    Hi lawyer! I am currently 17 and I live in China, studying at high school. My parents always abuse on me and I even got to the local police station several times. Can I come to New York with a 10-year travel visa and then apply from such SIJ green card?

      SIJ is difficult to do without a lawyer. Maybe it's possible, but I've never seen it done.

    Hello, Mr. lawyer! I live in Russia, I am 13 years old and soon I'm going to apply to SIJ, my parents live together, but I am subjected to psychological and sometimes physical violence by my father, I am against the current government (those who are against us are put in a children's colony), and I don't want to go to die forcibly in the war in Ukraine, on the contrary, I am for peace. Can these arguments help me with getting a green card for this program? And if there is physically no money to move to Mexico at the US border, can I apply for asylum online or at the embassy of Kazakhstan, for example? And will it help that I already work as a programmer (on a freelance basis) and I already have one large company ordered a website? I'm sorry for asking such a long question.

      Complicated question. You can only apply for SIJ or asylum if you are physically inside the US. Applying for refugee status at an embassy takes a very long time and the requirements are strict.

    As the gaurdian, what are your responsibilities? does the petitioner need to remain at your residence or in the state while on SIJ green card?

      For the most part, the petitioner/guardian would have to provide financial and emotional support to the minor. It is ideal to have as a petitioner someone like a parent that has been taking care of the minor, providing housing, covering their bills, actively working and engaged in the life of the minor--these are some of the things that a petitioner must provide. In other words, as a guardian, you are basically taking over the custody of the minor. You also would go to court with the minor and likely to testify on your relationship and how you will provide for the minor. Besides, the parent(s) who abused, neglected or abandoned the child are to be contacted as they sign some documents (giving up their custody, if I am not wrong) as well as informed about what is being filed. About your second question, if I am not mistaken, I read that once SIJ is approved, you can change jurisdiction, but court needs to be notified so the process can continue/be transferred to the other state. Address in the same state can be changed at any give time, although I would encourage it to be after SIJ is approved. **disclaimer: I am not an immigration attorney. They just lost there mother ( the only support they had left) and they are left with with there abusive father.       In New York it is considered a "similar basis" to abandonment and is sufficient to apply for special immigrant juvenile status. Living with the mother will not negatively impact the case under these circumstances.

    Hi my priority date is Dec 1, 2021 and got my I-360 and filed my greencard the same time as my priority date. I still haven’t heard back since august 2022 when my I-360 got approved.     Hi, can I apply for SIJ program while having F1 student status? Like can I study still in college and being in process for SIJ or I have to quit? I just turned 19 years old and If I apply what are my chances to get green card?

      Yes, you can begin the process for SIJ while in F1 status but speak with a lawyer in your state before you make any decisions. In New York you can get SIJ until age 21. I'm not sure what the rules are in Washington state, and SIJ is unique because it depends on state law in addition to immigration law.

    Hello, I was subjected to excessive academic pressure from my father while in Korea, and I am currently studying in a U.S. high school on an F-1 visa. My education expenses have been supported by my father, who is nearing retirement age and has informed me that he will not be able to support my college education after I graduate from high school.       Every state has different rules for this. You need to speak with a lawyer in Texas to see if you can qualify. In New York you can do this until you are 21, but my understanding is that most states only allow a version of this until you are 18.

      You can't request to leave (advanced parole) until your I-485 is pending, and that can take a few years after starting the process depending on your country of birth.

      It depends - did you get your green card through asylum? If yes, then you should be prepared to explain why/how you were able to safely return to your country without persecution. This can come up when/if you apply for naturalization.

      Each county in New York has its own family court, and processing times at different courts vary. I usually finish the family court portion in 6-10 months. Then the I-360 will generally take around 12-18 months. Once the I-360 is approved you can get an EAD and apply for the I-485.

      You can study at most schools even if you are completely out of status. Once the I-360 is approved you can receive employment authorization, and in SOME states that might help you qualify for in-state tuition - you should ask the school whether you need immigration status to qualify for in-state tuition.

      This doesn't matter at all, actually. The only thing that matters is that the minor is (1) under age 21, (2) unmarried, (3) the victim of abandonment, neglect, or abuse by one or both parents, (4) unable to reunify with the parents for that reason, and (5) it is not in the minor's best interest to return to her home country. It does not matter if the minor has US citizen children and I have represented minors in this situation many times.

      I can't answer this question because the SIJ juvenile/family court procedure is different in each state (and takes different lengths of time), and because the answer may be different depending on your age and country of birth. SIJ depends on state law in addition to federal immigration law, so speak with an immigration attorney in Washington state.

      I've completed cases in New York where the child was turning 21 in 1-month. So yes, it might be possible but you are quickly running out of time. Most states only allow this option until age 18.

      The only thing that SIJ does not allow is to petition for a parent. You can do everything else.

      @@robinmehla9811 Oh, that could be complicated but technically possible. To get SIJ you typically have to indicate that at least one parent has abandoned, neglected, or abused you. Perhaps you could invite the other parent, but I don't pesonally have a lot of faith in the tourist visa process for certain countries.

      No, it won't impact your asylum work permit. When your I-360 is approved you will have a second basis for a work permit.

      SIJ is an independent pathway to residency, so there is no need for any I-130 process. The SIJ applicant cannot marry until they have their green card. Marrying before the green card will make them ineligible for SIJ.

      The answer depends on the county where you live in NY, but an average time including all family court and immigration processes (from start-to-finish) is 18-24 months. The chances are very high that you will become a permanent resident if you don't have a relationship with at least one of your parents.

      Thank you for subscribing. Yes, you can apply for SIJ if you are under 21 and meet the other requirements. The process currently takes several years, but the important thing is to finish family court (and submit form I-360 to USCIS) before you reach the age of 21.

      The forms for Special Immigrant Juvenile Status (Form I-360) doesn't cost anything. It's free. But eventually you'll have to submit your green card application and that currently costs $1,125 (including biometrics fee). If you are 20 years old you need to immediately call a lawyer to get started.

      You can probably still apply for SIJ in NY with an out-of-state guardian. I can't give you an estimate because every law office operates differently. The filing fee for the green card is $1,225.

      All of that is fine, BUT in New York you need somebody who is willing to apply for custody or guardianship of you. You can use a friend or somebody you live with.

      Which application? The work permit application or the I-360? You have to wait for the I-360 to get approved (~1 year). Then you apply for the work permit, which will take several months.

      Every lawyer charges different fees for SIJ cases. You should consult with a lawyer in your area to see the pricing. Some lawyers offer flexible payment plans, and you might be able to get a work permit (EAD) before the green card depending on your country of origin.

      You can apply for SIJ at the same time as asylum. SIJ will not affect asylum. After SIJ is granted you will eventually be able to apply for a green card, but you will never be able to petition for your parents if you get your green card through SIJ.

      Yes, if you are under age 21 and are unmarried and were abandoned by your father then you can begin the process for special immigrant juvenile status. Some states only allow this if you are under age 18. New York allows it until age 21.

      Being a university student doesn't impact processing times. Have you already submitted the I-485 green card application? If so, tell me the "priority date" on the I-485 receipt notice, and your country of nationality.

      @@marlenbautista4897 No. The visa bulletin for Mexico says that USCIS is reviewing applications from September 2020, so there's a 2+ year delay for Mexican SIJ cases. If you filed in September 2020, then maybe your case would be approved by 2023. You might be confusing the I-360 (SIJ petition) with the I-485 (green card application).

      It's generally safe for green cards obtained through SIJS to travel to the home country, so long as the person did not apply for asylum. If you did also apply for asylum then it's best to speak privately.

      Some states in the US (such as New York) allow you to do SIJ until age 21. You can't cancel asylum, but you can ALSO apply for SIJ. If you are granted SIJ then you'll have options when it comes to asylum. For example, the asylum office or immigration court will probably allow you to withdraw your asylum application once you have your permanent residence.
