    Rules? I live in the middle of nowhere so we do what we want, if frequently firing fully automatic weapons at night drunk hasn't brought the cops then I'm pretty sure the drones safe.

      Isn't it true, that any law that is repugnant to the protections of the God given Rights and Constitutionally protected Rights of the People, the law can be ignored as if it were never written?
      Also, isn't it true that we all have the God given Right to persuit of happiness?
      And isn't it also true, that any agreement (registration) entered into under threat, duress or coercion is null and void on its face?
      It's "illegal" to J-walk, but until or unless you willfully provide evidence that can be used against you in a court of law (we all have the Right not to provide evidence, including name or ID), isn't it true there's nothing a "law" enFORCEment office can do about said J-walk? Unless or until you e harmed person or property, the "authority" has no authority nor jurisdiction, right?
      All that being said, if a "law" says you must comply, which clearly violates your Right to persuit of happiness, is the "law" legit and are you obligated to comply?
      Me thinks NOT.

    Good show! And yes, you MUST register a drone. The law was recently signed and enacted with NEW legislation. All drone operators should watch and pay heed to the flight rules commentary. Appreciate your great work!

    Shows how awful the FAA is. A lot of their rules make sense, but this Part 107 crap - like where if you're a farmer you cant use your own drone to check things on your property - is stupid. Also, if someone requests photos and you do it for free and for fun - why does that matter? The FAA probably just wants money, but that's serious government overreach if you ask me. I'd love to see new legislation that shuts down most of their BS.

      Yeah, I believe a lot has to do with money, plain and simple. People, including farmers, will interpret the laws different ways. In fact, FAA employees from different states can have different interpretations of the mess! That shows you how messed up it all is! But yes, from the way the FAA employee in Little Rock, AR told me, doing anything by request is considered commercial! :(

    Jay, we are brand new to the CZcams platform as creators. We’ve considered purchasing a drone... (or as I learned from this a UAV / UAS) to use for capturing b-roll and this video informed me of a whole slue of issues I was previously ignorant too.       Aaron & Holly I use a Mavic Pro and it seems to be just perfect for me. DJI should be announcing the new Mavic this month, so you might want to wait a few days to get the new one or maybe get the original Mavic Pro cheaper!!!

    I'm here in 2020 and just registered with the FAA in the Hobby style category. I view the registration as protecting the people on the ground. We have to be responsible. To those who think registering as government encroachment, then at least put your phone number on your drone so if you do damage, the victim can contact you. Show respect.
    What if a person has more than a single drone, will the FAA number cover both of the vehicles?

    I've always wanted to ride a motorcycle. Some of my past friends would buy theirs and teach themselves by riding in parking lots. If I ever got one of my own, I was always resolved to spending the two weekends in a class to learn to ride skillfully and safely. The same would apply for flying.
    Well, I now want to fly drones outside after having flown inside my house. I appreciate your simplifying the requirements for hobbyist AND commercial flying. As I grow in knowledge and experience, flying on vacation or some other personal hobbyist endeavor, I'm pretty positive I will be approached for some 'commercial' opportunity, paid or not.

    Good video. I just got a parrot bebop2 and my daughter is excited to play with it. I can believe the hurdles we have to go through just to have fun. I think rules should be enforced based on how high you are going to fly a drone just to make sure it doesn't interfere with air traffic. Very good information, keep it up.

    Thanks, I am registered and I found out that I can't fly in my yard because I am within the boundary of Mississippi National Park. I am waiting for the warmer above 32 degree days to happen before I fly. I expect my 1st flight to happen in March. Getting ready, by studying how to fly and preparing my Mavic Air for its first flight.

    Under a new FAA regulation change, the drone registration number id can no longer be out of sight, such as in a battery compartment. It now has to be visible on the outside of the drone. This was put into effect before the end of the comment period so it may have changes in the future.

    Thank you for a sober and very informative video on this very important subject affecting our growing community of UAV enthusiasts. Being new to UAVs and having just purchased a Phantom 3 Pro, I have a lot to learn in order to be a responsible operator of my P3P. As the VP of our local garden club, I had thought how nice it would be to produce a short video of a quick fly around of a few of our club members' gardens to be shown in the winter at our club meetings. Though I wouldn't be receiving any compensation from this, I do see how this could be considered "monetizing" in the sense that our club (a non-profit organization) is providing a service to dues-paying members thus requiring that I register as a pilot with the FAA, a level of effort I'm not sure I want to undertake. I also respect the fact that we live in new world where there are anything from people with just no common sense whatsoever to groups of people who see the UAV technology as having weapon potential for harming both people and property. Unfortunately, it's at those times when we would hope that our society could entrust our government to protect us with some of our freedom being a casualty. Our world is going to get worse before it gets better. Thanks again for this video, the information provided, and your replies to the comments as everyone here has valuable viewpoints to be considered.

    about giving the airport notice, you also have to call the air traffic control tower too. and any heliports within 5 miles. this includes hospitals. thats what the FAA told me when I called.

    UPDATE. I believe It is no longer required to register your drown with Big Brother if you fly it under part 101 recreational rules. This video was not made in 2018. But check your laws frequently.

      You could always make a 3" race drone, as in 3" props. You can hit 100mph on 3" props and still be way under the 250gram weight limit. You can even have hd cameras and dvr if you want too. Nice little loophole, for now anyways.

      @Jay Malone Yes, Trump did sign that act, however as long as the drone is under .55lbs, it doesn't need to be registered. If it is flown as a hobby, the drone operator doesn't have to get 107 licensed.
      That makes "Tiny Whoop" operators, such as myself, very happy.

      I am not clear on this. Since a Part 107 is in regards to civil sUAS in the NAS, and since only air carriers, models, and Sec 333 exemptions are exempt, how is it possible that a micro drone, which is not a model, can be exempt from Part 107?

      Short answer: Because the FAA and Congress considers all drones (including micro drones) 'Model Aircraft'. I think the confusion lies in what you would think of as a 'model' and what Congress defines as a 'model aircraft'
      Long answer:
      According to the FAA, drones are drones regardless of size. All drones are considered unmanned aircraft system (UAS).
      So the question becomes, "Is a UAS the same as a model aircraft?"
      Congress has defined a 'model aircraft' as a UAS that meets all of the following:
      1) Is capable of sustained flight in the atmosphere
      2) Is flown within visual line-of-sight of the person operating it
      3) Is flown for hobby or recreational purposes
      The FAA has to follow what Congress' definition of a 'model aircraft' is. Since all drones, including micro drones, meet all three criteria, they are 'model aircraft' per Congress (and the FAA).
      According to the FAA, the new Small UAS Rule (part 107) does not apply to UAS flown strictly for fun (hobby or recreational purposes) as long as these unmanned aircraft are flown in accordance with the Special Rule for Model Aircraft (Section 336 of P.L. 112-95).
      Under the Special Rule for Model Aircraft (Public Law 112-95 Section 336), UAS operators must:
      1) Register their UAS with the FAA if the UAS weighs more than 0.55 lbs. (250 grams) and less than 55 lbs. (25 kg).
      2) Fly for hobby or recreational purposes only
      3) Follow a community-based set of safety guidelines
      4) Fly the UAS within visual line-of-sight
      5) Give way to manned aircraft
      6) Provide prior notification to the airport and air traffic control tower, if one is present, when flying within 5 miles of an airport
      7) Fly UAS that weigh no more than 55 lbs. unless certified by a community-based organization
      So micro quads under .55lbs flown for fun are exempt from part 107 because they are considered model aircraft by Congressional definition.

    Thanks for the vid, it's very informative. The only thing that it didn't clear up, is that when you register with the FAA, you are really not registering your drones. You are basically registering yourself and assigned a registration number which you can put on multiple drones.
    One thing I would also like to add to those who are new to registering, is to beware that there are many bogus registration sites masquerading as the official FAA registration site. Make sure you are on the official site.

      Yes, if you are a hobbyist you can register multiple drones. I have to register each one since I fly under Part 107 rules. Kinda crazy that there would be a difference (just my opinion) And yes, you are correct, stick to the FAA site for registering! No need for spending more than $5 registering! I had someone tell me they spent $35 registering...I knew they had registered at a bogus site. :(

    Thanks for posting this, I found it very helpful. Just bought my first drone, and I needed some clarification on what type of registration to acquire and what the regulations were.
    Basically just flying for fun, but I do want to keep things legal and safe. From what I can see, having a drone is not too dissimilar to having a full sized aircraft.

      I did happen to watch your video about the fake drone sites too, but I had intended from the get-go to deal with the FAA directly, as I had done some due dilligence beforehand with the BBB and noticed practically all of the sites/companies had lousy ratings and numerous complaints from people not getting their drones registered after paying up and other scammer tricks.
      I'm happy to say the FAA's site was easy to use, and I got my registration filed and a number assigned in about 5 minutes flat, no muss, no fuss.

    Trying to get an opinion here. If I take my Mavic to Oshkosh next week and fly it during EAA am I going be looking over my shoulder for the feds? I had originally intended to fly at a friend's home (where I'm staying for the weekend) which is located roughly 1 1/2 miles east of the north/south runway. The property consists of 20 rural acres and is perimetered by trees on 3 sides. I only want and intend to fly no more than 75 ft altitude or tree level height. I will call the tower and either seek permission or let them know my intentions. If I go ahead and fly (at no more than 75 ft) will I see the police come down his driveway? I don't want to break the law or cause an unsafe condition for aircraft that will be in the area.....hence the 75 ft altitude limit. But if there's a condition that I'm not aware of that will be a safety concern I really want to know. I just don't know or can't think of a hazard. Anyone? Thanx!!!!

      I would highly recommend downloading the Airmap app and search for the exact address to see what kind of flight restrictions are there. I would guess that during an event like that, that you would not want to be that close to the airport.     I have a question about the 2 sets of rules that I can fly under. Hobbies & Part 107, can I do both just to play it save such as get both certificates/verifications. And my other question is that all I’m doing with
    my drone is basically taking it to the beach and getting a good view on the shores and ocean. I edit videos and post them on my social media for fun. What’s the best advice you can give me Mr. Malone

      Ok, hopefully I can explain this ok.
      You decide what rules you will be flying under each time you fly. Of course, whatever rules you take off under you have to remain under those rules for the duration of your flight. If you ever plan to fly under Part 107 rules, then you need to pass an FAA knowledge exam and obtain your Remote Pilot Certificate. That cost is $150 and is completely separate from registering. czcams.com/video/u4bUkwsXaNg/video.html
      Once you obtain your Remote Pilot Certificate, you can register as Part 107. Until then, you can only register and fly as a hobbyist. If you are registering as Part 107 each aircraft has to be registered ($5 each). But although the aircraft is registered as Part 107, you can fly under hobbyist or part 107 rules.
      As a hobbyist you can fly at night, Part 107 flight requires a waiver to do that.
      As a hobbyist you are required to call an airport if you are within 5 miles, Part 107 it isn't always necessary.
      A hobbyist flight cannot be anything that is commercial or furthers a business, Part 107 can.
      There are other differences, but as you can see, depending on your location and situation, you will have to determine the rules you will fly under!

    Excellent and up-to-date. One question. Does VLOS mean you can clearly see your A/C and have a good sense of exactly how close it is to surrounding obstacles ... or does it mean you can see the airspace in which your A/C is flying including any potential manned aircraft. It seems many UAS pilots use the second interpretation once they fly beyond about 1000 feet.

      Hey Russell, thanks for commenting. I personally try to keep VLOS with the first interpretation. If I go behind a tree or something for a moment, I'm not too worried, but for the most part, yes, I keep an eye on the A/C where I can spot it. NOTE: Most of my flights fall under the Part 107 rules, and I am required to keep VLOS for Part 107 flights. Hobbyist can get around some of that.

    Thank you for this very helpful information. I have been a member of the AMA for 5 years. Drone rules require your flying behavior to be as the AMA states in its safe flying criteria. Due to health I plan on flying my newly acquired drone as a hobbyist only under FAA guidelines. The main difference that I can see is that as a member of the AMA and a member of a local fixed wing flying club you are covered under AMA million dollar accident policies.     I have several UAVs, some are 'toy grade' and do not require registration (of course I am registered as a pilot for my other UAVs). Am I still bound by and flying under Hobbyist rules even if my UAV does not meet the requirements for registration?

      Section 336 (Hobbyist Rules) does NOT apply if your UAV is equal to or less than .55 lbs, because it's not registered (therefore, not regulated) by the FAA

    It appears that making youtube videos is a commercial activity even if you do not monetize them. So no youtube videos for my drone, not worth the trouble for me. Certainly takes the fun out of making drone videos. This video did not touch on the possibility of being within 5 miles of multiple airports like I am. Do I have to call them all? If so maybe it would be quicker to drive the 25 miles needed to get out of the restricted area. B4ufly shows about 9 heliports and 5 airports within 5 miles of me. Thanks for the video.

      I've been filming a friend's wedding and the surrounding areas for myself. Then all guests shared their photos videos and I did same. I used CZcams "unlisted" video as a mean of sharing (instead of emailing/dropboxing/etc). Are You sure it qualifies as a commercial activity?

    Hi, I've recently bought the DJI spark. During the summer I'll visit the US, coming from Europe. The only reason I bought the drone, is to capture some nice shots to share with close friends/family as it would have been an oldschool photobook. Is the 5$ registration attest enough to pass the border? Don't want to lose it before the journey has even begun.. Anyway subbed!

    Unless something had changed, I believe you are not required to get AUTHORIZATION from the ATC if you are flying within 5 miles of the airport IF you are flying as a hobbyist. You are simply required to ”NOTIFY” The ATC. (Air traffic control tower) However on the flip side, if you are flying under part 107, then you are required to get authorization from ATC.

      That Guy 107 correct. The “Autorization” that I mentioned is not really an Autorization. Pretty much just notify them, let them know where you are located. If for some reason something special is going on with the air traffic then they might recommend you to not to fly for a certain time period. But, according to the FAA notifying them is sufficient.       I live next to a airport. So I called them and they said they had no tower.And could not help me. Any suggestion?

      Mitchel, if you are near an airport that is small enough to not have a tower (same as I am) then what I found best was to get the phone number of the airport manager. I called him, when I was flying as a hobbyist. Now that I am flying under Part 107 rules, I am no longer required to call since the airport is in class G airspace.

      This did happen, but because of a bill passed by our President this year, registration is once again required. It might get overturned again, but as of now, registration is necessary.     Thanks for the video. I've had some practice on ScharkSpark SS40. Now I'm considering upgrading slightly to one of the Hubsan series with HD video and brushless motors to fly over some land parcels of mine for good video. I'm not worried about the regulations, it'll be fun to get the RPAC. I'm just curious if you know anything about the Hubsan's and if they will be sufficient for surveying land.

    Great drone information video. So, the MAXIMUM drone flying height is 400 feet. What is the MIMIMUM drone flying height when flying over residential areas, or is there NO MINIMUM drone flying height limit and can a drone be flown at any height below 400 feet, even above residential areas? I read somewhere, can't remember where, that the MINIMUM drone flying height over residentials areas is 100 feet, with the exceptions of the drone lifting off of the ground and landing the drone. FAA regulations may seem excessive to some people, but i would expect that any motorized flying object flying over my head would be under some kind of control by someone, in addition to the drone pilot, just like vehicles on the road. Soon, i expect to see police drones with flashing lights and sirens, flying around chasing and catching drone violators in the sky. That would be cool, hehehe

      That's absolutely true and luckily it is that way. The only thing I try to say due all those enlightening videos about the F.A.A. and quad copter regulations is to 'lighten up' a bit. On the other hand, most of us for instance drive a car. Where are all of those enlightening videos about the regulations for that? I mean, how many people get killed yearly in terrible accidents due to bad driving behavior or alcohol use? On that way, I can make a long list about all ways that we all endanger each other reaching to climate change, world hunger, war, and so on. Am not gonna do that, since we all have our ignorant ways. I choose a happy path. ☮
