இசைஞானி நம் தமிழ் மண்ணின் மிகப் பெரும் பொக்கிஷம். அவர் பாதுகாக்கப் பட வேண்டியவர். போற்றப் பட வேண்டிய ஒரு உயர்ந்த இசைத் திலகம். இன்று இசை என்றால் என்ன? இசைஞானி என்பவர் யார்? அவர் செய்த சாதனைகள் என்ன? அவர் இசையை முழுவதும் உணர்ந்தவர்கள் அனைவரும் என் கருத்தை உணர முடியும். இன்று social media இருக்கிறது என்று தன் நிலைக்கு இஷ்டத்திற்கு கருத்துக்களை பதிவு செய்யும் முன் சற்று யோசித்து எழுதவும். பிடிக்க வில்லை என்றால் எதுவும் பேசாமல் இருப்பது நல்லது.இன்னும் சொல்லப் போனால் அவரை அவர் அவர் விருப்பத்திற்கு இன்றைய சமூக வலை தளங்களில் பேசுவது தவறு என்று அரசு ஒரு ஆணை பிறப்பித்து இருக்க வேண்டும் என்று நான் நினைக்கிறேன். மிகவும் வேதனை அளிக்கிறது. இந்த 82 வயதிலும் ஒருவர் இசையில் இவ்வளவு பெரிய அதிசயங்கள் செய்து கொண்டு இருப்பதை பார்க்கும் போது நாம் இதை எல்லாம் பார்க்கவும் கொடுத்து வைத்து இருக்கும் தலைமுறை என்று பெருமை பட்டுக்கொள்ள வேண்டிய நிலையில் மட்டுமே இருக்கிறோம். இன்று ஒரு படத்திற்கு பெயர் சொல்லும் அளவிற்கு பெயர் பெற்ற இசை அமைப்பாளர்கள் தம்பட்டம் அடித்துக் கொண்டு இருக்கும் சிலரின் மத்தியில் கிட்ட திட்ட 1500 படங்கள் 7000 பாடல்கள் பல பல தனி ஆல்பங்கள், சிம்பொனி இசை என எண்ணற்ற இசைக் கோர்வை அமைத்த இசை சாதனையாளர்.
இந்த வயதிலும் பாடுகிறார்
பாடல் எழுதுகிறார் என்றால் அவர் இறைவன் அருளால் இதை செய்து கொண்டு இருப்பதை என்னால் உணர முடிகிறது. இன்று இவ்வளவு விமர்சனங்கள் வைக்கும் நீங்கள் அவரைப் போல ஒரு பாடலை, ஒரு பாடல் வரிகளை எழுதி, அவரைப் போல் பாடி இன்று அவர் பெற்று இருக்கும் உயர்ந்த அங்கீகாரம் பெற்று விட முடியுமா என்று யோசித்து எழுதவும். இன்று வலை தல பக்கங்களில் என்னைப் போல எழுதும் எண்ணற்ற இசைஞானி இளையராஜாவின் ரசிகர்கள் அனைவருக்கும் நன்றி...இதை அனைவரும் புரிந்து கொள்ள வேண்டும் என்பதற்காக தான் இந்த பதிவு.

......In India- the Songs belong to the music director as creative property, although as per Association Agreement singned in 2007, a sum of not less than 2% but upto 10% royalty may be paid to the Singer (Sony Nigam received 10% royalties for many Songs). In 2015 - Bombay HC however deemed this unfair to the music director and insisted that Singer could get royalties only upon signing contract signed prior to the singing of the song.
So today Music Directors own copyright of every song composed by them while the Producers only have rights to play the song in their movies. The songs are no longer owned by a Producer, it is just a leased property.....

The Copyright (Amendment) Act, 2012 (2012 Amendment) came into force with the primary objective of establishing an equitable and just framework for administration of copyright and sharing of revenue to protect the rights of owners and authors (Ilayaraja) incorporated in cinematography and audio recordings.
But, it does not say anything about the copyrightable work. Also, it has to be taken into consideration that Section 18 of the Act says that the owner of creative work can assign the copyright to any “person”.
Therefore, an owner (Ilayaraja) or author (Ilayaraja) has the right to assign his copyright to a production company and also has the right to assign it to any other person at the same time.

As per a supreme court lawyer: "A song usually comprises three elements-lyrics, tune and voice. According to the Copyright Act,1957 (amended in2012), there is a clear line between the owners and the authors of copyright under the Copy Right Act. The Act gives the right of royalty to lyricists and composers if the song plays outside of the cinema halls. According to Section 2(d)(ii), a composer of musical work is an author and lyricist is an author in relation to literary work (lyrics) under section2(d) (i) and the producer in relation to sound recording is an author under section 2 (d)(v). If the song is a part of a film and is going to be played as is, then the producer will be the owner of the song. The rule is the same if it’s an album owned by a recording label. Also, because a song has three different elements, all three can be registered separately under literary work, musical work and a performer’s rights. The song as a whole (the master sound recording) will still be with the producer (music label or film producer). If a restaurant, for example, is going to play songs by AR Rahman, or if Spotify will play a Shankar Ehsaan Loy playlist, these will be outside the scope of the films in which they exist. The composers, lyricists and singers will receive a percentage of the royalties because the restaurant is charging the customers who are listening to the music while Spotify is also earning through its subscribers. It’s essential for film and music production companies to sign on third parties for issuing public performance licenses and the collection of the fees. Some such organizations are Indian Performing Rights Society Limited and Phonographic Performance Limited among others."

Man trust me this Guy knows what he is talking about, there was a verdict by the judge already in 2019 , however this guy was pretending like he doesn't know anything whatever happened. This Echo and the producers had the old contract for the audio on cassettes only, but Not on other devices and those companies didn't request for a new one from Ilayaraja and they were selling Ilayaraja's songs Illegally all these years. Therefore they must pay for everything whatever they have sold so far and they must pay some fine for ILLEGAL usage of Ilayaraja's songs.

The Madras High Court on Tuesday prohibited monetising songs of renowned music composer Ilaiyaraaja through TV reality shows, concerts and online radio channels, among others, without his prior permission.
Justice Anita Sumanth passed the order on a civil suit filed by Ilaiyaraaja, alleging copyright infringement by Agi Music, Echo Recording, Giri Trading Company and a few others.
The court had earlier passed an interim order in favour of the music composer and confirmed it on Tuesday.
Justice Sumanth made it clear that the songs composed by the musician cannot be exploited or monetised in any manner without his prior permission.
However, films comprising songs composed by Ilaiyaraaja released and screened in theatres are exempted from the order.

So today Music Directors own copyright of every song composed by them while the Producers only have rights to play the song in their movies. The songs are no longer own but leased property.....
