Utah Family Sues School District Over 8-Year-Old Boy's Playground Slide Death

  • An 8-year-old Utah boy suffered a deadly fall off a corkscrew slide. Dallin Cunningham was transported to the hospital but he never regained consciousness. The parents are now suing the school district claiming it failed to maintain the mulch below the slide to cushion his fall. The school district has now removed the slide from the playground. Inside Edition’s Steven Fabian spoke with the 8-year-old boy’s heartbroken parents.

      Quickly changed to dollar signs. The report said they plan to sue the school for not having enough mulch.
      Seems a million other kids managed fine not diving head first into frozen winter ground.
      If you didn't manage to teach your kid common sense don't sue the school

    When I was in elementary school, we were not allowed on the playground during the winter. Until everything was melted. That includes the ground. I'm so sorry for the family's loss.

      Was the same for my schools up in Canada. It should be a common sense rule to be enforced by all schools when freezing temperatures affect the playground areas. Play in the school yard instead, and if there's ice in any areas, they get cordoned off with traffic cones and a member of school staff watches to make sure kids don't test their luck and go there anyway. Completely avoidable accident.

      When I was in middle school I slid off of a regular slide during wintertime and literally had the wind knocked out of me after flying off way further than expected and landing square on my back against the ledge of the playground area. I was paralyzed for about a minute and legitimately believed I’d broken something. To this day I feel as though I actually did because I have a lot of spine and back issues as of current day. I’m scared to go to a doctor and check. 😭

      Exactly, you have to know to look out for the dangers of natural causes. The mulch would've regardless have broken the fall if not for the ice. What a waste of a slide, not even recycled.

    The look on dad’s face reminds me of when I was a medic and we were called to a 3 year old that the dad accidentally ran over. He was cradling his son as we got there and his son went into cardiac arrest as I was intubating him. Never got him back. The tire ran over his head and it took 2 nurses to walk the dad in to see his dead son! I will never forget this day!

      That is just too much to bear. Unimaginable to think about. The regret and guilt must be so heavy for the father. It must have also been hard for you as a medic, unable to bring the child back and watching the father mentally fall apart.

      My grandfather almost ran over a kid the same way and it always haunted him, he'd almost never parked in a way where he'd have to back out after that and would always talk about how backing out is the most dangerous part of driving. It also made him more likely to follow rules as the only thing that saved the kids life was a company policy my grandpa had hated until then

    So I know no one asked for this.
    But I knew Dallin
    He was a kind little boy, who loved to be with his family. He has three older sisters, his youngest sister (still older than him) her name was Margaret. I met her in third grade. We would play all the time. Especially with Dallin and Margaret.
    In fourth grade Margaret moved to Utah.
    Then in 2023, February 8th, we figured out that Dallin has died. We were so sad.
    RIP Dallin, you will be missed forever. You were a great little boy

      I clicked this video thinking the same, but looking back, when I was in elementary school we didn't use the playground during the frozen months. We just went outside and milled around the pavement / snowbanks. 🤷

      It’s the school’s responsibility to keep kids safe. If the playground wasn’t up to code, then yeah it was an accident, but it was an accident that could’ve been prevented, hence this issue

    I feel much empathy for the parents. This seems more like a freak accident than anything. I was a boy in the early 1970s. They didn't have mulch under the slides, it was dirt. The monkey bars had concrete. We played like boys play. Once in a while you got scrapes, bruises, and the wind knocked out. There's no way to put pads on everything in a playground. My condolences.

      Yeah a decade later for me. All the merry go rounds had a horror story. And kids often got hurt on the monkey bar dome thing. I don’t think a lawsuit is in order. Everyone knows what playground equipment is there. No one expected a freak accident like this. It would be like suing stairs. Anything involving height and gravity can potentially end you.

      Just given the report and pictures, it seems the ground was _frozen,_ so no amount of mulch would have provide protection, especially if it had rained or snowed recently.

    As tragic is this is it's an accident and accidents happen. It's not the school district's fault, there could have had 12 in of mulch there and if it had been wet or rained anytime prior to that and it froze that mulch would have been hard as concrete. In the United States we cannot keep suing everybody for our accidents, sometimes bad things happen And it's not anyone in particular's fault It's just an accident. In this situation I think it was an accident and that's all it was, a kid fell off of a slide accidentally.

    When I was in elementary school, if it was too cold/snowy outside we could not go onto the equipment to prevent injury.. Sad knowing other schools don't follow this and this poor boy lost his life.

    I don't blame anyone for his death. It was pure accident. There's absolutely no way that every school will have their ground tested, especially during snow. I'm assuming that he ran and dove head first because that's the only way to fall off the rail for someone like his size. I've done that many times when I was a kid too. It was pure accident.

      I don't know, if the ground was like hitting concrete, and the school was responsible for the maintenance of the ground for safety, then I think they might have a case. It wouldn't be that hard for schools in cold areas to run out and check the safety of the ground real quick. Like no effort. It wouldn't even need to be year-round,

    Here in my city in Canada we close the playgrounds during the winter, spring comes and we test the structure and open it back up.

      I was just about to mention that. As a Canadian growing up, we were always told never to play at the playground in the winter months even in the month of March, we were even told to be very careful as things may have not thawed out yet as well black ice. They always always close them sometimes even putting barriers in place so nobody could go near them

    I’m guessing because it was snowing outside, the slide was slippery and that he slid down the slide way too fast. Ice was probably on the slide. They did say the ground was “snowy,” and “rock hard” for a reason.

      No- the frozen ground, & their failure to soften the fall by the required amount of mulch made it so dangerous. Like falling on bare concrete. Never should have happened.

    Everyone's first thought "Let's sue" What a terrible accident that I cannot imagine having to live through. Unfortunately this was just a terrible accident. Cue kids not being able to play outside in the winter while in school and remove all playground equipment while were at it. This is a terrible tragedy but just an accident.

    Tragic. I know rubberized material is often used but with the freezing temperatures don't know if it would have helped. Such a horrible thing for that family

      I was thinking the same thing since these days it's common to use soft recycled rubber from tires and such in playground pavements.
      From what I could find, they shouldn't harden a lot in freezing temperatures. That would be a problem for tires anyway.

      It was just a horrific set of circumstances..it does happen..I understand parents pain .but it's not something that can be directed at the school for blame ...he may have died regardless if ground was frozen or not 😢 and with it being cold ..your apt to slide much easier on a surface of plastic.. carried to much speed ..freak accidents do happen..I find it odd though because it's really not that high if he came off the first loop .then fell .?? Tottaly has to be with way he landed

      @@karlfritz47It could very well be that he hit the ground the wrong way. They didn't confirm exactly what the injuries were. At any rate, the fact that they did not have the required amount of mulch on the playground is disturbing, those things should be inspected several times during the school year. Everybody that has ever tended a flower bed knows that mulch packs down as it lays, and it's especially going to do that when you have people running and jumping on it day in and day out.

    It’s incredibly sad situation but why is the school responsible. Mulch freezes in the winter doesn’t matter how thick it is. This is a lawyer making money off of a grieving family and making them relive this tragic day over and over again

    Sounds like someone pushed him off the side. I work at a school and we have slides just like this. I have never once seen a kid fall off the side while going down it. There's more to this story it seems

    I am sorry for this family’s loss, but this was an ACCIDENT. Suing the school district is going to hold the community taxpayers accountable for the cost of the lawsuit. That is NOT going to bring their son back and it’s going to deprive other students because of what it will cost the school district to fight the lawsuit.

      It was an accident that could have been prevented. So yes,I agree they should sue the school. Had there been a proper amount of mulch on the ground to cushion the fall the kid wouldn't be dead. Also why let them use the playground if the ground is frozen solid?? Yes the school definitely could've taken precautions that would've prevented this child's death and if it were my son I'd be doing the same.

      I’m definitely for trying to keep things safe for kids but I don’t think the first response should be to sue the school.

    There is no way that a lawsuit is fair. There is always some danger involved in a playground. I have been hurt many times. This death is just a tragedy and the school cannot be blamed for it.

    Something is being omitted. The kid either went down the slide when it was iced over, went down head first foolishly, or the kid had some sort of preexisting condition that made a fall that wouldn't normally kill a kid kill him. Plenty of kids have fallen from the top of a jungle gym, and have been fine, which is why it's absurd to suggest liability for a kid who does from falling a few feet.

      When I was a kid I fell from the top of a jungle gym, hit my chin on a bar on the way down and slammed into the ground, only got bleeding from my mouth and a big bump under my chin. It's so unfortunate that this boy didn't survive that fall, must have hit his head in a wrong angle.

      The school allowed them to play outside in such cold weather where the ground hardened and was described to be like concrete. And they only put 1 inch of mulch when they were supposed to have a foot.

    Our schools aren't allowed corkscrews. Also we have to close our playground once the temperature drops below a certain temperature and can't open it until Health & Safety comes around to make sure the ground is thawed enough. I always thought it was ridiculous, as a kid that grew up with tire swings and whatnot, but I guess it is to avoid getting sued when an accident happens.

      That is ridiculous. This is what drives me nuts about lawsuits like this. Kids should be able to play on playground equipment when it is freezing - you just have to keep in mind that things might be icy and ground is going to be hard.

    When I was in 1st or 2nd grade it was winter in Japan (very icy) I was next in line to go down the slide, waiting for the kid in front of me to get off the bottom before going. The kid behind me was impatient and decided to shove me down the slide, I ended up face first into a patch of ice at the bottom and had a bruised face and bloody nose. No kids should have recess in those conditions. Teachers should take time to set up fun activities indoors where it is safe and warm for kids to play and get some energy out. Absolutely heartbreaking for that family. 💔

    While this is so, so tragic, so heartbreaking, sometimes accidents just happen. My opinion is that the biggest factor in this is that the ground was frozen hard, and nobody took that into consideration. The mulch had probably been compacted by snow/ice and was also probably still wet or damp. When fully dry, it probably would have had more cushion capability. I have no doubt that the groundskeepers would have raked it over and topped it off as warmer weather came around.
    My heartfelt condolences to this family but I really just think it was a horrible freak accident.

    i dont want to be a downer and i know people will be against me but i dont think this is the schools fault. to note it was a icey day and thats not notacable to the naked eye it seems a tad damper but thats all, we also have conflicting statements. these may come from the school trying to hush the incedent but i dont think they where. i just hope no one watching the incident gets arested as they almsot immeditly called the authoritys and seemed to do the best they could. its also clear that the slide has been used a lot and ive been on some playgrounds in my day but the slides always have that divit. thats something that is hard to fill with everyone being safe on there way down. i lean with the kid being somewhat reckless and going down head first as i doubt the kid went over a bar. its also described him falling to the ground and not catching himself witch seems unlikely to happen on a 5 foot drop sitting down. all the best to everyone involved

    Why did he fly off the slide at such a velocity? Did another child potentially push him as he took off? In winter the ground is gonna be hard and frozen. Perhaps we need to set even higher standards of safety for kids’ playground equipment in light of basic facts like that. So sorry for his parents, teachers, and friends. How traumatizing to witness a child’s senseless death that way.

    I don’t think he landed rump first. I think it was head first if he had a brain injury causing his dead. Rump first could cause injury to the buttocks and spine but not the head. Feel so bad for the parents

The lawyer is going after the mulch level, but that may be because they know they won't win with a frozen ground "don't let them play" approach. But mulch or no mulch if the ground is a frozen block of ice the result will be the same.

We could go outside but the playground was closed, it can be unsafe and slippery. I don't necessarily think it makes the most sense to have kids on the playground in winter months.

    This reminded me of a similar incident back at my Elementary school. I recall they had to close off the playground due to a fact that one of the students died at the playground when trying to climb the slide. I still have that memory to this day.
