It was narrated that Buraydah ibn al-Husayb (may Allaah be pleased with him) said: “I heard the Messenger of Allaah (peace and blessings of Allaah be upon him) say: ‘The covenant that distinguishes between us and them is the prayer, and whoever neglects it has disbelieved (become a kaafir).’”
(It was narrated by Ahmad, Abu Dawood, al-Tirmidhi, al-Nisaa’i and Ibn Maajah). What is meant here by kufr or disbelief is the kind of kufr which puts a person beyond the pale of Islam, because the Prophet (peace and blessings of Allaah be upon him) made prayer the dividing line between the believers and the disbelievers. It is known that the community of kufr is not the same as the community of Islam, so whoever does not fulfil this covenant must be one of the kaafireen (disbelievers).

If someone regularly misses salaat as a result of just being weak in imaan they become a fasick or sinner not a kafir. If someone believes they do not have to pray salaat so they have stopped praying permanently and have abandoned salaat then they becomes a disbeliever. Plain an simple

.....Ibn Hazm (may Allah be pleased with him) said: We have narrated from ‘Umar ibn al-Khattaab (may Allah be pleased with him), Mu’aadh ibn Jabal, Ibn Mas’ood, a number of the Sahaabah (may Allah be pleased with them), and from Ibn al-Mubaarak, Ahmad ibn Hanbal, Ishaaq ibn Raahawayh (may Allah have mercy on them)and from other Sahaabah (may Allah be pleased with them),a total of seventeen, that the one who deliberately and knowingly does not offer an obligatory prayer until the time for it has ended becomes a kaafir and apostate. This is the view of ‘Abd-Allah ibn al-Maajishoon, the companion of Maalik, and of ‘Abd al-Malik ibn Habeeb al-Andaloosi and others. End quote from al-Fasl fi’l-Milal wa’l-Ahwa’ wa’l-Nihal (3/128).
And he (may Allah have mercy on him) said: It was narrated from ‘Umar, ‘Abd al-Rahmaan ibn ‘Awf, Mu’aadh ibn Jabal, Abu Hurayrah and others among the Sahaabah (may Allah be pleased with them) that the one who deliberately does not offer an obligatory prayer once, until the time for it has ended, is a kaafir and an apostate. End quote from al-Muhalla (2/15).
Fatwas based on this view have been issued by the Standing Committee, under the leadership of Shaykh ‘Abd al-‘Azeez ibn Baaz (may Allah have mercy on him). I may have missed it, but hasn't the 'ingratitude' meaning of كفر been overlooked here? It doesn't absolutely need to be one of two types of disbelief to still be كفر.

But it is not upon the regular Muslim man who makes takfir to apply the hadd of riddah on this murtad who doesnt pray. The rulings of riddah and the hadd is done by the Qaadi and Muslim ruler. Not just any Muslim.
So to make takfir on the abandoner of Salah is one thing and applying the hadd is another thing.

Nicely said, however I think the highest of us far as iman, Only Allah knows who they are, have missed a salah, or will miss a salah, not intentionally or prementativly, I'm not saying there's a valid reason, but it happens, there's some sort of internal malfunctioning at that time when we don't offer, may we strive to be better ameen, I like how the brother ended it, what's ever going on in our lives, not praying I'd definitely not going make things better. Some muslim never realise they become a disbeliever. Some will later assume themselve repenting and star praying again without knowing they are not even muslim anymore. O Allah, you promise no mercy for them after they become disbeliever.

If a man didn't pray out of ignorance there's no punishment but he must make sure to pray from then on. He doesn't even make up prayers but he can do extra prayers.
Ppl who refuse to pray are imprisoned for 3 days and told to pray. Ask the big scholars. There are differences of opinion about if they aren't Muslims. In this time of great fitna we can say many Muslims are ignorant or dont pray with khushu, etc. They need dawah and they need to make taubah.
Allah guide us and make us from the good believers.
