I don't think Favre has a real chance to win the suit. First off, the court(s) initially ruled in Sharpe's favor, saying that what he said about Favre was protected under the First Amendment, which I agree with. And since one court already ruled that freedom of speech protects Sharpe and what he said, it'd take something really serious for that to be overruled, so I doubt this case really goes anywhere. If I HAD to make a case in Favre's favor, MAYBE, MAYBE, when Sharpe said that he stole the money, BEFORE anything was proven or whatnot, MAYBE he can make a case on that, but that's his best case. He MIGHT be able to do something there, but I think that that's slim to none

I'm an attorney 3 years out of law school and I don't see how Brett has a case. He's a public figure!! As a public figure, he has to prove the statement was more damaging then a normal person and Shannon by a reasonable search AT THE TIME would have known the statement was false. Allegedly stuff has come out now, that Brett claims clears his name, but that was not available when Shannon spoke. The fact that Shannon didn't say "allegedly" or "if he did this" in my opinion doesn't matter. What Shannon said, I believe is clearly protected speech by the 1st amendment. If Brett wasn't a celebrity he might have a case, but the fact that he's a hall of famer is exactly why this was an issue. Everything Shannon said was hyperbole and/or opinion. It was commentary on the story at the time!! The case likely will be dismissed again. Favre is doing the same thing with Shannon that happened with McAfee. If I'm not mistaken, not too long after Pat got the ESPN deal Brett settled with McAfee. Brett is looking for another settlement. His attorney's are getting paid that's for sure!!
