- In dozens of states around the country, there is a special class of crimes that apply only to people living with HIV. Those who allegedly don't inform sex partners of their HIV status can be charged with "criminal exposure to HIV," arrested and put behind bars. The charge is often the same whether or not any actual HIV transmission took place. In some states a conviction can even land the HIV positive person on a sex offender registry.

Good evening everyone. I am Lashanda Salinas and vice news did this documentary to raise awareness about this in Tennessee and other states. It is my job to speak up for the people that are scared to. I have spoke to law makers and organizations and we are working on changing more of the laws because they are so outdated. Thank you for listening and watching my story. As of July 7th i was able to come off the sex offender registry and i have my life back. Thanks for showing me all the love and support. If someone knowingly gave you something that if not properly managed will kill ypu. Shouldn’t there be consequences to that? I mean there are consequences for punching someone in the face. That won’t 100% kill you or leave with permanent injury.

@@User-54631 Yes, definitely if you were unaware of it. People have been prosecuted for that. Which isn't what happened here...especially assuming guilt and the person was a sexual predator because they were ill.
The idea that she got it in high-school from someone she was dating is extremely tragic. Puberty is way too young to be facing mortality and dealing with a terminal disease.
If a teen can't face adult choices and/or consequences, the teen shouldn't participate in adult activities that can lead to those. The way we are treating teens nowadays makes no sense. We are telling them that since they now have adult bodies, they are free to make adult decisions regarding what they do with them. However, we are also saying that they are too young to be responsible or accountable and that they are too immature to deal with the predictable fallout of the very decisions we say they have a right to make.
@@Ashmo613it scares me honestly because more and more teens are being encouraged to get IUDs and BC pills which DO NOT protect against STIs and STDs. It’s very important to inform teens about the dangers of sex some that go beyond pregnancy. STDs are real and they can have a very negative impact on one’s health, lifestyle etc…
@@Ashmo613 Nobody is telling teens it's ok to make those decisions, JUST that we know it's going to happen regardless & should be treated that way. Why would we continue to pretend the problem does not exist? We have done that in the past & people became pregnant at early ages & died of preventable diseases.

It’s not a terminal illness if you take the medicine you can live a perfectly normal healthy life.
As someone who is living with HIV and has worked in the field for almost 7 years, there is NO reason for people to be charged criminally for having HIV.. Especially if they are taking measures to avoid transmitting HIV to others.. People need to educate themselves. Science is out there. My heart breaks for this beautiful woman.. Our work is not done.

Lashanda's story depicts a beautiful person worthy of love and respect being treated senselessly. It is such an injustice that she spent time incarcerated, let alone the challenges she endured as a child. I am so grateful she received some relief from changes to legislation. The laws criminalizing HIV are unconscionable. The fact that people had to register as sex offenders is horrendous and appalling. While we all need to be responsible for our own safety we also need to take the necessary precautions to protects others. This young lady did all of those things. Lashanda is innocent but it should be illegal to knowingly spread HIV to another person without disclosing that you are HIV positive.
@@CristianMartinez-cr1eo yeah it should. but that law isn’t criminalizing hiv, it’s criminalizing a person. the laws are criminalizing the disease irregardless to the person, and that’s the problem.
Meanwhile actual sex offenders are getting off with just a little bit of community service.

As a woman and blood donor I have been asked, as a screening question, whether I have had sex with men who have had sex with men. How the hell would I know? It was only recently that restrictions changed to avoid mentioning gender. But this woman is living under complete injustice compared to the relatively mild discrimination prospective blood donors face.
I had this question too and because that man was my boyfriend, I knew he had had sex with a male once a long time ago.
I was denied the ability to donate.

I had to ask my HIV+ boyfriend if he ever had sex with men.
He contracted his infection with IV drugs use many years ago.
Nonetheless, if I hadn't asked, it may have never been brought up and answered.

if the answer is yes, then statistically you have a higher chance of positive. the history of hiv is that it spread more through gay, more promiscuous, communities. this is why they still ask. because of statistics.

I'm heartbroken by this story. I'm glad that Tennessee's laws are changing. How can sick people be villainized? Especially this poor woman. Most STD's and STI's are usually given without consent and the cycle continues. Hopefully this woman can regain her self - worth and happiness.

I am so glad that they were able to remove the sex offender requirements (at least in TN, hopefully other states have done, or will do, the same), but the fact that we are still criminalizing people with HIV despite all the advances in treatment, along with the widespread availability of pre and post exposure prophylaxis, etc. is just heartbreaking. I get why lawmakers may have _thought_ it was a good idea back when HIV was still seen as a death sentence, but when the burden of proof has to be placed on the person who is being accused, it’s hard to see how they are supposed to know, much less have the resources, to write up some sort of legally binding contract with any potential partner just in case they are later falsely accused and need to prove their innocence. It’s all just mind boggling, all I can say is that I am glad that Lashanda will no longer have to register and I’m so grateful that I, as a gay recovering opioid addict, was able to get on PrEP, which, God willing, will hopefully prevent me from ever contracting HIV.

That compounds Lashanda's trauma to have got HIV from someone who didn't tell her then to be accused of doing the same thing. I believe her story, she is a beautiful person. I don't think I would have handled her situation as good as she is.
The situation was hard and unbelievable but I have turned that in to advocacy and I speak for other people that are scared to say anything

Maybe I have the law wrong but didnt get put on the registry simply for having HIV but because they thought that she willingly gave it to someone else. Some people actually do that and thats just evil. So now it makes it so that innocent people wont be charged but it also makes it harder for guilty people to be charged. I care more about innocent people being charged than guilty people being free but I do think there is need for a law if people knowingly and maliciously infect others.

There are so many comments about “archaic laws” that were in place to prosecute people knowingly spreading HIV, which SHOULD be a crime. The real issue No one seems to acknowledge is that according to her story, she disclosed she had HIV to her boyfriend, who later brought charges against her, and apparently she lost the case.
This is horrible, these laws are disgusting. God bless this lady, I hope everything works out for her in the end.

I think she is not telling the full truth though, she probably told her boyfriend after they were in a sexual relationship. People just don’t file charges without feeling some injustice was done to them.

That poor woman, what archaic and outdated legislation, there's so many laws that can be (and sadly frequently are) misused, weaponised and even written in predatory ways that either need significant rewrites/amendments backed by social, medical and scientific data or to be outright repealed.

What this tells me is that you have every new sex partner sign a piece of paper saying they were informed of your disease before first sexual contact, so that someone can't pull this crap. That is about as lame as it gets, fingering somebody for something they didn't do. THAT should be a HIGHLY punishable offense, if proven untrue.

My heart absolutely breaks for her and all HIV victims. My uncle contracted it and I was never allowed to meet him before he did die because my mother (a nurse) was terrified of it somehow getting transferred to me.

This woman is so fucking strong. Her story is so upsetting that we treat people with an autoimmune disease this way. Regardless of how she contracted or how others contracted this, we as a society, need to be better at protecting the sick and others in vulnerable situations. The stigma with HIV is still as bad as it was in the 80s and 90s despite all the drugs we've been able to develop.

I just got a subpoena 3 months after his mental bipolar breakdown. When I came home that evening, he showed me the cut, but said nothing about his nefarious reasons for it or how he got it.
Then the gobsmack of being served for domestic battery at work!

A matter of torture and control of another person
- Before she gets excited about "getting her life back", she should check if the changes to the law will be applied retroactively or if she'll get grandfathered into staying on the registry. 🤔
- It's insane that this had NOTHING to do with kids, yet they restrict her life like it did, she can't even go to the gd library. 🙄 The law is so incredibly obtuse and narrow-minded. 😒 Also, making her pay them to have her life ruined is disgusting. The law doesn't care about harm-reduction, it ONLY cares about finding ways to rob people. 😠
- She's all for disclosure laws, not being told is how she was infected in the first place, but they should also be protected from people like her boyfriend who abuse the law to get revenge on them by lying and claiming to not have been told.

Speaking as a journalist with a law degree, I'd say this report is incomplete. It completely leaves out a critical part of the story: How in the hell Lashanda was ever found guilty of this crime in the first place, just based on her ex-boyfriend's accusation. *A defendant is supposed to be presumed innocent until proven guilty,* so *the prosecution should have borne the burden* of proving that she supposedly didn't tell her ex about her HIV-positive status when they first started dating. And proving a negative proposition is inherently difficult. How in the hell did they convince a judge or a jury that you didn't warn him about it when you actually did?!? *SMDH*

This video has struck me really hard. I have been living with HIV since 2020. Her struggles after diagnosis involving the internal stigma is something I too dealt with. What I have not dealt with and didn’t even know about were these ignorant laws still in place across our country. Every year I raise money for the AIDS Lifecycle, but after this video I really want to work towards fighting these remaining laws and abolish this stigma.

I can understand her being under arrest if she infected someone else if she didn't infect someone else she shouldn't be charged with a crime
You SHOULD be charged if you give it to someone, but you should not be registered as a sex offender UNLESS you commit a sex crime. There are plenty of people who are willingly and knowingly exposing others to HIV and the only thing that has stopped them, or given the victims justice, is them being placed in prison. I live in the Philadelphia area where drug addiction has gone rampant and IV drug use is prevalent. HIV is well documented here among people not just addicted but also in the general population, but not all will tell their partners, especially with the improvements made by medical treatment m. Many are non-detectable which means they have less than 20 copies to 0 copies of the virus found in their blood. Being considered undetected means they are are not likely to infect.
