@@dontnonowuno9953 Yes. Civilly liable in your example, not necessarily criminally liable unless other facts show recklessness or other bad acts on the part of the owner. Baldwin may be criminally liable here because a reasonable person should treat the gun as if it were loaded, and should know never to point a gun at anything they don’t want to destroy. That can be viewed as reckless. His failure to act with reasonable care resulted in the death of another. So there could be grounds for criminal liability from the act itself. But to have him criminally liable as the ED, other facts about safety protocols on set would be needed and, frankly, are probably there since this happened. His company’s civil liability is not much in question, although whether it might be paid by insurance could be.
      Edit: Sorry, recklessness, not negligence.
Recklessness is the one that creates criminality; you knew there was a danger but you did it anyway. Negligence is more accidental and typically not criminal (except Kim Potter, alas)

Remember the union crew all quit days before because they were not following ESTABLISHED INDUSTRY SAFETY PROCEDURES. Anyone familiar with the film industry and unions know this was a giant red flag. LLC protections have limits and I guarantee Baldwin is well beyond them. This was gross negligence on the part of everyone onset who was above-the-line (look it up). He may skate on Criminal charges over this but he will be sued, and he will lose. There had been other incident's involving Gun safety on this set and no one seemed to care enough to either stop production or find another more qualified armorer.

Only people who have no idea how gun handling works could possibly even think anything else. This is quite literally the first thing you are taught about guns. They won't even let you touch a gun before they have explained this and a few other things to you.
If I don't have a licence to operate heavy machinery and I run your car over with a road grader with you inside, that is my fault. Period. It is not the fault of the operator if he left it unlocked. It is not your fault for not getting out of the way. It is not the fault of whoever invented the internal combustion engine. It is my fault alone.
The amount of excuses being made for Baldwin is absolutely sickening. If I had done exactly the same thing he did, I would have been arrested immediately and so would you. This is a really good video, in the time allotted, to explain what "probably" happened. Single action pistols are one of the safest to teach new people how to shoot. The hammer is as shown here on ALL single action pistols. I have owned and shot these for over 40 years and have taught many people how to shoot with one(.22lr single six Ruger).
I took my Dad out last week. He hasn't been able to go shooting for 15 years but has had knowledge and use with these pistols. He taught me to shoot one. When we were out, he did exactly what was described here as to holding the trigger down and cocking the hammer. He's 84. I had him sitting at a bench and pointing the pistol down range when it happened. This is a likely scenario and it's the first thing I thought of when I heard of the incident before I went out with my Dad.
I don't know how you don't feel at guilt, in any way, for what happened. You didn't do this on purpose. but just the fact that it happened would cause me great remorse and to question why I didn't check the gun when it was put in my hand like I've been taught. Not exactly true. At Boot camp (for example) we were treated like infants with guns. They watched over us, made sure our weapons were unloaded, and NEVER left it to us to do on our own. These weapon safety measures were also taken while on regular active duty.
Range Control personnel are held personally responsible if there is an accident/shooting.
This is the case because it was to be expected that accidents can happen when weapons are handled by no professionals.
Because actors are not weapons experts, there are people whose jobs it is to make sure an armature is not handed a loaded weapon. This is their job. it's what they are paid for. and the fault lies mostly on them.
Frankly, the industry [movie] itself is also at fault. ALL people who handle weapons on a movie set should be required to take a weapons safety class beforehand.

They hired her as both prop master and armorer to cut costs. There was one redundant safety measure taken out.
If she herself didn't know the difference from a live round with active primer and a dummy round with a spent primer and no powder, an experienced prop master would have seen the round in the chamber He/ she would have questioned why there was a dummy round in chamber instead of a blank. This in turn would have had the live round exposed before harm was done.
Regardless the live round had no business being on set. The expected dummy round had no business in the chamber as the scene called for a shoot-out not something a dummy round would be used for. The only scene you would really need a dummy round in the chamber would be to film a stair down into a barrel. Mainly another example of pinching pennies and loosing dollars and unfortunately life as well. My heart goes out to the victim's family and friends and the cast crew on the set. 🙏

I have taught enough basic firearm safety classes to know that an inexperienced person will always pick up a gun with their finger on the trigger.
Baldwin my have picked up the gun with his finger on the trigger, pulled the hammer back, allowed the hammer to fall forward discharging the firearm. He inadvertently "fanned" the revolver.
This supports Baldwin's explanation but in no way relieves him or anyone else on the set from failing to exercise basic firearm safety.
