Press Freedom on Trial: Julian Assange’s Lawyer on Extradition Case & Criminalizing Journalism

    At a critical hearing this week in London, lawyers for imprisoned WikiLeaks founder Julian Assange asked the British High Court of Justice to grant him a new appeal in what is likely his last chance to avoid extradition to the United States, where he faces a 175-year prison sentence for publishing classified documents that exposed U.S. war crimes in Iraq and Afghanistan. Assange’s lawyer, Jennifer Robinson, says the judges were receptive to their arguments that Assange could face the death penalty in the U.S. and that an extradition would set a dangerous precedent for press freedom. “If Julian is extradited and goes on trial under the Espionage Act, this is a case which is going to set precedent which criminalizes journalistic activity and will be used against the rest of the media.” A ruling in the case is not expected until next month at the earliest.

      I was put in a maximum security jail back in the early 90’s for only 1 felony charge of Marijuana for selling it and no other felonies, only for a plant. This country is worse than Sadam Hussein.

      They should call a jury. Let a common jury finally sit in judgement on this case and on the previous rulings of government magistrates. Let the people in a democracy decide important law. For all we know magistrates were briefed on all their findings by government. How do we know that ridiculous question of execution when a sentence of 175 years is bandied about isn't a way out of the extradition and a jury trial in the US? Because juries are notorious for making just rulings. The DOJ have no case whatsoever, and are probably terrified of the case going before a jury they cannot pick, who they cannot compromise and will likely rule according to the evidence? If that happened it would put press freedom to publish truth as a precedent freeing all journalists around the world to publish truth unfettered.
      And for that reason, these two magistrates must call a jury to hear the case and judge it according to commonwealth law. Otherwise, Julian could be free but journalistic excellence still be under the threat of that bullet on the table that is exemplified by Julian Assange and his abuse. Set a precedent that punishing truth in journalism is unacceptable. Otherwise, the iron grip of the anti-press laws are still intact and Assange is slandered as guilty as sin but saved by England not approving his claimed to be just punishment. See how that works? The mock court needs to be in the stocks for the harm it has done to this world.

      What I don't understand is that no-one knows the names of the people in the helicopter who actually murdered the people on the ground or why they done it. They have never been prosecuted that I am aware of. Interestingly, I don't think they have been jailed. Surely this is the crime.

      from what I've read and seen they thought the journalist were carrying guns (they were actually just the big cameras news crews carry and they were in an area known to hide terrorist cells) they view the ground through an IR camera which makes it harder to see not excusing their actions but providing some context.@@heidithesausage

      Right , the Australian government is just a puppet of US imperialism and has been since the end of WW2 , but this case might wake people up and there is a drive to a more independent Australia.
      But I can not let the British “people” off so easy, when we see TV coverage of Julian Assange being dragged out of the Ecudorian embassy it was British police doing the dirty work of the USA, the staff of the prison he is in and the courts he is tried in are all run by “ BRITISH people”. I know they would all say “you can’t blame me , I was just doing my job” .
      But this was the excuse used by Hitlers nazis at the Nuremberg trials and the disgraceful way the British police behaved was reminiscent of the Police in Hitlers Germany as they dragged Jews from their homes to be sent to ghettos .

      Right , Australia is a puppet of the US , as is The UK since WW2 .You say most British people support Julian Assange , that’s good but it’s not enough , if they value freedom of speech they need to do more, now.
      What is disappointing about the British people is how they cooperated in the persecution and torture of Assange , I refer to the British police who dragged him out of the embassy , the staff at the prison where he is held illegally, the staff at the courts where he is tried , all these people are British.

      Of which Assange cares NOTHING about. He knowingly and indiscriminately published the names of individuals who acted as sources of information to the US, putting their lives at risk. Proper journalists do not try to recruit hackers for his portal. He also released unreacted personal medical info of US civilians.
      He edited a gunship sight video, to make it look like the gunship never took fire, and killed unarmed people. A FOIA request showing the presence of weapons on the scene, including AK-47 rifles and an RPG 7 grenade launcher, as well as the gunship taking fire, are public record via Reuters. The military released the full video, showing Assange lied and edited it. Every engagement was authorized by the military, before the gunship opened fire. Assange's released footage EDITED OUT over 20 minutes of of video, which was not not included on the leaked tape.

      Politifact stated: "When Assange points out in the context of justifying the title 'Collateral Murder' that the word 'RPG' was not used until after permission to engage was given, he leaves the impression that the soldiers were given the okay to open fire on a group of unarmed men, or men believed to be unarmed. But the video and accompanying audio make clear that the soldiers in the helicopter said they spotted 'weapons' among those in the group-later identified by an internal army investigator as an AK-47 and an RPG.

      Agreed. The past governments in Australia were neo-con governments and heavily supported the Murdoch infestation of Australian news media so little to no public information regarding this case made it into the public arena. Julian has had an active support group in Australia for the entire time of both incarcerations, and this has brought it to the attention of politicians of principle, and the general public.

    I hope the "high court" judges realize that our collective "humanity", decency, and freedom as a "civil" society is on trial here - not merely Julian Assange's right to free or protected political speech. There's not very much that separates modern western society from fascist dictatorships like Russia, China, and North Korea these days. If free speech in the press or "unfavorable" political speech is made a crime, then there is absolutely nothing that separates us from the fascists.
