  • The plaintiff says her upstairs neighbor's toilet keeps leaking, causing damage to her ceiling. The plaintiff had to hire a plumber, so she's suing her neighbor, the defendant, for half the cost to pay the plumber. The defendant claims she already spent thousands of dollars fixing the problem, so she denies having to pay for the plumber the plaintiff used.

    Y’all are so upset with this lady because the person in the wrong was nice and sweet. *The point is* shouldn’t have to shell out $2 much less $200. The other lady had to pay because it was *her fault*. Simple. If she chooses to go above and beyond to do the whole ceiling out of precaution and not have to come back, then that’s her prerogative. Just because it was an accident, that doesn’t relieve her from the responsibility and the cost 👏🏽 a lot of you lack accountability

    It’s easy to armchair this one. Watching this it’s easy to say “that’s petty I wouldn’t have sued.” But it’s one of those things where if you have to go through the stress of all of this, you want your money. I’d probably do just what the plaintiff did.

    It is all fine until it's you, then she'd be paying for that leak and damages. The ones who say they wouldn't sue a neighbor is lying through their teeth. The people who are complaining in the comments will never get that it doesn't matter if they agree or not. You may think that it's petty, but the plaintiff was well within her legal rights. Just because you feel entitled to be excused from being held completely accountable, does not mean everyone has to sacrifice their resources and eat/pay for your mistakes.

      It’s annoying but it’s to keep the trial going on in a timely fashion for TV…she has already reviewed all the documents so she knows which direction she wants to take the conversation….even in her conversations with her husband you can see the media training kicking in to keep responses succinct and moving.

    No bad people here. The plaintiff was legally in the right to be reimbursed for the inspection. Had the defendant thoroughly checked her bathroom no inspection would've been required. Chock it up as a lazy tax. If the 200 didn't put me in a financial bind I wouldn't have sued. The defendant handled it as soon as she could and didn't skimp on having the repair done the best way possible. Sometimes you have to give a good person something for being good even if it's just the grace to not ask for more.

    I wouldn't hire *anybody* to go into my ceiling if I had an upstairs neighbor. You go upstairs and have them hire a plumber. Going upstairs to the *floor* is better in so many ways! (No plumber wants to open a ceiling with a leak above him-- and it might very well cause *more* water to come into your place. That's nuts!)

    Anyone complaining about suing for 200 dollars... After all the aggravation, while should the Plaintiff be out of pocket for a leak that was from the Defendant's apartment? The Defendant took care of most of it, but it was still her duty to pay for ALL the bills accrued(due to HER leak).

    Most condos have bylaws. Unless you do something negligent or cause the issue usually you don’t have to pay for the neighbors damage. Once she was aware of the problem she fixed it and the damage. Depending on the bylaws she is not legally responsible to reimburse or fix plaintiffs damage. Unless she was aware and ignored or did something that caused the leak. It sounds crappy but this is one of the risks of condos.

      @@zakiyahyman1496 I agree this way makes more sense. I used to work for an insurance company and in IL most condos had these rules. I felt bad cause people didn’t want to make a claim or be responsible for the deductible but they had to unless they could prove the neighbor was negligent.

    The plaintiff has no shame. I can't stand people like that. "I want what's fair". The lady replaced the whole ceiling instead of doing a patch job. A patch job and the $200 would've likely been cheaper. Absolutely ridiculous person.

    If Milian would allow the litigants to tell their stories by giving testimony without interrupting then things would go much smoother! But her constant barging in is disruptive to the entire procedure! She did this with the plaintiff right from the very beginning but luckily for her she was rendered a verdict in her favor!
