At the heart of this case was whether certain provisions of the Public Order Act Chapter 104 of the Laws of Zambia went against and therefore contravened Article 19 on protection of freedom of assocation and Article 21 on protection of freedom of assembly and association . What were the Holding of this case?
The Supreme Court held that the Public order Act Section 5 was inconsistent with the relevant provison of the Constitution and thus declared it null and void and requested Parliament to then enact the law which is now called the public Order Act Amendment No.1 of 1996 ..Section 5 talked about Notification of the Police authority if you want to hold a public gathering
So the key facts about this is case are what I didn’t get it??
It was about Section 5 of the Public Order Act and whether that provision was Constitutional. It required any person who wanted to hold a rally to get a permit .
Christine Mulundika and 7 Others challenged the provision as it was unconstitutional.
