I have sensory processing disorder (so a much lower level of anxiety) and certain sounds can immediately send me into a rage so I empathise with him. I don’t see why they couldn’t just build a privacy wall at the front as well? Seems weird. Would help the noise too!

This judge is a rare man of deep character and wisdom. His deep respect for vets, the elderly, and genuine loving commitment makes him not just a superb judge, but a rare human being in this present fallen world. What a breath of fresh air to listen to him!

Thank you judge for having the compassion and understanding of this cruel and insidious disease. I applaud you. I nursed my husband for 9 years with Alzheimer’s and it is not easy for family members and caregivers.
This and senility are so hard for the family. Watching someone you love and have respected for so many years change into a person who’s no longer even able to recognize you is horrible. And all you can do is watch.
It's refreshing to see a judge taking a bow to a combat vet and giving props where props are due........thank you Judge Simpson for being a man of integrity and compassion.

As. Prior primary caregiver for a generally non-violent veteran with terminal dementia, this is one of the most difficult things to do. A person like this needs constant supervision, and that's an incredibly tall order, even in a nursing home. My heart goes out to him, his wife and loved ones. ❤
As a Viet Nam vet myself, with cognitive issues, I believe the pros needs to have a long talk with the supposed victim. Judge Simpson has it nailed.

The way the wife keeps looking back at her husband. Letting him see & hear her there for him....helping him feel a little more safer in the court. And clear in knowledge someone he knows is there for him *always & forever❤💙

If think that if he had the jurisdiction, Judge Simpson would have ordered the neighbors to just ignore the vet and leave him alone.

As a combat veteran; you're not exempt from treating others with respect. If he can't handle loud noises and is threatening people. He needs help or to be put into an institution.

Simpson is a good judge for a case like this. You can tell he does actually care.
Judge Simpson made me so happy with the depth understanding and care of this mans case, I know the law tries to make life better for millions of people every year but Judge Simpson really applied the court’s best side.

I love judge Simpson. I stood in front of him 1 time and, he was absolutely amazing. It was a simple payment plan I was there for, but he has empathy, understanding, and compassion... all while being just. I wish all judges were like him. The world would be a better place if we all could have half the traits of this judge.

How do we know that the "victim" suffered enough⁉️ yes we don't know the entire story. That's why I about fell out of my chair when he said "the very fact that they have the right to file the complaint is because he preserved their right to do it." My heart swelled with pride for that Judge. You have No idea the demons we fight and it sounds like the neighbor is a jackass that provoked a combat veteran suffering from terminal dementia. Complex severe PTSD is bad enough. I can't possibly imagine how bad it would be if I started losing the ability to remember my meds or the counseling ECT.. 😱😫😓🪖💯🇺🇲

Of course he should be allowed to be on his driveway . He’s as much right as the next person. If anyone wanted to know the true meaning of love just refer to Mrs penz. It’s extremely difficult to look after the person you married all those yrs ago and have them slip slowly away from you as the dementia takes hold.
Although we don’t know how much mr penz has ‘upset’ neighbours over the years, compassion and understanding is lacking. It’s not as if mr penz has any control over his emotions. It seems that the loud noises trigger him. Any vet would say the same after combat.
I hope that Mrs penz gets all the help she needs so that she can have respite to come back later recharged for another day.

Obviously the easy solution is the neighbor turns their freaking music down. Listening to this though we may be past that. It sounds like defendant literally can't stand the sight of the neighbor, and gets provoked into a rage whenever they have any kind of contact.
The neighbor sounds like a jackass, I don't like anyone that plays loud music, but they do have a right to feel safe and secure in their home which clearly can't happen now because the defendant has cognitive decline, and lives on a hair trigger. I agree with simpson that he should be allowed on his driveway, I also think he shouldn't be out there alone because he's going to hurt someone.

The neighbor can't help being the VICTIM! The vet is the aggressor as he seems to look for any reason to yell at his neighbor, have altercations, bang on his windows & even threaten his life. This is obviously an ongoing issue according to his wife so the victim did the right thing by contacting the authorities. Yes, it's sad that the vet suffers from various illnesses, but that doesn't mean he's innocent. There's a reason he was found guilty & got locked up!

It sounds like his neighbors are total assholes they're going to have trouble with anybody they were to make the neighbor move.
@@zerieth6620As frail as Mr Pence looks, I don’t see how he could physically harm anyone without a firearm, which was discussed at the beginning. If the neighbor is able bodied, there is no reason for him to be close enough to be physically harmed by any object Mr Pence might have.
The damn neighbor is just as culpable as Mr Pence from what we know from this hearing. Maybe more so. He suffered property damage so that absolves him of any responsibility?
Judge Simpson is a very compassionate man.
Judge Simpson raises a really concerning issue about Alzheimers. The individuals and their families suffer under an unbearable situation and isolation. That a neighbour could have such stipulations imposed is truly frightening.
I do understand that the neighbour also has a right to live his own life in peace but how can we know for certain that neighbour isn't goading the patient. We can either live in our own homes or be confined to a 'rest home' where

How can they convict an Alzheimer or dementia patient? They don't have any idea what is happening or control over themselves or understand? They are mentally unfit to defend themselves in court or understand it. Won't remember the next day or even hours later that anything happened.

lol... You people simping for this old guy is sad. I am a combat veteran and understand what war can do to you. But this is a vet that needs to be put into an institution.
Serving our country doesn’t mean you don’t need to protect yourself from him or that he’s exempt from not threatening you. You don’t know the circumstances and that neighbor needs to make sure they’re are safe!
I usually don't watch much of Judge Simpson but this video hit so close to home. My father is a Vietnam vet as well as my father in law. My father in law is only now showing signs of cognitive decline but, my own father has been steady going down hill for the last 15 years, to the point that he flips out on my bed ridden mother over where his eye glasses are when they are sitting on top of his head. It's very difficult on these Vets & on their loved ones, & I'm very happy that Judge Simpson understood how insane it would be to restrict someone who helped fight for our freedoms, be limited on their own property. My heart breaks for his wife & the guilt she feels when all she ever did was do what a wife does, love & care for her husband, even during their hardest times. I pray for them. And I thank the judge for understanding.

I'd be mad to if someone started screaming at me, hitting my windows, and threatening to kill me. From the outside looking in obviously there is more to it than that but from the neighbors perspective it's pretty reasonable to call the police.

The lovely, dedicated wife is carrying a lot of weight on her shoulders taking care of her husband. She's in survival mode and doing it with grace.

I have PTSD from two combat tours, loud noises like doors slamming, yelling, fireworks, amongst other things, trigger me. Im sorry when i yell "F*CK!" I can't help it. I had neighbors that threw firecrackers in my back yard because they thought my anxiety was funny.(Itvwas a family of idiots on paper). I moved as well. Hope this man gets the help he needs. 🙏🏽🙏🏽🙏🏽
Also: The VA Emergency Room won't hospitalize for mental health, the mental health department has to do that. And its like pulling teeth to even get an appointment. 🤬🎉
Thank you for your service and I am so sorry you had to experience that. Vets should have elite communities so they can have their homes without the hassle of assholes who trigger them. The neighbor in this case seems like an asshole who needs to show empathy for a person who fought for their freedom.
My grandad came home from second world war they got treated badly when they got home I would have hoped by now with ptsd being recognized things would be better but more I see can see nothing has changed . Hope you are doing ok

I didn't catch her name, but the wife is an absolute angel. Being a full time caregiver for a seriously ill loved one, especially when the illness has such a cognitive impact, has to be one of the most difficult things. The love she has for her husband is palpable.
He's so incredibly fortunate to have her as well as Judge Simpson.

Also, the DA made it clear that the vet has it in for his neighbor which makes him the AGGRESSOR so he's the one who "made this happen". Regardless of your opinion, the neighbor is the VICTIM here so don't you play that game with me! But thanks for clarifying your bias 👍

A little extra compassion for those who gave us the right and ability to sit in a nice house, with the free time to piss and moan on the internet would be a good thing.
My neighbor was suffering from dementia and would come over yelling at me to stop spying on her, and then beg me to help her because snakes were hanging from her ceiling taking pictures of her. She got to the point where she wouldn't use the bathroom or shower so I let her use my bathroom. After knowing her for years as the kindest sweetest person, i would do my best to calm her down. It was so sad to see her mind treating her this way.

I knew a woman that swore there were snakes in the walls watching her. How do we know what but that at a certain age the human brain develops the ability to see trans-dimensionally. It is admittedly an odd theory, but we dont know and cant explain what we dont know. The "scientific understanding" we believe we possess today may be perceived "primative" in 500 years.
This Neighbor is not INNOCENT infact more than likely is the problem & shame on him! The D.A. seems to have ZERO Compassion but knows & can see that Judge Simpson certainly does but for him too not want this man outside on his own driveway ( other than transport) is the most Ridiculous request out of his ungrateful mouth! @@brendaallen1060 The police are also at fault. Instead of arresting veteran and taking him to jail, they should have consulted the wife and taken the man to a VA hospital. The prosecutor decided to charge the man without finding out anything about the Veteran. It is disgusting this Veteran was treated like a criminal! I like the firm way Judge Simpson told the prosecutor that he will not sign the order preventing the Veteran from using his own driveway. I teared up when Mrs. Penz said that they are planning to move to avoid any future problem with the neighbor. Mrs. Penz is true to her marriage vows “ for better, for worse, for richer, for poorer, in sickness and in health, to love and to cherish, until parted by death”. She is a remarkable woman! God bless her, and her husband!!

He does have a job to do and he has to make sure the victim is protected. Doesn’t mean he’s a bad man for it. Imagine how he’d feel if later on the victim ended up dead? His job is to keep the people safe. So he’s not being an asshole by doing that. He doesn’t want the guy to get in more trouble by also keeping the neighbor safe. That’s his JOB and an oath he took. He can’t just let mental health people run around threatening people and breaking their windows and pounding on them scaring them and threatening them just cause he “has a heart” he has to have a heart for the people as well.

When Judge Simpson heard loud noise is a trigger. Made a point to not raise his voice & watch any actions made to reduce chance of loud noise triggers. Not part of his duties as a judge but a part to show Judge Simpson is a caring & thoughtful person💎💙 Judge Simpson is a trully amazing person x

Lol I thought my eyes were playing tricks on me or there was somehow a shine to his hair and that made it look lighter ...but then he looked down I zoomed in and omg lol he is doing a side bang kinda comb over but bald spot was to big for the thinning hair to help cover it.why do a combo over if u have huge gaps in some areas that will automatically lead our eyes to the spot he's trying to cover.him doing his side bang style is just cringe and I bet when he's around people there eyes are CONSTANTLY being lead to the shinny spot and he knows it.i had to be sure and loom through the comments.
I have been in Mrs. Pence's position. Thank God my husband, an Air Force veteran, had no issues with any of our neighbors, so none of our neighbors had issues with my husband. The disruptive behaviors began once my husband was removed from the home. It BROKE MY HEART THAT WE COULDN'T SPEND THE REST OF OUR LIVES TOGETHER IN OUR HOME. However, his altered mental status from vascular dementia made living at home unsafe for him. Sometimes, no matter how I tried, I couldn't control my husband's behavior, so he had to be in a controlled environment, a memory care unit. He was never a threat to me or our daughter. He just lost an understanding of safety awareness.
Judge Simpson never ceases to amaze me. Your Honor, you are in a class by yourself! Thank you for your compassion on the bench!

Also, veterans that get older start to re-expierence things from their service and doesnt always come out until late age or disability especially Vietnam Veterans that were hated for their service. God Bless this family and this Judge.

I'm not an American citizen, however, I have visited many many times and as an English woman I have always held "The States" with regard, I watch with great interest many of the courtroom action channels in order to compare the British and American legal proceedings and associated behaviour of those involved. I hold Judge Simpson in high esteem for his no-nonsense yet compassionate approach to all he encounters, I also watch carefully the minute body language of those who are before him and other Judges, I witnessed the prosecution lawyer at 30:15 make a hand gesture that I interpreted as one of exacerbation with the comment made by Judge Simpson and left me feeling rather angry. A minor matter to many yet indicative of the attitude of this prosecution lawyer, almost a " for goodness sake Judge just follow the stips and recommendations" No Sir, this is the exact reason we all have a Judge who presides and ensures amongst other things fairness to all. So, get a hair cut, tidy your office and remember all people matter and this veteran sacrificed a lot to provide you with the freedoms you currently enjoy, his wife isn't far behind on that scale putting him back together since returning from the military.

An example of true appreciation and respect for the military, as well as compassion towards others.
We as a society have to take care of our veterans, elderly and our vulnerable neighbors. I pray this woman and husband never have to leave their home. They deserve help from our society, VA, State and United States Government, all our veterans do. Full time caregivers, nurses and doctors and in home care as well as housing, healthcare, financial support, medical care. They deserve the best care, and our support.

Mrs. Pense is an amazingly good person. I am a Marine Veteran and have many friends with PTSD and certain things trigger us...very loud noises, certain smells, etc. My father has dementia and he is a combat veteran as well. As such, my heart goes out to this man and his family. And Judge Simpson is so understanding and compassionate...with the wisdom of Solomon. This brings back a great deal of memories, of friends and my dad, who have given so much to serve something greater than ourselves. God Bless all veterans and this judge...thank you so much for what you do. Tears are flowing because of how little some people could care less about there neighbors. Above all else, be kind.
I have so much respect for this judge. His heart is in the right place and his sense of justice is right on. If only he could be cloned. I’m a 71 year old retired parole officer and have seen the ugly underbelly of our society too many times to count, but this case brought tears to my eyes for all the right reasons.

I wish we cared more about our Veteran's within our communities. My heart is especially for Vietnam and Agent Orange. It sounds like what is causing his issues. I pray she has gotten him rated. My Prayers going up for him.

Cause you can’t have fences that are 10 feet tall in your front yard lol. There’s city ordinances that won’t allow that. Imagine how weird it would look if people had 10 foot fence down their drive ways! lol

Judge Simpson is simply the best. This case made me tear up as well. I wish the defendant and his wife peace and love for the rest of their years.

As a Veteran myself, I appreciate that he understands what it took to enable the population to enjoy the freedoms that they have. The neighbor could've been more tolerant and understanding of this precious gentleman who, undoubtedly, is experiencing PTSD as well as alzheimers and/or dementia. This case was so sad because I know Wendy she’s going through. My grandma suffered from Alzheimer’s and we all had to chip in to take care of her, and there were moments grandma would get so aggressive with us and we did everything we possibly could to calm her down and we weren’t always successful but NEVER did we even think about putting her away to make her someone else’s problem, we rolled with the punches. So I 100% know what the wife is going through.
I watch Judge Simpson daily and respect his work ethic very much. I'm not sure why he"s having so much trouble articulating his concerns and thoughts in the hearing. It is interesting to me to watch him move chess pieces around. When he asks questions, one never knows who he is really targeting when the question is asked. He looks to see what answers are given. He may be looking at the defendant while asking the question, but wanting to see how others will respond. Kind of tricky but not. He learns all kinds of things using that technique. ❤❤❤ Unlike Judge Boyd, who is extremely direct! Love them both for their concern of all parties involved, and the future health and wellbeing after court. ❤❤
I think Judge Simpson wanted to say something as a person and his personal thoughts. But had enough mindset to think it through and follow legal rules & regulations & wording. Instead of saying "grow up and behave like adults" and neighbour/victim to show a little more compassion and the vets wife agreed to work harder at managing her husband's behaviours.

funny but i honestly think at the end when the judge motioned the wife i think he probably cried and said to her thank you for the love you give your husband, rarely do we see anyone protecting our rights as human beings, i could go on but i think you might understand it.
Dear YoHonor, Simpson, I have been following you for two days now, and my being a daughter and sister of 3 military men, Father Korea and Vietnam and Brother Vietnam, both are now deceased (Asin Orange Cancer) and my 2nd brother washed out from the marines with a disability of depression (racism from the 70's)..
I just want to say thank you for bringing awareness to, in my opinion, this ridiculous issue.

People must understand that, to take a human out of their environment and drop them into a jungle to fight FOR THEIR COUNTRY is a magnificent and priceless honor.
