  • People who live in a popular Orlando neighborhood are screaming foul about a possible increase in their homeowners' association fees. Some Baldwin Park residents say their proposed monthly association fees are increasing to more than $1,000 per month.

HOAs enrich the financial portfolios of the criminals who skim money from HOA dues in KICKBACKS, PHONY CONSULTING FEES, INFLATED SALERIES PAID TO PHONY MANAGEMENT COMPANIES and OUTRIGHT THEFT, Houses in HOA communities are difficult to sell and often end up becoming abandoned and derelict. Because it is so difficult to sell HOA homes, real-estate companies often DO NOT disclose that the home they are selling is encumbered with a mandatory HOA contract. The relator pays the HOA management team under the table for a couple of years until the statute of limitations expires for full contract disclosure. Once they are legally protected from criminal prosecution, the management team springs several years of past unpaid dues on the homeowner. The dues were actually paid by the real estate companies but the money was skimmed off by the HOA management team. Houses that are not sold are usually shatched up by house floppers and rental home owners for pennies on the dollar. The people who purchase them are often connected with the HOA office or are actually the people in the office. . When I attempted to explain this to the district attorney in our area, he informed me that HE DIDN'T WANT TO GET IN THE MIDDLE OF A BUNCH OF SQUABBLING HOMEOWNERS and hung up on me.

      ​@@we8608 HOAs destroy neighborhoods by making the homes virtually impossible to sell. This actually lowers property values for the homeowner. The way the process actually works is the homeowner can no longer afford the HOA fees, fines and harassment. The house is then foreclosed on and becomes abandoned. The property is then snatched up for pennies on the dollar by a house flopper. The house flopper does a quick & dirty remolding job and the house is sold before the house flopper is required to make a payment. The home buyer isn't informed that there is an HOA because the house flopper is paying the dues under the table to the HOA management team who skim the money off into their personal accounts.. Once the statute of limitations expires, any criminal or civil liability no longer applies. The HOA management then informes the homeowner that they are several years behind on their HOA dues and either pay the back dues or face foreclosure. Bottom line: HOAs do NOT increase property values, they destroy neighborhoods while enriching the HOA managers and property management companies.

    I'm on the HOA board in my community just north of there and our HOA fees are being reduced. Something isn't right if an HOA board won't show the books. The MUST be transparent with the money.

      In most states the HOA must report their books and must do a reserve study to ensure the dues are sufficient.

    In the United States, folks living in cars because they're not fully housed is a mix of different problems. Rent and house prices are high compared to what people earn, and wages aren't going up much. Losing a job, not having a strong support system, medical bills, getting kicked out of a place, and not having cheap housing all add to the issue. There are also bigger problems in the system and not enough good rules to fix things.

      The problem is, a potion of the HOA dues paid by the homeowners go to bribe the legislatures and public officials who are supposed to protect the citizens. When I attempted to report the criminal activity by our HOA, the district attorney told me "HE DIDN'T WANT TO GET IN THE MIDDLE OF A BUNCH OF SQUABBLING HOMEONERS" and hung up on me.

In the 35+ years I lived in our community I haven't met one homeowner who wanted the HOA. Since the people in charge of the HOA are the ones who count the votes, it is impossible to vote them out. .When a homeowner speaks out about the corruption, they are hit with non-compliance fines.

You're saying that you purchased in an HOA - all your neighbors purchased an HOA, but now for some reason everyone has changed their minds and nobody wants to live in an HOA? and in 35 years, you've had the same people in charge? I don't know anybody who would want to do that for 35 years. If you feel that there is corruption in your HOA, you probably should be reaching out to the Ombudsmans office. Good luck.

      ​@@nancydominguez6967 As I stated before, the solution to the problem is to make HOAs VOLUNTARY and not MANDATORY. Then people like you can remain associated with an HOA and the homeowners who want no part of them can quit.
      You stated that my post made no sense. Whether is does or does not make sense to you has nothing to do with the reality of how HOAs operate. Apparently you are either one of the criminals skimming money from homeowners or you are unable to understand the process. Many of the homebuyers were unaware of the existence of the HOA when the house was sold to them. When a home is sold by a house flipper or other sales organization, the buyer isn't told about the HOA. The house flipper then pays the criminals who run the HOA under the table and the buyer is unaware that they belong to a MANDATORY HOA. After a period of time, which it typically about 2 years, the statute of limitations expires, then the buyer is confronted with a huge HOA bill.
      Your advice to contact the authorities would be great advice if the authorities had any interest in dealing with it. When I contacted the DA's office I was told that they didn't want to get in the middle of a bunch of squabbling homeowners and hung up.

    Increasing over $1,000/mo? OMG, I bought a house in 2021 and my mortgage is $1,005. Annual property taxes $980. HOAs are not the way to go.

      I am in a HOA. It is scary. But I pay a reasonable 335 a month. The HOA I belong to does 5 things. Snow removal. cut grass. Put in roof and replace roof. put in and replace siding. Pay for trash pickup.

    There is no way I would ever want a home with an HOA. I foresaw the problems with them. They can also be sued as well. So there goes the lawn service of roof replacement for condo owners. I don't like someone telling me I cannot have the American Flag on my home during a 4th of July or Memorial Day. I am a retired Realtor. Most of the homes I did sell had no HOA!!!!

      Why? The bills have to get paid one way or another (hoa fee increase or assessments). From what I understand, they need roof replacements and homeowners insurance has gone up. Sadly, some communities chose not to fund reserves for years so that also contributed to increases we've seen in the news.

      @sinebar you realize most HOA board members are owner occupants, right? Yes sometimes there are nefarious board members, but from what I understand, HOA fees are increasing to cover the roof replacement and the significant increase in building insurance (which is a major issue state-wide). Some boards choose to increase HOA fees for roof replacements rather than issue an assessment for each unit. Anyway, my point is that the bills still have to get paid... arguing with a board member who is performing their due diligence is NOT going to change the fact that the roof needs to be replaced and the cost of insurance is going up 🤷‍♂️

      Geez. Are you going to be the one to pay for that? Thinking you'll prove that others are corrupt? What you will find out is that the board mismanaged the common area by low-balling the monthly dues. Residential towers are COMPLICATED and EXPENSIVE to maintain. The construction is much more complicated that a single family home, which itself is a huge challenge. Retirees are not up to the task and they don't care about the future. If anyone is corrupt, it's them. They put their personal finances above the common good. Completely appropriate for Fulorida.

      ​@cpamvca6858 at the condominiums I live we are audited every other year. accounts payable are uploaded every quarter so the entire community can see how every dime is paid for. no exceptions. I paid for catering at our last meeting and before anybody had a chance to take a bite I had to explain to the members that it was on me and the hoa would not be paying for any of it. You have to know where every cent is. Yes it's complicated yes its difficult yes it can be confusing so what. Run the audit and know and understand how the money is being spent.

      Replacing the roofs on 62 homes will cost that much. Added on that is the rising costs to insure the structures. It’s all very unfortunate for the homeowners.

      For a complex like that... a once upon a time $50,000 annual insurance bill is now $200,000+ in FL. My $2800 bill including mandated flood insurance for my FL home went up to $7400 in just 3 years.

You expect them to charge homeowners that amount of money per year for the next twenty years just for roof replacement? Plus? Owners typically get assessed when the roof is replaced by an HOA. Due to the fact that the HOA does not hold that money in reserves and is more often than not managing it poorly. The fact that they aren’t being forthcoming with opening the books tells me all I need to know. I feel bad for the owners who are being punished for no reason.

      @@mnp870Yes, condos are complicated. Townhomes (whcih is what this is about, Townhomes) have a lot of the same complications of Condos. In fact in some places, no distinction is made between condominiums and townhomes, as they are more alike than they are different. When you share roofs, walls, foundations, and the land underneath it all with other unit owners, it's pretty difficult to get rid of an HOA. So, when someone says "just disband the HOA" in a discussion about Townhomes, that really just illustrates that they really don't know enough about the situation to have an intelligent opinion.

      Actually it's part of the globalists "you will own nothing and be happy" plan. They can't get us out of our 3% mortgages so they're using taxes and insurance to push us out. On top of this is the new Florida law that requires 100% fully funded reserves aren't helping the matter either.

      You think "that's all" this is but you're wrong that the HOA is trying to force people out. The HOA is comprised of unit owners. What's happening is that the maintenance costs were historically underfunded and now the bill for deferred maintenance is due. The HOA is adopting these fees so that the common asset can be maintained. The HOA board was probably made up of short timers (elderly retirees) who mismanaged the previous decisions for their own personal priorities and not the common good. Also, it's really hard for the average person to understand the best practices and repair methods for a residential tower. Repairing elevators, pools and large HVAC systems requires a knowledge that even experienced home owners do not have. It's not what you think. At all.

    HOAs are out of hand and HOA companies are pocketing m$ millions. Only a small percentage is actually used to provide maintenance services. There needs to be a law cap on how much HOAs fees should be. It doesn’t matter where you live. Paint cost the same, landscaping cost the same. If the landscape company raises what they charge by $200 dollars doesn’t equate for the HOA to charge 1000 unit residents another $100 or $200 a month.

Look, this is simple: if costs have truly gone up so much that they need to raise rates 300% in 2 years, the HOA should have no problems opening up their books and proving this. If they do, I have no problems with the increase. Well, I do, which is why I'd never live in an HOA, but at least they'd prove that the increases are necessary.

Any homeowner who runs for a board office who wants to run the HOA in an honest way NEVER gets elected to the board. This crap has been going on in our neighborhood for the past 40 years. The money is not properly accounted for due to padding expenses, kickbacks from contractors and outright stealing. The people who run the office brag about the numerous rental properties they bought with cash and the expensive cars they drive on the modest salary of a phone jockey. The homeowners know about the criminal stealing but no matter how anybody votes, the same group of criminals remain in charge.

      HOA companies? What are those? The HOA is made up of the unit owners. The decisions of the HOA are made by elected board members and/or votes of the members. If they want a property manager who understands how to maintain a residential tower then the owners can hire a manager, or, they have to acquire that expertise themselves. But the property manager doesn't make the decisions. Often, you can't even get members to serve on the HOA board because no wants to spend their time for the common good. People don't listen to others and the politics of HOA's suck. It's just karma in action.

      That would make your unit worthless. A unit owner does not own ANY common area, meaning that use of the common area (elevator or walkways) would be trespassing. Membership in the HOA is what gives you easements over the common area. Then there's maintenance of the common area. If the elevator breaks, who pays to fix it? Who decides which vendor to use? Who has the right to sign the repair contract, and to be liable for the repair costs when others refuse?

    A $1.2K month?!? What are they getting for almost $15K a year? My roof costed $8K after 25 years. I do my own lawn so what the hell? They better get free buffets at the free golf club-house and Olympic pool with free massages and health-club w/ pickle-ball. I cry about my $500/yr. HOA fee. These aren't even condos where the structural needs to be fixed every 30 years or so (which is why I'll never buy a condo). I'd get an audit going to be sure no fraud going on.

    The actual homeowners need to get together, fire the management company and create their own HOA board from members of the homeowners. We had a management company for couple years, but then formed our own board a 2nd time running our HOA ourselves. It is the best and only way to have a HOA. You control the fees and spending. Shalom

      That's kind of a fantasy solution. It could work in a small set of situations, where the complex is small, or the board members are extra smart, experienced, mentally healthy and ethical. Maintenance of a residential tower is extremely complex, far beyond what a single family home requires, which is difficult enough. The typical HOA always has a few aholes, so lawyers are commonly needed and the politics are often horrible. The repair methods often require engineers, and the large contracts for repair may need legal review. I don't think many can do this without professional help. You could get lucky.

    Reason why we have a house without HOA, but still our property insurance went up 3 times what we’re used to pay yearly. We will be seeing a lot of Floridians moving out especially the retirees to another state or country where they can enjoy their retirement!❤️🤗

    From my experience as a facilities manager, a massive increase in HOA dues is usually due to deferred maintenance of the property in order to keep the dues artificially low. But eventually at some point, all of the deferred maintenance issues stack up to the point where either dues must be raised significantly, or folks have to be willing to bear a special assessment.

      Assuming you're right, the HOA can simply open up their books and prove that. They should have no issues doing this, since there would be nothing to hide and they're supposed to be their to serve the residents. If they DON'T open their books or are forced to do so by a lawyer, I'd then have to assume that, at a minimum, there are mismanagement of funds.

If someone wants unfettered 24/7 access to the finances of the HOA, then they need to get elected to the board. Simple as that.

But once those dues are raised to where they need to be in order to properly maintain the property, the folks who can't afford to stay there will have a rough time selling their condos.     Our HOA fees in Naples are higher than our NY state property taxes which are the highest in the country. Our property taxes in NY $7000. Florida taxes plus HOA? $9460.00. More square footage in NY as well. HOA fees are a racket.

      17 yrs ago it was all nice in SWFL.... Paradise.....not so anymore....traffic congestion & crowds everywhere, more frequent & violent storms, crazy insurance costs, higher taxes (no snowbird 3% cap) .... so we sold our snowbird home last year....and glad we did! Now we just have our NY home and new RV to take us to FL or AZ or wherever for a few months in winter!

    I know of a townhouse community that voted for owners to be responsible for their roofs instead of HOA. Most owners got a partial refund of the reserves that had been collected for roof replacement. Result was HOA dues stabilized and haven’t increased in a few years.

      Most HOA Boards are VOLUNTEERS. All this ranting and raving going on just show me people should post of what they know stuff about. I'm doing pt. time on a 36 unit and we're going to get a "cash call" for some pretty stupid stuff, but almost all are well healed. The funds also feed LONG TERM issues as well as short term . Our new "digital" boilers are a nightmare. just had two sprinkler leaks (dating back 22 years to bad install) 5,000 just to repair the pipes (have to be Certified fire Trades) adn that doesn't fix the ceiling, with is double firewall with custom stucco. Not my claim to fame. I save a lot of money for them doing basic stuff, but some things just go sideways. Everythingnow costs huge money.

    There's no use to interview the management company because they only implement whatever the decisions of the board are. It's important to check before you purchase a home if its a part of HOA and weight in your options because on top of the utilities and mortgage you'll have to pay for it hoa fee and 98% of the time it goes up on a yearly basis

    This is the new normal in FL. HOA dues are $1000 at a minimum , including or plus any special assessments. Prices of these condos will have to come down. When you buy now in a condo it feels like you are paying a mortgage and on top of that rent , crazy.

    I would never, ever buy something that has any type of HOA associated with it. I know several people who have had nothing but negative things to say about the ones they're involved with. Now in this case, obviously, this is ridiculous in the percentage increases and yes, those are very expensive properties, but it seems like the HOA is just fleecing some well to do people because they feel the people can afford it. Way out of line for painting and maintenance and landscaping. The places look like they're in great shape, so how much maintenance needs to be done and how frequently? It's not like a roof has to be replaced very often and I'm not sure where all that money's going. Strange. Just a rip off.

    I think that many HOA's increases are not necessarily increases, but restitutions. Many HOA's were paying far too less (mine was one of them) than they were supposed to be paying. Yes, there's increases, but how much of it is really an increase? The condos are getting slammed harder as they were paying far too low a fee. Pay now or pay later.... pay never isn't either one of those.

    It's very simple. Each association has a budget based on how much contractors charge for the services, look at the contracts and go from there. People want to complain about budget increases but don't want to serve on the board. If you unhappy with the increase, get rid of the board which you can do under Florida statue. Put yourself on the board and then lower all fees by half but being sure that you still maintain all maintenance and service requirements to be sure the community is still upkept including having full insurance coverage.

      And once on the board put on public bids for all services... Amazing how many times a board member's cousin got the contract despite being one of the higher priced deals.. Goes on everywhere, everyday because people tolerate it...
      Same happens to your pension funds - do you show up for the annual meeting, question the investment advisor, or even know what question to ask without sounding like a fool?
      Also, being on the board does not mean it must be a titled position. Being a member at large still gets you access... Or just showing up for the monthly meeting, they are public after all.

    There may be real reason why cost have gone up. I know insurance rates have sky rocket for FL condos, that said why wouldn’t you have a meeting to explain this to the homeowners They have a right to know what the money is being spent on. Usually board members are residents so not sure why they wouldn’t explain it to there neighbors

    This sounds like the board members are colluding with the contractors and property management. The first step is to request new bids on the work that needs to be done and to audit the financials of the board members and the association. My guess is that there has been a massive amount of misappropriation. If most of the residents are elderly, this could be a federal case.

    It’s stunning how many people don’t understand HOAs and HOA fees. People who live in a community with a homeowners association have to remember that the owners ARE the HOA. Complain all you want, but everyone on the HOA board is also paying the monthly fee. I doubt if hiring the attorney is going to change things much in the long run. It’s like hiring an attorney to fight yourself!

    Warning: The fewer number of homes in your HOA the higher the cost. I live in an association with only 28 homes. When we have an unexpected expense it is divided by 28. Our HOA fee has gone up from $250/month to $380/month in five years. I am OK with that because we paid cash for our home and can afford it. However, we have some single people here that this increase is hurting them. Any additional increases may force some to sell and move. It is a 55 plus community no pool or clubhouse but beautiful homes. All homes have most living space on main level (including master).

    The lack of laws to control any of this is mind boggling. It's like they force you to pay something by law and are able to put whatever price on it they want. This is insane and it will be beautiful to watch when the bottom drops out on them.

    These corrupted & Arrogant (H.O.A's) are (Not) allowed to increase, such (High) Association (Fee's) & must be in a very (Low) rate........! Recommend, these methods, have the Assocation Members (Removed) from their Positions, hired an Attorney & notify the State of Florida agencies that regulate; & filed (Written) Complaints........!
