ST. ANTHONY - Prosecutors plan to present “sufficient evidence” that shows Lori Vallow Daybell intended her two children and Tammy Daybell to die and that she participated in the killings of her kids.
That’s according to court documents filed Thursday from Madison County Prosecuting Attorney Rob Wood and Fremont County Prosecuting Attorney Lindsey Blake.
The prosecutors also expressed “serious reservations” about Daybell’s request to meet with her husband Chad, and they argue her alleged actions make her eligible for the death penalty.
Lori and Chad Daybell are charged with multiple counts of first-degree murder and conspiracy to commit murder for the deaths of 7-year-old Joshua “JJ” Vallow and 16-year-old Tylee Ryan - two of Lori’s children - along with Chad’s previous wife, Tammy Daybell.
Prosecutors are seeking the death penalty against the Daybells, but Lori’s attorneys filed a motion this month arguing Blake and Wood have not been specific enough in stating why their client is eligible for death.
Defense attorney Jim Archibald asked District Judge Steven Boyce to declare the death penalty unconstitutional in the case and take it off the table.
In the newly filed objection to Archibald’s motion, prosecutors explained why they believe Daybell qualifies for the death penalty.
“Sufficient evidence existed for the grand jury to find probable cause that the defendant intended for her children and Tammy Daybell to die. Further, there is sufficient evidence for a jury to conclude that the defendant participated in the killing of her own children,” Blake wrote.
Blake calls the facts in the case “egregious and heinous.”
“The evidence the state will introduce at trial, some of which a grand jury has already reviewed, will establish that the defendant intended for her children and her boyfriend’s wife to die, and that she affirmatively acted to make those deaths happen.”
Lori’s attorneys filed a notice of alibi this month, saying her children died in the apartment of her brother, Alex Cox, while she was in her own apartment and that she was in Hawaii when Tammy Daybell died.
In a separate court filing, prosecutors responded to Lori’s request to meet with Chad in person and talk with him on the phone for “strategy sessions” ahead of their trial.
Archibald said he and co-counsel John Thomas will attend the meetings and phone conversations, along with John Prior, Chad’s attorney, and the conversations will not be recorded or used as evidence.
“The state has serious reservations about allowing the co-defendants to have face-to-face, or other communication directly with each other,” Wood wrote. “The state recognizes that the defendants have agreed to not use any evidence or information they may obtain through any discussions or meetings against each other; nevertheless, the state is not willing to make a similar agreement.
“Any communications between each individual defendant and his/her attorney(s) are confidential; however, having the other defendant and/or his/her counsel present would make them potential witnesses of statements made by the other defendant and eliminate any claim to attorney/client privilege,” Wood continues.
While not completely objecting to the idea of the Daybells meeting, Wood asks Boyce to consider objections raised by prosecutors.
Prosecutors acknowledge in another court filing that hair samples recently discovered by the Idaho State Lab may be used to determine if there is sufficient DNA to create a DNA profile.
Based on court documents filed in July, it’s likely the hair came from duct tape inside a body bag used to transport JJ’s remains, but the new filings do not provide specifics.
The hair may be destroyed while the lab is testing for DNA, prosecutors wrote.
“In the event sufficient DNA is available to create more than one profile, the DNA sample will be split between the parties for testing, and each party may have the expert of their choice test their respective portions of the DNA,” prosecutors said. “In the event sufficient DNA is available for only one profile to be created, the parties agree the State Lab shall halt any further testing and the parties will reconvene at that time to determine who should conduct any further testing.”
Legal counsel for both Chad and Lori filed separate motions objecting to having the jury sequestered when the trial begins in the spring.

I know right. I was just thinking that on another case, he killed his wife and all 3 kids and the dog...He went into details about each, and ALL I could think of was those poor babies, seeing their dad murder them! I just can't understand!

Sure, for the "official" approved update there's no better news station/channel than Idaho where most of their murder spree took place, & at least Nate tracked down their despicable selfish behinds on their Hawaii honeymoon! First & foremost though,long before this news hit the mainstream and national or even local news coverage, I stay with my original source for 1st line updates and insight on Reverend Donna Seraphina's channel. She was able to tell us what happened & where the kids were long before law enforcement finally got to looking for these kids. Many skeptics of mediumship and the afterlife turned believer by witnessing the work Donna did in helping get justice for Tylee and JJ (Tammy & Charles too). Too many times it was obvious to those following that LE was listening for help and guidance too, & I know after convictions are secured, we'll hear more about that in the years to come! Donna credits Tylee of course, since it was her soul who sought Donna's help to communicate to the world what her mother did to her. Lori killed her children and in belief (claims) with God's blessings since they were zombies, but really because she was selfish and insane. God ain't having it and made sure they face consequences! I believe the Scots use a term that I feel is superior to the one used in America. We say “Innocent UNTIL proven guilty”, while the Scots say “Innocent UNLESS proven guilty”. Our’s implies that, regardless of the outcome in court, there’s still a lingering cloud hanging over the defendant. The Scots term implies that, after the verdict is pronounced, it’s done. Melanie, the friend who was staying at Lori's house the night JJ disappeared, said after her boyfriend had a bad dream, Melanie went to Lori's room to get him Lori's spiritual help, but the door was locked and nobody answered her knock. If that's true, nobody in that house can affirm Lori being in her apartment for a period of time.
First I must say that finding out that Lori participated in the deaths of her own children and the death of Tami is absolutely disgusting. Here all this time, we assumed her brother had done the dirty deeds and Chad had taken care of Tami. Let’s hope the death penalty gets put back on the table. Nate - I surely would be one who would prefer a nightly recap of what happened during the day with you giving a summary of the court happenings. It simply cuts through all the red tape. I find trying to listen to an audio feed is annoying. So if cameras are not allowed, a nightly recap would be absolutely wonderful. Thanks again for covering this for us!
It’s an allegation and nothing more by the prosecutors. There’s been absolutely no evidence provided only the prosecution saying they believe she did.

My son was murdered 4 years ago in a fight with his friend. His birthday was yesterday and I was a difficult day for me as always. He was born 35 years ago but but only lived 31 years and died. Sorry about your son 😔

Same with my first cousin. She called me at 2:30 a.m. when her son was in the hospital, crying, "his heart stopped!" I jumped in my car, picked her up & drove 70 mi. to the hospital. She was in no shape to drive. All the way there she kept praying and crying. (His heart was going again by the time we got there).

I certainly wouldn't go off to Hawaai to marry my boyfriend, who just murdered his wife. Poor Tylee and JJ had nobody to support them once Charles was murdered. I've always been against the death sentence, but I might think differently in this case.
There's no "poor Tylee". From the videos I've watched Tylee very much participated in Charles' murder. She was old enough to know better. She was 17. Children have been tried for crimes as adults who were much younger than that. Tylee's
mistake was trusting her murdering mother and uncle. Bet she had no idea she was "next". I think the brother/uncle caught on that even he wasn't safe before it was all over.

Sadly, it seems that a few people were involved in and were present during the "deaths" of JJ and Tylee. Timeline shows that Melanie Gibb and David Warwick (both of whom should be CHARGED for conspiracy to commit murder), Alex, Zulema were present to attend the ritual of JJ's death. Yes, I said "ritual". Tylee was also sacrificed, in a slightly different manner, according to Chad's sick interpretation of scripture. In short, both the children were ritually murdered to increase Lori's "spiritual power". All of them took part in the ritual and swore silence. Disgusting, horrible, self centered, self absorbed pieces of garbage...doing such evil in the name of God. Disgusting.

I can’t believe it’s been three years. I’ll never forget the day of the kids were found. I cried, as if they were my own kids. This case just needs to come to an end and Justice for those poor babies.

Same, I truly thought these kids were safe in some LDS members vacation home. I was broken hearted knowing those babies were murdered.
I remember the day so well, it was so unbelievable, felt it in the air, it was so much to grasp. We all felt it, we all cried like they were our own, we cried for the innocent ones in the kids family, we’ll all be there.
I instantly felt sick when I heard and teared up!
It seems the only positive that can come from this is identifying warning signs of cult involvement and whatever else went on in all of this. I too thought they were hidden somewhere. No one wants to think this is possible, but it clearly is, so hoping whatever those warning signs were - they get written down and people read them.

Definitely would watch your nightly recap if they won't allow cameras in the court room. But I hope the judge realizes that there are people all over the country that are interested in this case and have been waiting for Justice for JJ, Tylee, and Tammy, (and hopefully after this, for Charles). Would be helpful to see Lori and Chads expressions, etc. I am in CA and have been following ever since friends in Kaua'i were talking about it, when you were there, and the subsequent arrest of Lori. Then learned all the past history. Been following your updates on CZcams ever since. This case defies normal care of humanity, and normal family love. Thank you Nate, without your hard work and commitment, we’d be in the dark.. and I think you’re well aware of how much the world wants justice for JJ, Tylee, Charles and Tammy. It hits hard and hurts every time the children, and the details are brought up. But, there is a ton of DNA on that duct tape. The defense knows that!!!! I’m just ready to see an ounce of relief on Larry and Kay’s faces. They are so deserving of any kind of peace in their minds, and hearts.

The problem is that the alibi doesn’t matter based on the charges. She’s being charged with conspiracy, not with first degree or second degree murder.
