सौरभ जी आपको सलूट है, आपने जनता को अवगत कराया कि सुप्रीम कोर्ट कैसे चलता है ।इससे अनुमान लगाया जाता है ,कि सुप्रीम कोर्ट भी सरकार के अधीन काम करता है ,निष्पक्ष नहीं है। संविधान की रक्षा करना भी संभव नहीं है। न्यायपालिका को एकदम निष्पक्ष होना चाहिए और निडर भी होना चाहिए, तभी हमारे देश का संविधान बचेगा, अन्यथा यह काल इतिहास में काले अक्षरों में लिखा जाएगा।

दस वर्षों में न्यायिक संस्थाओं को भी सत्ता के अधीन नतमस्तक ही देखा गया। सत्ता द्वारा उक्त संस्थान की अवहेलना, मखौल उड़ाते ही देखा गया। हां कभी-कभी विश्वसनीयता बने रहने के लिए भी कुछ कार्य हुए। ऐसा लगता है कि इस बात को ध्यान में रखते हुए सुचारू से धीरे-धीरे समझाने के लिए कराया जा रहा है। चुंकि यह शिक्षा संघ से मिलती है।

But unfortunately at the present time the judiciary system of our country totally inclined towards the powerful ruling government. This executive judiciary will Make our country autocratic.
मुझे भी तभी से शक हो रहा है जब से सुप्रीम कोर्ट ने Electoral Bond पर फैसला सुनाया है, इस फैसले का हम क्या करें क्योंकि जिस कंपनी का turn over 5 crore है और चन्दा 500 करोड़ और इसकी जाँच के ऑर्डर भी नही दिया गया है इसलिए इस फैसले का कोई मतलब ही नही जब भृष्टाचारियों पर कोई कारवाई ही नही हुआ |
आज इस conversation ने मेरे विचारों को बल दे दिया है😮😊

मैं हमेशा से कहता आया हूँ, भले ही हमारे संविधान ने judiciary को बहुत सारी power दी है, पर at the end of the day आप उस power का कैसे इस्तेमाल करोगे, ये उसपर डिपेंड करता है जो उस कुर्सी पर बैठा है। अगर कुर्सी पर बैठा इंसान दबाव में आके judgement देता है, डरता है, या फिर ईमानदार नहीं है, तो उसे पद का लोभ और निजी स्वार्थ है, तो judiciary कभी भी ठीक ढंग से काम नहीं कर पाएगी। इस से बचने का तरीका है transparency maintain करना, और transparency मतलब objectivity के साथ हर judgment क्यों लिया गया, वो public के सामने रखना। हमारे judiciary objectivity पे कम काम करता है, और judges का perception, bias और ideology पे ज्यादा काम करता है। इसीलिए similar cases में, जिधर similar evidence है, context वही पर इंसान दूसरा है, एक court से दूसरा court में अलग-अलग फैसला आता है, इस से पता चलता है कि objectivity की कमी है, और केवल perception based judgment है जहाँ पे uniformity नहीं है। एक judge को जो सही लगता है, दुसरे को वो गलत लगता है, और इसके लिए कोई जवाबदेही भी नहीं है। हमारे राजनीतिक, शिक्षा, स्वास्थ्य, मीडिया के साथ साथ judiciary में भी अमूल परिवर्तन की ज़रूरत है, जिस से हमारे देश में एक मज़बूत न्याय व्यवस्था स्थापित की जा सके, जो सिर्फ़ कमज़ोर पर ही नहीं समय आने पर ताक़तवर राजनेता और powerful लोगो को भी सज़ा दे सके। हमारे ये पुराना न्याय व्यवस्था जनता के हित में कम और सत्ता पे बैठे लोगो के हित में ज़्यादा काम करती दिख रही है, individual rights सिर्फ़ किताबी बातें बनकर रह गयी है, जनता के भले लिए काम कोई नहीं करता, सब अपने स्वार्थ के लिए काम करते हैं, कमज़ोर पर ताक़त आज़माया जाता है, और ताक़तवर के सामने घुटने टेक देते हैं I हमें strong judiciary चाहिए, तभी जाकर इस देश में न्याय मिलेगा, और लोगो को अपना हक़ मिलेगा। धन्यवाद I

We r sorry to point out that many judges don’t even know how to decide and as a result many judgements remain reserved for months and years.Beside this many judges hear and hear but they don’t deliver judgement .As a result clients suffers the most .We don’t see any work has been under taken to seriously do something for improving the judicial system.Appreciate the discussion
