    A carjacking ends in murder, and the defendant gets a plea deal to avoid all prison time. This is outrageous. I don't care if he is "rehabilitated." His victim will not have that option.

      Wow, where's your sympathy for the poor criminal though? His part in the crime was so small! All he did was provide all the guns that were used to commit the murder, knowing they would be used to commit murder, and he only fired a few of the bullets himself. That's all! Think of how sad he'll be if he has to go to jail 😢
      You would think that's obvious sarcasm, but the district attorney actually said it with a straight face. Holy shit.

      Thank you for saving me a post. I agree. First thoughts to occur to me after hearing that. It used to be that an accomplice to a crime, regardless of how peripheral it was, is EQUALLY responsible. Someone dies in a carjacking? In Texas its capital. Life or death. If you are committing a felony and someone dies, If you arent executed, you NEVER get out.

      I have never understood why a plea deal is allowed without the victims agreement. Aren't we supposed to be getting justice for the victim? A plea deal does not get justice. It just punishes. It doesn't give justice to the victim of the crime. For some reason our justice system doesn't seem to get the difference between justice and punishment. Justice is for the victim, punishment is for the criminal. You can give the criminal punishment without giving his victim justice. And that's exactly what a plea deal does.

      Plea deals are necessary as long as organized crime exists. The only thing that stops mafia from taking over a city is the knowledge that one prosecutor could waive prison time and get one member to rat everyone out.
      Also, 95 percent of cases are settled in a plea deal, the court system literally cannot handle everyone going to trial.

      The DA downgraded his charges after this to attempted assault from murder. He pled guilt and was released immediately.

      I showed this to a friend that is an attorney. She said the prosecutor agrees with the defense attorney, because it literally keeps the district attorney's office batting average up. That way they get a victory instead of going to trial and possibly losing

    Thank you Judge for not failing this grief stricken family. The prosecutor certainly didn't care about the young man that was murdered only the criminal. It is so hard to believe that this prosecutor thought probation on felony murder was the right sentence.

      I think all these liberal attorneys lost sight of that a long time ago.
      My sister in law is a retired prison guard. Years ago, when they passed that "Three Strikes Rule" her union STRONGLY opposed it. Their reason... Inmates now "Didn't give a f@#k" because they were incarcerated for life. She said it created a greater danger in her profession. My argument... At least NOW they were a "danger" in prison and not out on the street. Kinda made simple sense to me.

      @derekbrandell8520 What it calls for is same charges as the person already sentenced, because they already convicted the other guy they have this guy all sewn up already. The fact that the bullets he fired didn't hit anyone doesn't matter much, he was there committing a felony and a homicide happened. "My bullets that I fired with intent of murdering someone while trying to rob him didn't hit him, it was my friend who I planned it with and gave a gun, he's the one who hit the guy." Doesn't really sound like a defense. Accessory would be driving the other car while not knowing the full intent of what was going on, then flipping on everyone involved.       @@JuggoJuggoThe problem is this guy’s testimony probably put his friends in jail. The reason you rarely ever see plea deals broken is because the effect it has on future deals. Without witnesses you can’t convict the murderers, and if those witnesses happen to be accomplices sometimes you have to take the lesser of two evils to get any kind of conviction.

      I can see it if there's a substantial number of years included in the deal. Maybe give the person 35 instead of 40, or 17 instead of 20. The court system is stretched too thin and broken. If it would allow for more violators to face justice for their crimes, I'd be for some minor plea dealing. Especially since a plea deal usually cancels out appeals and the court system having to allocate even more resources to deal with that.

    Prosecution is concerned that he won’t get the help if he’s in prison. This kid knew right from wrong decided to be apart of the armed carjacking anyway, he needs to be held accountable. I don’t understand why he doesn’t get treatment in prison? That is something that needs to be looked into by people from the outside. This family will never see their loved one again.

      No real difference occurred for the family in the end.
