  • Right guys i have fully thought about what occurred on the day of this incident and truth be told i wish i handled it in a different way but what's done is done and we can only learn from our mistakes certain things what was said and done in this video was a test and West Yorkshire Police Heckmondwike and the 999 Dispatcher FAILDED massively also sharing this for awareness so people are fully aware of the CORRUPTION what is going on at Heckmondwike and within the West Yorkshire Police Force!

      The signage where he enters the area is misleading. By itself it seems like it is for the interior of the building which in combination with the note that it is not accesible makes the reader assume it is only for the inside. A sign like the one by the road would be much more approriate since the no public access area is behind it.

      We all have not just a right but a duty to monitir our governments behaviour at all levels - we should NOT be paying for thugs like this bunch. Just imagine any one of them interacting with our children, elderly or other vulnerable group. Besides which I doubt their signage is lawful since we pay for the building and have aright to monitor unrestricted areas 0 no barrier implys rightof access and it is a police station not MI5!

Saying they just saw him leave a pub he just passed. When in fact he had just left a hospice where his father was dying. Which was about a quarter of a mile away.

      But the simple thing to do is to push them away! If they then step forward THEN you do the do.
      Yes you get arrested.
      So just counter sue.
      Their actions are not in the public interest so a plea is entered to drop your charge of them battering you and they will drop their BOGUS charges on you.
      BUT, you did manage to plant a few blows on them first.
      ...and you STILL know their addresses...everyone involved.

    Auditor is totally in the wrong with this one!!!! He filmed the parking lot which clearly shows No Public Access, decides to try to find away around that by walking up a staircase with a sign clearly stating No Trespassing!!! been warned arrest should take place… I like watching some Auditor’s, but this one deserves to bet arrested.

    a. Don't..... "immediately fall over and shout that you've just been assaulted".
    b. Don't.... "claim to have got an unidentifiable back, neck, or head, (etc) injury from the assault".
    c. Don't.... "seek medical assistance and document the unidentifiable injury".
    d. Don't.... "record everything or request body worn or security camera footage".
    e. Don't.... "get a good personal injury lawyer".
    f. Don't.... "sue the offender for loss of earnings, medical costs, injuries, physiotherapy, post traumatic stress and damages".
    g. Don't.... "report the offender to their company, superiors, investigators, authorities or the press and seek punishment for the offender!

    The sign said no public access. You shouldn't be there. It's like going into someone's driveway and getting upset when they ask you to leave.
    If you're unsure you can ask, but as soon as it's apparent that it's private land, you must go.
    Imagine someone coming in you garden ect.

    The PCSOs and PCs deliberately escalated the situation by intimidating AY and using unwanted and unnecessary physical touching of his person, in order to get him intentionally angry and upset, so they would then have reasonable grounds to suspect him of an offence and make an arrest. Although AY used profanity and insultive and abusive words and name calling at the 2 PCSOs and 1 PC in particular, nearly all of what the auditor said was protected free speech under legislation and common law, which has been upheld many times in the Crown and High Courts. If AY was arrested for a Section 5 Public Order on the "supposed" police private land/carpark, the chances of him being found guilty in court of this offence would of been slim as a Section 5 is public only related act, and AY was standing on private land at the time the incident took place. I've watched thousands of auditing videos spanning over several years now, and I have seen how poorly and cruelly the police have treated the public, but then I've read comments of people on CZcams and the like saying this auditor and this person shouldn't of insulted the police officer in that way, when half the time the police do exactly the same to us. So as for as how AY spoke to the PCs and PCSOs, he had every right under free speech to voice his anger, opinions, thoughts, displeasure, grievances and distain at them.

      @@auditnerd8767 It was a lawful removal from the premises but it wasn't handled in the best and most appropriate way, the PCSOs and PCs in my opinion failed to P.A.W correctly. If that police carpark was indeed private land then AY could of been arrested for a Section 5 but they would of had to change that to a Section 50 or something similar because Section 5 is a public only related offence, a Section 5 wouldn't of stood up in court, but the police would of had better luck getting AY convicted on a Section 50, cos they would of argued that AY was using abusive and insultive language. The Police had every opportunity to arrest AY, cos like you said he did return back onto the premises, but he was on the phone to 101/the station to report a crime and some members of the public had congregated right across the street, which left him feeling uneasy, unsafe and he didn't want them overhearing him give out his personal information, so these were his reasons he went back onto the premises. I'll give the PCs their due, they could of arrested AY, but rather chose officer discretion at the time, or there were other reasons at play that they just decided not to escalate matters any further than had already occurred.

      @@auditnerd8767 Yes of course I know Section 33 CJA 1972, this is another public related legislative law. I agree with you, Section 33 has been abused by some auditors, but I think most of it is down to them not fully understanding it and applying it to areas of land and property where Section 33 either doesn't apply or cannot be applied to. I cannot be too hard on any auditor who accidentally misinterprets sections of legislation, and from time to time a person is going to get it wrong. That is why it is so important to; rather than ridicule an auditor for making a mistake, instead to support, correct and teach them in a constructive and positive way. The reason why auditors came on the scene in the first place was because people got fed up of the way the police had failed them and violated their civil rights. It's pretty obvious to me that the police are not gonna change their ways and make the effort to right their wrongs, so it's up to us to do that job for them.

      We all go through life, after a while you expect you have a handle on things, but when your world is turned around, you might be excused for being put off guard, you are suddenly in a different world in which plastic cops are pushing you around, and all your rules are thrown out, you may not be able to get yourself together to push back, like getting caught off guard, playing sport you muck up the kick or catch whatever, he was definitely in a place that was foreign to him being pushed by plastic coppers.

      3 auditors were charged and prosecuted for aggravated trespass on a police station, mysteriously the videos were taken down after the convictions...

The "auditor" refused therefore they had the right to use reasonable force to remove him from private property, just as anyone has the right to remove trespassers from their. Had the auditor resisted or fought them it would have gone from a civil matter namely tresspass to a criminal one namely aggravated trespass.       @@auditnerd8767 And if the police arrested him for swearing then they'd just prove they are snowflakes or just retaliating because they can't do anything else. I've personally been with people who swore at police with way coarser language and seen it in many videos (no not in auditing ones) where the police just let it slide. The law about swearing is only used by police as a last resort or just to add on the charges once someone has been arrested. If you say it's because the others used discretion to not doing anything about the swearing, then I say that discretion is used when it's not in the public interest to continue with arrest etc. Public interest meaning the cost, the time, the effort involved just for the swearing is not worth it. Finally, we are not in Victorian England anymore. Swearing is on TV, in films, your local pub, and kids are the ones that are more likely to swear than anyone else and have done so since I was a kid over 50 years go.

However they totally took the bait, missed any opportunity for deescalation (as they are trained to), allowed their egos to control their actions, and didn’t behave professionally. That’s all true, surely? Every instance is an opportunity for learning, and I hope they do learn not t get triggered so easily… then audits would stop. When they behave like this, it only attracts more auditors.

      @@budgetnuclearweapons7858 I actually agree with many of your points. I don’t believe auditors should cross the threshold of private property, unless there is implied public access. Auditors will always take it to the threshold of legality, which can often pass the point of being passive.
      Auditors come in all shapes and sized and have varying motivations, indeed - I don’t think this example was a perfect audit at all. I far prefer the passive auditors that allow any aggression/escalation to come from the ‘auditee’. Those auditors that are in it for the ‘right’ reasons seem to shine out in my view, and I actually love to see a ‘pass’.
      I still stand by my points about the reaction in this example though… if they had their chance again I suspect it may have progressed differently. 👍

      @@budgetnuclearweapons7858 incorrect, reasonable force can only be used once the trespass escalates to aggravated trespass, they touched him before aggravated trespass was established, touch is battery which is assault, which has a jail time sentence of up to 7 years. Audits like this highlight police abuse because they expose police abuse you can try to invert that as much as you want but a fact is a fact no matter how hard you try to reframe it!

    As controversial as my opinion may be, the PCSO's can use reasonable, proportionate and justifiable force to remove anybody off private property, but they should use procedures they should have been shown when (if) they got trained properly! But wow, 4:12 first interaction with PCSO with what appears to be high vis attitude...! What started out as an order quickly turned in to unreasonable actions which then unreasonably came to a fast physical contact without any patience or dynamic risk assessment, nor professional standards as expected! The PCSO should first have engaged with less of an attitude because the camera does not dictate the actions and feelings of a camera operator just because they have a camera in their hand. This was a civil matter from the start but I never expected it to be handled the way they did. I know that their handlers will be having words with them about their actions! These are my only thoughts I am prepared to say... shocking unreasonable actions from PCSO's... When PC's turn up, they could have had a little bit more empathy and less contempt... I guess this is the standard of policing from this police station as highlighted by PCSO's and PC's... I think many people will agree that they know that Auditing Yorkshire could have been approached in the first instance with better standards of professionalism and much much less contempt despite how people view auditors. The alarm and distress should have been taken seriously but instead, the police officers acted the opposite way to what they should have done, they should have acted impartially and took the report of alarm and distress and then instantly passed it to another police officer from the station to deal with it who was not part of the allegations being made. Thanks for sharing your encounter, they should take your call seriously and investigate this properly but my guess is they wont!

    Imagine been at your work place and someone coming and taking videos of your personal car and reg plate to put on the Internet , as if you wouldn't get annoyed. Its madness that just because you work for the police you're meant to accept been made a fool of and have no privacy. I work in health care so someone videos my car and puts a camera in my face calls me a mug that's acceptable hmm don't think so! Not one of these people commeting praising this "auditor" or "independant journalist" as he calls himself can say they would be ok with it oh and guess who they'd probably call..... the people your all laughing at calling idiots and you wonder why crime is so high because no-one wants to do this job because of the lack of respect and "auditors" / "independant journalist " putting you on the Internet making you a target.

    13:45 The amount of force used was not reasonable for the situation at hand. AY is only standing there talking on the phone and the constable grabbed him and forced him off the car park. It's not a secure car park even though it's technically an area for authorised personnel only is has no barriers or gates. AY was doing anything that required an immediate removal from the area. They could have stayed where they were and just monitored, and at best approached AY to ensure that he didn't go any further. But going over the top with force for an open patch of land which is just the cops being driven by their egos.

      Wasn't bothered? Did you miss the angry looks from peanut head? He would have done worse if no cameras for sure. Wasn't the best way to audit, but they were defo bothered by him, or the quote incident wouldn't have happened. They pushed him about before any swearing took place

      @@theangryscotsman5174 He should of remained calm while being pushed about. Would of highlighted the police in a worse light in the event of a complaint. He chose to launched into a tirade of verbal insults which made him look stupid in my opinion. Yes obviously not easy to remain calm and as I've said I can't stand the police either but on this occasion I think he deserved what he got.
