  • On Wednesday, a higher court judge threw out DC Magistrate Judge Lloyd Nolan's decision and sent 18-year-old Amonte Moody back to jail to await his trial.

The alcohol age limit is a legal fact, but it doesn't mean we believe a person is magically able to handle their liquor when they turn 21 (or 18). It means we had to draw the line somewhere, and it just landed on 21. Also, it's a fact that a person more or less is who they are ever going to be as a moral being by around age 10. After that, if you're easily moved to harm or even kill others, it's not a trait that is going away. And that's what society needs to be protected from. Really, though, when we see folks like this it's a fair heuristic to assume that the kid has emotional problems and probably missed an early childhood development threshold or two. If you don't develop when you should, again, you likely never will. The point is that all of the odds are on this kid ending up in prison or an early grave, and also that he makes at least one child out of wedlock before that happens, so he can spread his dysfunction.

      Crimes that end with the word "Murder" are very hard to prove. You essentially have to get the suspect to tell you that they wanted to kill them, otherwise you can't prove premeditation, an most of the time they will "plead the 5th". Unless you have concrete proof like death threats in their Journals etc. Assault with a deadly weapon is easier to prove but is just as serious as that.

      you do know the purpose of pretrial incarceration isn't to punish a person who hasn't been proven guilty, it's to ensure the defendant returns to court, right?
      and that if a defendant is not likely to flee, and will show up for trial, society has no right to imprison them prior to proof of their guilt, right?
      or do you just want to string everyone up immediately, regardless of the 8th amendment's guarantees?

Research shows that people drive drunk 80 times for each time they are caught. The same applies to virtually all crimes. If you truly get caught the first time you step out of line, then you are an even bigger loser than the average criminal.
