    One other caveat, My wife and I were married in another country and living in that country. We applied for the residence green card and received approval around 1 1/2 years later. We were allowed 6 months to move to the USA. I found the law that said if we presented to Immigration for residency 1 day after being married for 2 years my wife would receive a 10yr/permanent green card. We arrived and presented to Immigration for permission to enter 1 week after 2 years of marriage. She did receive the 10yr/permanent green card. There was a hiccup at the beginning because the Immigration officer at the airport was unaware of the 2 yr rule and she was issued at first a Temporary green card, to which I immediately contacted Immigration and was told the document to submit when a mistake was made. I don't remember the number or name of the document. It took a couple of months before getting a face to face with an Immigration officer who was not aware of the 2 yr rule until I showed it to her and she then changed the green card to a 10 yr/Permanent Residence card. That was 4 years ago now. After 2 years and 6 months in the USA I applied for her Citizenship and she became a Citizen 8 months later October of 2021 in Phoenix.

    I hear what you are saying in regards to waiting until the I-751 is approved before applying for citizenship but I'm glad my husband applied for citizenship while waiting for the 1-751 approval because who knows how much longer the waiting for the citizenship interview would have been. What ended up happening was the he got a notice for the citizenship interview while 1-751 still pending and we did a combo 1-751/N-400 interview the same day. Thankfully everything went well with interviews and the exam and my husband now a US citizen.

    that is not fair at all that they can just take as much time as they want and mess people up and what for is the 3 year marriage rule for citizenship if they take 3 years in some cases for issuing the GC so eventually it becomes 6 years.

    You're right for those adjusting their status while present in US. For those who are interviewed overseas at an embassy and received CR1 visa, when they enter US at POE and CBP officer admits them in to US, that day You're resident since. So if your marriage is over 2 years when you enter USA on CR1 you will get IR1 status and 10 year Green Card. If you still receive 2 year Green Card it is mistake on part of USCIS. You can file i-90 to replace the Green Card. You have to send evidence to them when you were married and when did you enter USA.

      This is how we enterd the USA after 2 years marriage and they made the mistake giving here a CR1 that we corrected through the I-90. We did have to show the Immigration officer their own rules for issuing the IR1. There's lots of Immigration rules and they don't know them all.

      Just to verify, if my husband has his interview at the embassy in his home country and we have only been married for 18 months during the interview, as long as he enters the country after two years of being married, he will get the 10 year residency correct? I am on several facebook groups and they all say you have to be married for two years at the time of the interview.

      @@jmorpez3507 you have to be married over two years once he enters United States to get IR1 entry on their passport.

    My 4th of July weekend starts well: two status updates. "Case was Approved." (from Nebraska Service Center) and shortly after "Card is being produced.". And I thought my case would rot in hell.
    I think I can go with a good mood into the weekend.
    PD April 2020. I-485 receipt October 2020.

    What if you get a conditional green card but you’ve been married more than two years I say that because a friend of mine his wife got a two-year conditional green card but they were married for two years and one month does that count?

    In the meantime. How long does it take the person who has applied for marriage green card to work? Does one have to get a green card in order to work? Or does the work authorizarion come before the green card?

      work authorization comes first usually

      I applied August 25th, I received my work permit September 28th. I did Biometrics on September 23rd by the way.

    Thankyou , been married going on 4 years this year . for some personal reason , pandemic and my mom get sick , finally we process my application this month and been waiting for my receipt . Im wondering about I’m getting a 10 yr Green Card ..

    Tell me about it. Over 2 years and she finally got the “interview” at the embassy and they denied her because they did not accept my divorce documents as the originals. Since we are still living in Colombia, it means I have to make a special trip all the way to Albuquerque since the court will not give just anyone those documents. And because they took so long, she came to visit me often on a tourist visa and that is a problem because they suspect she was working or some garbage like that. So they flagged her application and I guess they need some other documents now as well. No, we just tried to be together! Dam idiots. So do you help people out here?

    My 24 months expired.

    I want to 100% understand and I still feel like I don't know the clear cut answer. I am USC and my husband is UK Citizen. Our 2 year anniversary is 5 months away. We are now at the NVC stage. If my husband has his interview and approved in 3 months but we decide to wait for him to move here after our anniversary does he get the 10 year green card? Thank you

    If I’m an SL6 applicant, whose green card was approved, will I receive a 10-year green card or a 2-year green card? I recieved the approval notice; however, I’m doubtful if they made a mistake by saying that I’ll receive a 10-year green card. Please let me know, I’ll appreciate it very much 😊
