Hopefully the law makers see the logic and incentive behind this someday .     An unlawful arrest such as this is an assault. A person assaulted has the right to defend himself. This sawed off cop was armed with a lethal weapon and beyond any doubt would use it. Therefor the citizen would be entitled to use as much force as necessary to defend himself, up to and including lethal force if the cop reached for a gun taser or club. The cop could have ended up dead, a result of his own stupidity and contempt for citizens.

    The really BS part is the man had to hire an attorney to ‘hope to get his record expunged’, after a judge found there to be no reason for the arrest. Why wouldn’t the record automatically be expunged?
    Cops want every citizen to have a record. If every citizen is on file, any future instances with cops becomes a ‘subject is KNOWN to police’. This way the can make it sound like you are this dangerous career criminal. Which makes getting future convictions that much easier.

    It is not a crime to record a police officer that is on-duty and preforming a function of their job in a public place. There is no expectation of privacy in a public place.
    Any reasonable officer should have known that. This department is going to get sued and will probably end up paying a settlement. The officer may even lose Qualified Immunity and be personally liable.

      Since he was in Texas, First Circuit opinions do not apply. He would fall under the 5th Circuit. There are 13 Federal Circuit Court of Appeals. All 13 can have differing opinions, until the Supreme Court makes a ruling. Differing opinions between the circuits will usually trigger a SC decision.

However, when there are precedents set in multiple circuits, Appeals courts from other circuits use those precedents in their rulings.

    This is why we dont "just comply" when the orders are unlawful. If cops cant articulate the laws they are expected to uphold, citizens are not expected to arbitrarily follow. HARD NO! fight back for your rights

    I was a cop in the 70's. Things were different then. I quit when departments "LOWERED" they're standards for new recruits. Not just once but more. Departments were desperate for new cops so they would hire most anybody after around 1985 or so. Half the cops on the street today were high school gangbangers and bullies. Nowadays they just joined a bigger gang. Today's cops don't care about your rights, your freedoms. They, themselves, are the biggest law breakers in our society simply because they can get away with it. They have no respect for the laws.

    Officer was investigated by internal affairs and found not guilty . The officer was given an award for excellent service and one extra week paid vacation

    Every time a law enforcement officer that's something wrong it shows in this video. The best way to train them not to do it ever again is a pay cut a big pay cut. And see if they don't straighten up.
