    I believe every word she said. You can tell by HIS body language she’s telling the truth. He’s broke and need some money

      For me it was how vague and wishy washy his version was, vs how specific hers was. Guys on PC, when they’re wrong, are super vague. “Oh we just grew apart. I think her friends/mom poisoned her against me” then it’s the girls turn to speak and she has a very specific story about cheating/abuse/addiction. I think that specificity really shows who is telling the truth.

      I have seen a lot of these cases, and sometimes one party will tell small lies to make them look better but it comes back to bite them as then the judge does not believe them. The defendant did not try to lie to say she already returned the ring. When asked if he asked for the ring back, she said he did but she wanted the money he owed her. Her story is they both agreed for her to keep the ring to settle the finances between them and then they went their separate ways six years ago. Her story is just more believable as the truth.

    If he had really truly wanted it back he would have sued her 6 months, 1 year, even 2 years after the breakup. To wait 7 years is ridiculous.
    Something is fishy. Either he needs money or he's trying to find a way to see her again.

      Actually, I believe they said they're from NY, and the statute of limitations for engagement rings is only 3 years, so he was definitely out of gas either way....lol

    Plaintiff definitely comes across as seriously medicated. Whether that is prescription or not. Dude is so emotionally stunted and monotone I'd wager a bomb could go off behind him and he'd barely notice.
    And yeah, totally believe the defendant's side of things. Plaintiff either needs the money or just wants to see her again or both.

    Ppl complaining that he should get the ring back are dense. It's too late to get the ring back. You have a window of opportunity to get the back which is 5 years. Where was he for 5YEARS!     It's called Statute of Limitations. I didn't have to watch the case after hearing how long it had been. Even if he had proof that he didn't owe her anything, he still would've lost based on the Statute.

    In most US states, engagement rings are considered "conditional gifts" given with the expectation of marriage. This means that if the marriage doesn't happen, the person who gave the ring is usually entitled to get it back. The reasoning is that the ring symbolizes a verbal agreement to marry, and ownership isn't fully transferred until the wedding takes place.

      Yes but that is not an absolute return in all cases. Her defense is that they created a new agreement where she could keep the ring as settlement for money he owed her. In this case neither party had much evidence but her story makes more sense. If he valued that ring so much, one would think he would have sued much sooner.

    To be fair yes 7 years is a little to late but the defendant doesn’t has any evidence of all that money and support she gave him nothing but word of the mouth or (flapping gums as the judge would say )and he does have evidence of buying the ring ..
    The only thing she should have taking into consideration is 7 years too late for a law suit, my opinion is the judge let her emotions over rule her judgement plain and simple...

      Agree with you. I didn't like the way Judge Milian handled this case; it seemed like she got emotionally wrapped in in sympathy for the defendant based on a whole lot of nothing. It's all the defendant's word about how he supposedly owed her - she presented zero proof that any of her help to him was in the form of a loan or that she expected to be paid back. People who are in relationships often help each other financially, and that doesn't make it suddenly turn into a loan after the relationship goes sour. If it was a loan, show documentation of it. Morally, I think she should have given him the ring back, and most jurisdictions would have found in his favor, if he filed in a reasonable amount of time - his biggest failure was waiting for so long to pursue it. Honestly, I think he waited because he naively thought he had a chance to get her back - it had nothing to do with any supposed payback he owed her.

    I think he thought he could win her back. And they would actually get back together. The ring was an anchor. Once he finally came to terms with the fact it was over, he wanted the ring back. I think it was less about money, and more about anger and closure. He is still working through the stages. That's why he's blaming her mother. It's hard to admit when bad things happen to you, and you are at least partly to blame.

      1) What does that have to do with the issue at hand? He said he never got the ring back even though they did not marry. She agrees she did not return the ring but her story is they agreed for her to keep the ring to settle debts her owed her. 2) People acquire citizenship through marriage all the time.

    If marriage doesn’t happen ring is returned- UNLESS a new agreement is made. It’s way more likely- which is all it needs to be in court like this- that a new agreement was made and he was fine. That’s why he didn’t care in seven years. But somebody dumb told him ‘the ring is yours no matter what since you didn’t get married’ and now he’s here trying his luck.
    The man was living with his mom and then kicked out his fiancé because he wasn’t willing to come off any money supporting her while she was in school. If he really thought that ring was his to keep, he definitely seems the type that would have been here before 7 years.

    I am curious. i agree with the verdict. However - if the decision was simply based on the number of years weighing more in favor of the defendant - then I have to wonder: if he sued her right away, then would this have been a different decision? (because then there would be the conflicting stories with her saying that he owed her X amount of money but with no proof, and him having the ring given in contemplation of marraige...and then the number of years would not be a factor, so would the judge need to have the ring given back?
    either way I wish them both well. I hope he gets the monkey off his back and I hope they both move on to find happiness, and since they're young they probably will :)

      As the judge said, she had two parties that only had their testimonies. Neither had any documentation.
