    Thank you a lot for the video! It was very informative and answered some of my question. It is my understanding that even if the child is listed on one of his parent’s asylum petition, he can still file SIJ based on the second parent’s abuse. And these two cases can safely go in parallel both for the child and the parent who filed asylum, listing the child as derivative.

    Hi there I have a asylum case pending with my wife and daughter since 2017 and my daughter is 17 what should be the best for my child ? Plz help

      If you both are taking care of your daughter, and none of you have abandoned, neglected or abused her, then she will not qualify for SIJ. If one parent abandons, abuses or neglects a child, then the child can qualify for SIJ, even if that parent is still in the US. (Unfortunately, we often see this in case of divorces, or separation, substance abuse, etc.)

    Hi 👋, I have a family member who seems to meet that case he is on his own but legally with us tourist visa under age 17 , he is practically by himself. Does he meet the requirements. His parents live outside of USA 🇺🇸 would the parents be affected in the future ? If they ever entered the USA for abandoning a child ?
