  • When a law student talks about the landmark judgments in India the very first thing that comes to his mind is the famous case of Kesavananda Bharti v. State of Kerala. Kesavananda Bharati case (1973) is also known as the Basic Structure Doctrine Case. It is also known as a 'Case that saved India`s. Democracy'.
    It is a significant and the most renowned judgment in the history of our country and of our Indian Constitution - delivered on 24th April 1963 and laid down the Basic Structure Doctrine.

      सावधान देशवासियों -
      1. इस सरकार ने कानून बदल कर मुख्य चुनाव आयुक्त की नियुक्ति की प्रक्रिया पर कब्जा कर लिया है | अब भारत का मुख्य चुनाव आयुक्त इनके मन का व्यक्ति बनता है | अर्थात अब भारत की चुनावी प्रक्रिया को निष्पक्ष नहीं माना जा सकता | और तो और, इन्होने नए प्रकार का EVM ला दिया है जिस पर सभी को शंका है | हालांकि EVM वाला मामला सर्वोच्च न्यायालय में चल रहा है, परन्तु समस्या और भी बड़ी है | नीचे पढ़िए |
      2. इस सरकार ने NJAC जैसा कानून लाकर न्यायधीशों की नियुक्ति की प्रक्रिया पर भी कब्जा करने का प्रयास किया था | लेकिन सर्वोच्च न्यायालय ने इस कानून को सख्ती से रद्द कर दिया, क्योंकि हमारे संविधान ने सर्वोच्च न्यायालय को यह शक्ति दी है | परन्तु यदि हम इस सरकार को सिर पर चढ़ा कर रखेंगे तो ये एक दिन न्यायधीशों की नियुक्ति की प्रक्रिया पर भी कब्जा करने में सफल हो जाएंगे | तब सरकार कोई भी EVM ला देगी, किसी को भी न्यायधीश बना देगी, कोई रोक नहीं पाएगा |
      भले ही आप को इस सरकार के काम अच्छे लगते हों और आप इन्हें अपने सिर पर बैठाना चाहें | पर अगर ये अपने इरादे में सफल हो गए तो कल आप इन्हे चुन तो पाएंगे, पर हटा नहीं पाएंगे | और तो और, आप की आने वाली पीढ़ी भी इन्हे नहीं हटा पाएगी, जैसा कि चीन जैसे देशों में होता है | आप कैसे मुँह दिखाएंगे अपने बच्चों को ?
      श्री कृष्ण ने कहा है कि इस संसार में हमें ईश्वर के अलावा किसी और से आसक्ति (लगाव) नहीं रखना होता, तो फिर एक पार्टी क्या चीज है | लोकतंत्र ने आपको पार्टी चुनने और हटाने दोनों की शक्ति दी है | अपनी एक शक्ति को खो कर स्वयं को कमजोर न करें | इस बार अपनी शक्तियों को बचाए रखने के लिए मतदान करें, लोकतंत्र के लिए मतदान करें |

    I'm not sure why this video got recommended to me, but as a brazilian law student I really enjoyed it. Our Constitution follows the same principle but is more explicit on the matter of what can't be amended. Also, it is from 1988 so maybe cases like this one might have influenced our constitutional assembly. Really interesting

    Fun fact: Kesavananda Bharati was not even want to file the case it was Nanabhoy Palkhivala who convinced him otherwise.
