The at fault driver's insurance company is asking for all of my pre motor vehicle accident medical records from all of my doctors. Are they allowed to do this?
Unfortunately, the answer is yes. If you bring a personal injury claim arising out of a motor vehicle accident and are claiming injuries, the insurance company of the at-fault driver will be allowed to subpoena and request medical records for you from before the accident from all of your doctors.
The reason being is that the courts allow the at-fault driver and the at-fault driver's insurance company to prove at trial that your injuries may have been caused by something other than the motor vehicle accident. Do not be alarmed. This is routine in motor vehicle accident and personal injury litigation. And you should certainly speak to your own personal injury lawyer regarding any concerns you may have with the at-fault driver and their insurance company going out and trying to retrieve all of your medical records.
