  • The plaintiff purchased a car from the defendant. A month later, the defendant took the plates, so the plaintiff is suing. The defendant argues the plaintiff failed to prove employment, so she lost the vehicle.

And I don't believe that she had a job at all not only cuz she did not provide proof but everything she said just sounded like a lie to me and that she got to work late and then she had to go back out and get her work jacket she didn't even go in dressed like what definitely not a very good employee

    The defendant is a crook he doesn't wait for employment verification because then if it's proven incorrect he repos the car, keeps the deposit, and then starts all over again by trying to resell it

      It's called spot delivery and is a common practice, even with brand new vehicle. There's usually a disclaimer in there saying if you lied about your credit or income and can't get approved on financing you bring the vehicle back and _possibly_ lose some of your deposit based on how much use you got out of the vehicle while awaiting for approval.

    Selling used cars to people with bad credit is not community service. It's a business. If employment verification is a requirement, don't complete the sale without it. Your bad policies and procedures are not the customer's problem.

      I was wondering when he said verify employment what kind of place it was. I have never once had a dealership ask to verify my employment, I actually just bought a new car in December and i don't have a job, I own property and I get social security, but they did not ask for any of that, she must have horrible credit.

All of the cars I've financed, only 1 asked for finance information and that's only because my first new car was financed directly through the bank, they just asked for consent to check an account I had with them.

    30 hours is usually considered full time. The company might say its not full time due to not wanting to pay insurance. Also it should go by pay. I worked 30 hours but I made a full time wage plus they still gave me insurance.

      Didn't hear a thing that implied the defendant was being racist, which is what you're dancing around. What I will say is that if your business is selling cars to people at sub/prime interest rates you're taking the chance on everyone you sell to. They have bad credit, bad payment history, run with the vehicle, hide the vehicle when it's out for repo. So I would tell this guy he'd better get straight so he has the upper hand when things fall through. That means he needs to follow the letter of the law make sure his contract includes all those fine details. And don't release the car until everything is verified!!! Been in the business, know how both sides work or don't work if you like.

    I have had my license plate stolen from my car twice (different cars). One they just stole, the 2nd they replaced my plates with stolen ones. A regular person NEVER has this happen and I've had it happen twice. 😂

    So many cases in which a litigant can't prove a payment. Judge Marilyn should tell them to be sure to always get a receipt, maybe even to the point where cash doesn't leave this hand until they have a receipt in the other hand.

    A "salesman wasting time with her" shouldn't be compensable, that's his job. The plaintiff and defendant's comments in the hallway were both stupid. The plaintiff talking about there was ONE paystub with 40hrs on it is just silly. (BTW, I thought full time was anything between 30-40hrs a week). Then the defendant talking about "people like her" ruining it for others ... I mean if he's in that line of business, it's to be expected. Dealerships who work with those with bad credit have to expect these things because with the exception of a few, most people with bad credit couldn't care less about it.

    Even though the contract doesn't state it, it makes sense that if the financing falls through, the deposit is non refundable. Especially if the applicant lied or failed to provide proof to back up the info on the application. The fact that the Plaintiff did this with another dealership is also suspect.

      she didn’t lie though. they asked if she worked full time and they were provided with a pay stub that showed that. IRS considers anything 32 hours or more a week to be full time

    Defendant was being lazy /greedy for a sale … I would tell her you can have the car on Monday when we verify .
    Also putting down almost 75% down and work 33 hours is more than enough security against a loan ????

    LOL. Why does NOBODY document anything??? They don't document when they pay people large amounts of money with cash, like when she handed them money for insurance. You didn't ask for a receipt, seriously? And this "dealership" is just as bad. They don't document repeated attempts to reposess a car and repeated efforts to contact the plaintiff? Both sides are incredibly sloppy here.

      Actually, I don't completely disagree with you. But if it weren't for dealerships like this, who are available to people who have severe credit challenges due to financial irresponsibility, they'd be stuck doing cash only private party buys. The people who do rely on these types of dealerships are a gamble for them as well. It's like being a bail bondsman... they have to protect themselves as well. I just don't understand why the defendant didn't have the obvious evidence that he'd need with him.

    WHAT? Doesn't the judge always tell us that a deposit is ALWAYS non refundable unless it states that it is, so why in this case is the judge saying it is refundable even though it doesn't specifically say that?
    And 32 hours IS FULL TIME work...
