    I wasn''r supposed to be this way. Prior to renting, the "wife" came to me begging to be my next tenant, and I knew her so considering her as a tenant could work. "You have to promise me you'll have the rent by the first of the month. My lender collects my mortgage on the fourth from my bank account. I don't have that kind of money and can't cover that for you." She hugs me and with tears in her eyes says ,"thank you...thank you." I told them thje rent was $1500 a month. This is much lower than any other rental in our county but she was practically family , had small kids and they were building their own business. Is the hair standing up on the back of your neck?To help make it easier for them to move in i cleaning deposit and the security deposit for them doing the fine cleaning after my last tenant moved. They wanted new carpet and paint. So with them cleaning and improving the flooring (to their desire) we struck a deal. When the 1st months rent was due, they grew quiet and said "You said the first month was free. I used that time to clean that filthy house." My mouth dropped open. But for the sake of peace, I let it go and collected rent the next month. But there would be no more paid rent, not on time at least and not in full and phone calls to them asking when I could expect the rent went unanswereed and eventually, they promised to charge me with harrassment. What? Anyway before i loose all of you readers, the months flew by with a little bit of cash here and an unannounced deposit in Pay Pal (who puts a 21 day hold on high dollar deposits.)So we were forced to serve them a 30 day notice and we would follow that with an unlawful Detainer or court order. Family pitched in to help me pay my mortgaqge payment and avoid losing my own home. First couirt hearing? They insisted they paid on time and in full and because of a loop hole in the delivery of the documents and the case was given to the tenants because they were, afterall, good people. Eviction will still take place but Im not sure where I'll be living at that time.

    If they can’t afford rent or have a hard time getting rent why would you charge a late fee ?

      A late fee is generally thought of as additional incentive to pay rent on time. Making late payments with no penalty just encourages late rents.

    This is quite useful to me. My tenant has always been paying rent on 6th or 7th of every month and I did not charge penalty for late payment. Going forward, I must enforce this clause. Thank you for the great video.

    Hi my tenants always paid rent late, then haven’t paid since december i am now evicting them but they requested a jury trial which is aggravating to me because he is a real estate agent who is just trying to delay and play the system and not pay. I’m so stressed out and just hope this nightmare is over i hope the court sees my side is the truth and they don’t pay so they have to go

    I swear whether its your own adult children or a friend you decide to let move in they always take advantage of that opportunity. They dont pay and get lazy giving you excuses and sobb stories. Im not renting to anyone anymore. Im done!

    Property managers and attorneys are a huge waste of money. They usually just cost you more money and are not effective at all!

      If you warn a tenant in any way you are going for an eviction they can avoid proper service to appear in court for their eviction. I give no warnings nor notices. I'm in WV

    I enjoyed the video and learned from it. I am considering renting out my paid-off house, and purchasing another heading into retirement. I still have a HELOC on the one I own. A major concern is what to do if a tenant won't/can't pay their rent. Especially now with all the Wuhan virus eviction moratoriums. Thank you.

    Please this is the 3 time to pay notice to vacate in court twice the judge dismissed,it's a couple from California doing drugs they paid weekly 260 all bills paid with Internet and washer and dryer they were good for 6 months paying late like every 10 days get rent ,they got 6 months already haven't paid nothing

    Social security is the boss when it comes deposits to the banks.. we as seniors have no control over this.

    If they choose the "Quit" option after receiving the pay or quit notice, what are the ramifications to both parties. Does that get reported on the tenant's credit report like an eviction? Have you encountered a tenant who used that option as a way to get out of a lease?

    5 day or quit isn't needed in WV. We can go directly to evict. I never use an attorney! You don't need one.

      Maryland is the same. No grace period required, no notice required. A landlord can file in court the first day the rent is late.

      If what you say is true, do you always do that? Suppose a tenant is always on time, for 15 months, always pays on the first, and on month 16 he is one day late. Do you harrass him or what?

      @@dragonore2009 yes I contact them I had a tenant a week late last month. After a week I file for eviction. Money can be lost quickly if I don't.

    Thank you so much for the video. It helped a lot! My question is, our tenant has been renting our property for two months in Nevada.
    The first rent payment was late, so they paid us by 3 partial payments, plus a 5% late fee.
    The second month they paid a partial $1,000 (after 13 days of due date) out of $2,100. They still owe us $1,100+$105 (5% late fee) and they said they needed more time. As of today, it is 21 days late and no payments received.
    The problem is they paid us though Zelle. How can we not accept partial payment as you stated in your video for the "DO NOT" part? Please advise the next steps in order to go through the eviction process. Do we need a lawyer?

      I have a same situation as you, tenant pay partial rent through Zella but I haven’t receive any payment as of today. I’m in nyc, eviction take about 2 years, I’m very stressful right now

    I have a tenant who pays 1 to 2 weeks late EVERY month..and alway blames it on outside factors..She has several new high end cars, alway dressed like a millon dollars and has a boyfriend CONSTANTLY hanging around. She is dictating when she pays. I feel played....I am bitting my tongue every month WITH ANGER.. so as not to snap and say what i really want to. I am very reserved instead...I really want her to go....FYI I had bypassed the initial credit check and inquiry from her old place because a friend asked me to help her coworker out. NEVER AGAIN.

      When does the lease end? You can just not renew the lease with her and re-list it and find a new tenant. Next time around please make sure to do a thorough tenant screening. It will save you stress and a lot of sleepless nights!

      And are you charging a late fee? Hopefully, you have one outlined in your lease. Sorry you are dealing with this- definitely frustrating.

      @suerichey1669 Yes. I have her pay late fee. Initially she tried many times to skip paying it or part of it. I did, however, inform her Instead of getting the late fee I would prefer her to just pay on time because having to drive by several times to pick up the check when she said she would have it ready ( and not have it or not the correct amount) was not worth the trouble.

      You should make her pay online. Don't drive to get checks. I switched over and it's soooo much better. Late fees will be automatically applied when you set it up that way and record keeping is easier. Look at Stessa or Rentredi. Basic Stessa is free. Aside from that I would send out a notice to let them know how you will operate moving forward and the process you will follow (5 day grace period, 5 day quit or cure and eviction...)and then stick to it. And then if they don't shape up don't renew the lease.

    its a dog eat dog world. no one has compassion no more. Go directly to the court and pay what is overdue, even little by little. the judge decides who stays and goes. Some of these lawyers have a vested interest and in cahoots with one another. take matters in your own hands and hear directly from the court. I am not a lawyer this is just my personal opinion.

    I don't see why you give a 4 day grace period, and then serve a 5-day notice. This is the same as a 9-day grace period to pay, which is not good business. If you immediately serve the 5-day notice, that is basically a 5 day grace period before you file in court.

      Jimmy, I think the initial grace period is kind of a good thing. Suppose it is January 1, New Years Day. Banks aren't open, some of the stores that partner with property management companies so tenants can pay that way aren't open. The property management place isn't open (New Years), so I can't call and pay. The property management company doesn't have a web portal for me to logon so I can pay online (that has happened to me before). What am I suppose to do Jimmy as a tenant? Receive your dick move five day notice? A grace period is there for situations I mentioned. They are legitimate situations, for honest tenants like me, who would otherwise pay on the first but am physically unable too on a date like January 1, New Years. That 3 or 4 day grace period is nice so I don't get ridiculous late fees for crap I can't control.

      @@dragonore2009 A five day notice is the same as a 5 day "grace period". If rent isn't paid by the 5th day, the landlord "can" file for eviction.

    So you get rid of one renter that was paying, just a couple days short...
    How much time and money not earned happens before you get a new renter?
