find out to be used as evidence in court. But you can always find that evidence in other ways if you know what you are looking for ahead of time. This machine is more likely used in that manner.. this is a intelligence gathering tool not a evidence gathering tool.. The outcome is always the same. You give the power and it's not a matter if it will be misused but a matter of when it will be misused.     Wonder how he'd feel about all of his 'private' information, emails, text messages and phone calls were intercepted by his neighbor, you know, just to be sure he isn't doing anything immoral or unlawful. The "I don't care what people say' says everything that needs to be said and the line about a general making his plans available is equally troublesome. He's not going to war with the taxpayers of his county.
    The irony is his daughter was arrested on felony drug trafficking charges so maybe he should've been paying closer attention to his kin folk instead of targeting the public. She plead guilty and got off with what amounts to a sweetheart deal, in case anybody is wondering.

      Tracking location by volentarily carring your cell phone is not that 'unreasonable'. You drive your car various places, it can track your movements pretty well, this is just bigger and better so to speak. If you don't want your where abouts and travels known be very careful with your cell phone - full stop.

    They do exist. I was resting at a rest stop but had to leave because of shady people. As I started up my car to leave I've noticed 2 deputies circling around other vehicles but stopped when I was leaving. I started leaving and those 2 deputies proceed back to their squad cars and began to tail me. They had nothing so they u-turned away from me. I found an active parking lot to rest some more only to be harassed by the two same deputies that were at the rest stop. What was suspicious about the whole situation was that there was no way these deputies could have known I was there unless they have followed me from A-to-B. LAW ENFORCEMENT have became a weapon against the people they swore to protect. This is why I dislike LAW ENFORCEMENT and must be abolished and re-institute new guards under a act I would like to call, "HONOR YOUR OATH ACT". Where it lays the work of consequence using one's position of authority under oath to go against anyone who has not commited a crime.

    This is a mindset that needs to be scrubbed from all police departments, this is America, you are state law enforcement officers, you are not at war, we are not your enemy, we are citizens of the U.S., this is not a war or conflict zone.
    I completely understand some people say things like "the war on drugs", but the militarization of our police has now given them the idea that they are fighting a war and the population is the enemy, this is ridiculous that we allow this to go on. They won't talk about these devices because they know exactly what they do and they don't want to be sued.
    I believe all police departments should start having new training programs, there needs to be more de-escalation training, they shouldn't be showing up to alot of situations with full tactical gear and APC's with a 20mm cannon. We need to pass laws to stop these private military companies from selling war equipment to our local police departments, why does any police department need those Big Bear Armoured Vehicles??
    Departments are starting to have better gear than some of our troops overseas. If we don't stop this now, pretty soon they will be flying mini drones around EVERYWHERE and you will not be able to go anywhere, without being followed with a livestream to police HQ.
    But the first thing we fix, needs to be the mindset, YOU are NOT at war and WE are NOT the enemy!!

    One should be able to develop software that is able to detect the repeater inserted between the tower and the local phone. A GPS and a map should know where those towers are. Based on your exact location, the phone should be able to tell how far away the tower is. If there is a discrepancy, the phone should be able to detect it.

Threat person contact me and threatened to violently take it back. I contacted the police and asked for an officer to intervene. They never showed up. I called and asked what had happened. The dispatcher stated that the officer could not find my address and therefore proceeded to go on to another issue. Luckily, I handled the situation nonviolently. I could have been killed and the cops didn't give a shit.
