  • The plaintiff claims the father of her child lied to the police, so she got arrested and her child was taken away. She says the father put her child in the defendant’s childcare facility and she’s being denied her parental rights. She also claims the defendant is slandering her, so she’s suing for mental anguish and breach of parental rights. The defendant says the child was enrolled in her daycare by her father and social services, and the plaintiff had no parental rights at the time. She’s countersuing for emotional distress and punitive damages.

      Ill tell you what happened to me when I was a new mom many years ago. I don't get along with my birth mother but I tried to let her be a part of her grandson's life. Well that was a bad idea, she never changed from that pregnant 15-year-old mindset(she had me at 15) and tried to cause harm to my child and me, she's mentally unstable. I told her she would no longer be a part of our lives. Well, I lived in California at the time and she was in Vegas, so she went to las vegas court and made up a story that my child was in danger.
      I had no idea until I got a letter stating she had been granted temporary guardianship of my child. Imagine that! Some incompetent judge didn't bother to see that I never lived in vegas, that I was a resident of California, and that vegas have no jurisdiction over California so she was not allowed to take my child anywhere. She went to my grandparent's home while I was at work and tried to sneak out the door with my son while my grandfather was in his room. I am so grateful to god something had just told my grandfather to get up and see what my son was doing, he said she had got halfway down the block and had a car waiting on her to put my son in there and leave. He stopped her and called me, I then called the police and she brought up these court papers the judge gave her which the police then told her these papers meant nothing because you can not take a child across state lines. the papers regardless of what was written served vegas and not California.
      She looked really stupid in the end thinking she was gonna take my son. I don't know if the mother is right or wrong in this case, but you would never believe how screwed up the system is. I wish looking back I would've went to vegas and filed a complaint against the judge that granted that crap.

    The mother went through the pregnancy. Bonded with the baby for the next 9 months and then they took the baby from her and give to father who never had any thing to do with the lil baby and was practically a stranger. Wow.

      Completely agree and my heart hurts for both the mother and the child HOWEVER the daycare lady is being overly cautious and following the law to the letter. I cannot blame her one bit! She is liable if the wrong person has access to the child or the child goes into someone’s hands that should not have her. She was trying to do the right thing. Maybe an extreme measure but she is protecting the child and herself and I have to think as a mother I would feel some sense of relief that she is so set on protecting my child. I sure as hell wouldn’t sue her!

      You both are so right. I feel so bad for her, but if the roles were reversed, I’d feel good knowing that her daycare manager was taking measures to ensure the rights of both parents or lack there of.

    When I used to work for DCF, I seen some illegal things take place. The daycare owner is lying I believe. This mom is having a hard time explaining what happened.

    I don't think she was slow necessarily; she was trying to be careful, concise and controlled in her responses to the judge. In court - especially in child/custody types of cases - it's better to answer only what is asked and to keep emotion out of your responses. I think she was showing a high level of restraint, and was trying to stay focused on the facts of the case from her point of view.
    I'll grant that, yes, she was robotic. And, yes, her situation is messy and very unfortunate. But I don't think she's slow or has mental issues. Plaintiffs on TPC lose their cool and display major attitude for far less.

      This Judge is the WORST.
      She either, short changes people for what they sue for and are owed, or she talks over people cutting them off and if they have anything relevant for their case to help their case succeed, she invariably says: “No.”…”We’re done here, because I’m about to rule!”…”We’re done here!”
      I’ve seen this scene play out MANY times, in MANY cases.
      I honestly think that she should be reported and later evaluated for her conduct as a Judge. There’s certainly no fairness or state of equilibrium in her courtroom.

    WHAT!!!! Naw I’m on the Plaintiff’s side. She was treated so bad in there. The plaintiff was being so polite and respectful. This was a sensitive matter, the judge did not need to speak to her like that. Completely unnecessary smdh

      Unfortunately the plaintiff wouldn't shut up. And to sue for 10k, like cmon. That raises eyebrows. Also, she just needs to move on. She has her child now and that should be enough. Just get on with it. She's living in the past. Imagine if we continued to attack people who screwed us in the past? We'd be chasing all day and night!

      @@LiveGrowRescue I'm so tired of hearing "move on". Yes, sometimes that is needed but honestly, that means that person in the wrong know they got away with their bad behavior. And how do you move on from losing those precious months. Those early months are very precious and important to the bond of mother and child. It's not something you just get over. She can't get that back. And the people who took that from her should have consequences.
      This is what is lacking in this country empathy, accountability, and consequences.

    I believe she did try to give the daycare provider the documents at the sheriff's office but she wouldn't take them. It also sounds like the father might be a narcissist who is only going back and forth with the mom to have control

      I thought the same thing too. She seemed too involved and didn't want to take the papers. I don't think the plaintiff would go through all of that trouble to get access to her kid and not try to give the lady the papers.

      that's a tactic to see if any lies would slip through. If judge let you finish every sentences that you have been rehearsing in your mind you can plan your answers but when you are thrown off guard with different questions mid-answer that's where you can be confuse in your lie or take a too long time before answering question and that would be suspicious.

    I have my two daughters home with me yet I am in tears after watching this. No mother should ever have to deal with so much trauma after giving birth to her child. This should have been the most Joyous time in her life and instead it's been the most trying. My heart and my prayers go out to her. I can barely even type this because tears are falling all over my phone. If you're a mother, a real mother, this breaks your heart. I pray that the Lord bless and keep her and that she is doing much better now with her child.

      The daycare director should have asked the father for a copy of the custody order or accepted the order from the mother. The daycare director doesn't seem to know dates or facts.

      Yes, I do not understand how the judge didn't see that. Anyway, all of this separation from a child that the father didn't want to be his in the first place can make one lose their marbles. This case truly hurt me. I hope she does get counseling and the right help to make better decisions.

      My sentiments exactly. Judge Marilyn Milian does this often. She asks questions and then she starts to answer them her damn self instead of allowing the people she's asking the questions to to answer her questions thoroughly. How are you a Judge yet you don't know that some questions cannot be given yes and no answers? I understand that Judges listen to numerous different cases all day long and that it gets annoying but if you cannot do your job sufficiently and with empathy, concern and true compassion then step the hell down and let someone who can do so do the job properly.

      They probably edit it down a lot. Each of these cases probably takes over an hour and they edit them down to 20 minutes so there is probably a lot more back and forth that we never hear

      They barely get to tell their side of the story most of the time. She is extremely rude and unprofessional, always cutting people off mid sentence. I would never take my case to her, she has her mind made up long before any facts are shown. All the other reality tv judges at least let people present their case or defense.

    Mom is definitely a lil off. I can only imagine the scene when she was arrested. Probably was going crazy and was warned to calm down and leave but wouldn’t listen. Does anyone else feel like the daycare lady is friends with the dad’s girlfriend? I just feel that I my gut. Like they knew each other prior and that’s why the child was in her care. She went above and beyond for them to turn around and claim to just be a childcare provider. Don’t sound right. Why get in the middle?

    This case is outrageous, this poor mother. My heart aches for her. There is a special kind of bitterness you have to swallow, when the system set up to protect you, is weaponised against you.     Cases like this are the perfect example of why I choose to remain childfree. In my almost 40 years on this earth I have YET to meet a man that I had a desire to breed with. Even the ones in church are either alcoholics, drug addicts, mysoginist, have some kind of mental health issue, are ex convicts, or are straight up narcissists in 3 piece suits.     everyone keeps saying the plaintiff is off- none of that changes the fact that even the judge read the details AS FACTUALLY RECORDED and even she thinks the way the plaintiff was treated is excessive and strange. She honestly seems like she's so persistent because people keep lying on her and she keeps GETTING PUNISHED.
    Grabbed an arm and got this level of punishment (that a law enforcement agent- a judge said was too much), the daycare woman doesn't even sound like she was really trying to hear or be helpful- she admitted she wasn't even receptive when she first heard of the joint custody. All this mess is happening to her and over and over again while she is missing time with her CHILD.

      The judge can’t do anything about what happened to get custody taken away. The daycare lady has rules and regulations she has to follow as a childcare provider. Anybody can call and say “oh yeah I’m this child’s parent and we have joint custody “ and what the daycare is just supposed to believe? She has things she had to check and she could not verify what the mother was saying. If she had just gone along with what the mother was saying she could have found herself in court for another reason. The judge’s ruling was correct. What happened was unfortunate but the daycare lady did not break any laws and does not owe her $10k

    I have very mixed feelings about this case. It felt more like an episode of Dr. Phil, with Judge Milian talking over the plaintiff all the time, while she was trying to presnt her case. I feel that she was pretty much exploited on TV. And yes, I know the participants come to the show voluntarily. But this time (and I think Milian is usually a good judge!) this was not a good decision.

The daycare provider seemed like she was overly involved and like she had some type of relationship with the father. Why was she showing up to the police station when it was time to hand the child off to the other parent? That’s strange. Also, the plaintiff said the daycare worker verbally told her she would get in contact with her social worker and contact her and then turned around and threatened to file harassment charges. The judge was very biased with this case and did not provide the correct ruling in my opinion.

    We had a son who suffered bruises at a daycare and when we confronted the daycare owner, she turned us in for abuse the next day and it took us a threat of lawsuit against child services and six months of harassment to get them off our backs. It was determined later that the daycare owners daughter had been the one who attacked our son!

    1. When she asked for $10,000, I knew she wasn’t winning! Out of all the TV judges, Judge Milian is the one who is going to give you the MINIMUM! Had she asked for maybe $500 or $1000, she might’ve got a pity ruling. But Judge Milian keeps the People’s Court wallet CLOSED! 😂 If you want THAT much money, you better be able to prove your case without a doubt. 2. She suing the wrong person. Sue the baby’s father who falsely filed charges and caused that absurd & completely unreasonable ruling. Sue the state or the Department that was responsible for the unreasonable ruling. However, the daycare lady could argue that she was acting out of an abundance of caution & not face many issues. (Even though I think the Defendant may have had some connection with the father, because she seemed to be helping him). 3. The Plaintiff may have some idiosyncrasies & certainly has a temper, but she’s well-researched & prepared. She’s just going after the wrong people.

      The judge only wants to hear the background of the case and the evidence nothing else matters that’s why she cuts them off this was an unfortunate situation but I agree with Judge M the defendant is not liable for 10k when the plaintiff can’t show evidence of her trying to get the court order to her and her (defendant) denying it had she had that evidence then she could’ve got alil something but it’s hard to make an accurate judgment when all you have is words spoken which is why Judge M went off the evidence she did have the defendant never got the court order so she’s not liable I do think Judge M felt bad for this woman but in civil cases the preponderance of evidence is on the plaintiff you have to show something was done unfair to you… This is gonna sound harsh but as sad as this case is evidence is evidence and that’s all the most judges especially judge M care about

      Because she's not answering. Instead of just giving an answer, she's doing the "Well, what had happened was." Aside from that, none of the questions she's not letting her respond to will make any difference to be honest. Whatever her reason was for not taking her child out of the daycare wasnt anything preventing her from doing it. Like the judge said, she had the legal right to and didn't do it. So her taking all day to explain why she didn't really wouldn't change anything.

    This was hard to watch. When you file a case, you have to wait for paperwork processing, then a court date. From there, you are either gathering your evidence or thinking about what you want to say.
    When the day comes, the least the judge can do is listen to what the people have to say.
    The judge was visibly surprised that the previous officers arrested her, which resulted in the removal of her baby. The mom has been shut down over and over again, and this judge did the same. She can deny her claim while treating her like a person who deserves respect.

    Plaintiff doesn’t seem all there but honestly… I feel that she was really trying all that she could and didn’t know what to do at this point. She had some evidence the judge didn’t even care to look at. Everything Judge Malian told her she should have done, she did. I feel bad for her.

      Because it didn’t matter what she had. By her own testimony, the defendant broke absolutely no laws nor violated any contract. It’s not a lawsuit. And she was NOT trying everything she could or else she would have emailed the fucking document.

    Day care provider was caught in tons of lies I can't even keep track of the amount of lies and judge Marilyn asked the plaintiff multiple questions and when she tried to answer JM cut her off EVERY single time!!!! Grabbing an arm is not at all assault and then JM says stop talking when she knows damned good and we'll every time she was Trying to talk she was never allowed maybe she didn't have a good case but the way this was handled really upset me and makes me lose a ton of respect I've had for her for a very long time. And I do think she was 100 percent entitled to something maybe not 10 grand but this was wrong on her part for sure. She still didn't even listen to any of the evidence she had.... everytime the judge was upset with the plaintiff for not doing something later she'd provide facts and the judge would be like oh ok you did do that .......what happened to asking a question before assuming JM really was disgusting here and she needs to know it and you know if this happened to her it would have been ON!!! And I believe the defendant did know she was in contact with the husband the case workers and admitted she was made aware of joint custody by the dad in OCT such a mess the judge was here.... wish someone would tell her this was absolutely gross.

    If the daycare lady showed up to the exchange, she should automatically assume that there’s shared custody regardless of paperwork. Clearly there’s an arrangement at play if you showed up to a precinct to witness an exchange.

      @@bobbarker9556 that's true, but in a case like my dad, he actually 'rented a shitty apartment' to be able to use a judge he paid off in another area, claiming said shitty apartment was his residence.
      there are ways evil people can be evil despite innate court bias.
      my assumption here is the dad had friends in bad places, like the gf being friends with the daycare worker as well. And of course, the plaintiff couldn't keep her mouth shut so when dad called the cops on the 'arm grabbing' she made it worse because she felt aggrieved.

    Her persistence here shows why she lost custody for almost 2 years, like the judge said you need to know when to shut up and cut your losses. She should've never gone to his house to confront him about not calling. I understand now why some mothers choose to be single mothers and not even ask for child support because they don't want the drama. They are in court again and will probably act foolish until they take the kid from both of them

This tends to happen with one night stands or folks who are not in a committed relationship so hurt jealousy feeling used guilt anger etc resinates. Now mother needs help & the man is not giving their all plus they're not together opps the child is now Collateral. I'm a single mother I don't get help & I got angry due to that but with help (thinking) I choose peace & to never use my child as collateral for I laid down with dude. Fact most women can't handle for we want what we want. I know of women who just picked the kids up & go or the grandmother sneaking the child to see the father smh. This woman here is fighting to expect something that was not there to begin with. One can't make another do nothing they don't want to & true she needs to realize it stop talking listen & rationalize what's important. I had to learn that early my child is 9 now. This is a main result of not knowing who one is sleeping with. Someone gotta be the bigger person.

So here comes mess after the baby. Women are emotional we're born nurturers so we want what's was best for the child.     It's an unfortunate situation. I think any parent, especially mother who wants to be involved in their child's life would be negatively impacted by the circumstances. Her behavior in court may seem a bit "off", but consider what she (and the family) has been through. Some people would lose it if they were kept away from their child for a day, a week, a month, hell especially over a year (not to mention arrested). She may need therapy at this point. I agree with the judge, she should focus her energy on rebuilding and moving forward. The child care provider had to take precautions, because it can be dangerous and she would be held liable if anything happened to the child in her care or anyone else's child. I do wish the mother would have emailed or mailed the court documents to the child care provider. I hope things get better, forgiveness occurs, lessons are learned, and the child is safe and stable.

      At the beginning of my divorce, my exhusband won physical placement and I went from being a stay at home mom and had my son every day to seeing him once a week and every other weekend. I fought like hell and got 50/50 placement and custody but one thing I learned is that if you don’t act responsibly and show that you are 100% together, you won’t get your child back. You have to keep your head in situations like this

      The defendant is not her parent. Just because she got fed a bunch of crock by the dad doesn’t make it right for her to try maneuver things so that the daughter can’t see her own mother. Just because she “feels” some type of way doesn’t give her any right to keep them away for three months. This is going to effect their relationship and bonding for a very long time. The mom isn’t even a abusing her child. She got way too involved for a daycare worker. And the mother was separated from her child by a coward who didn’t want anything to do her even after that child was born, got her arrested for touching his arm, and then recently came with his friend to beat her up, so of course she’d be pissed. Did you even follow the case?

      I’ve noticed that Judge Milian does seem way more angry and aggressive lately. I was wondering if it was just a coincidence that I’ve seen so many episodes in the last week or two where she was mean/rude or if they’ve all been very recent episodes. I was even wondering if she is going through something difficult in her personal life that is affecting her attitude. I really hope that she doesn’t continue to act this way. I choose to watch her specifically because she is NOT like Judge Judy. I’ve seen Judge Milian become angry and loud in the past but it wasn’t that often and it seemed like it was only in the most extreme cases. She usually has a great sense of humor and seems to genuinely care about people. PLEASE BRING BACK THE KIND AND REASONABLE JUDGE MILIAN THAT WE LOVE AND RESPECT!!!❤️

    I’m sorry this Judge bothers me. She asks people to talk and tell her their side but cuts them off when they are trying to explain and then gets mad if they cut her off to correct something that was misunderstood. I don’t like her i am intrigued by the cases but I would recommend people to go to other courts cause this judge is too self involved to completely understand others people’s situation to listen. She angered me during this case she really didn’t care to listen.
