When Will You Get a Lump Sum Payment for Retroactive Disability Benefits from SSA

  • Most claimants who filed for Social Security disability will receive a lump sum payment representing past due or "retroactive" benefits. How much will you receive and how is this back pay calculated?
    The size of your lump sum payment will depend on several factors, including:
    -how much you are due each month from Social Security (your monthly benefit)
    -the date you applied for benefits
    -the date your disability began (your onset date)
    -whether you can re-open an old application
    -whether the five month waiting period reduces your back benefit
    Sometimes Social Security will approve a claim but change the onset date - often this reduces or eliminates the retroactive benefit payment. You do have the right to appeal a changed onset but doing so puts the entire claim back in play and you could end up with a claim denial (although this rarely happens).
    You can help your attorney maximize your lump sum payment by:

    I became disabled January 2013. I filed July of 2014. Denied twice, then i got a fully favorable decision by a judge. I just got my first check 2017. yes, it can take FOREVER EVEN WITH A LAWYER! I got my first month check but haven't gotten my lump sum and wondering why. love your videos and you have very much eased my mind during this process. 4 years!

    Best advice yet I have heard and exactly how I did mine. I applied 6 months after my accident but it was 3 years after I applied before I got awarded my disability. My personal back pay was $27,000 but my wife and kids also got little over $5,000 each. But for 3 years of no income except my wife's part time job caring for a elderly lady. Those were tough years but sure made good use of that back pay. Bought 5 acres of ground and built a house with it debt free. That was 21 years ago and I have a home that is mine. This makes living on disability much easier. Oh I should mention those numbers was after all my lawyer fees so it was a substantial settlement.

    Guess I was lucky. I filed for SSDI in Feb 2016 and was approved Dec 2016. I will get my first check Jan 2017 and my back pay for four months at a later date. I was denied the first time and filed an appeal. I didn't hire an attorney but my cardiologist wrote a letter for me explaining my condition, I'm sure that helped.

      I tried to hire this lawyer and these idiots sent me back my paperworks telling me that I had no chance of getting approved. After that, I sent social security bunch of paperwork and I was approved. The law firm lost out.

      Yes heart problems that could easily get you disability social security hurts me because mines is mental they don't even understand yes I can make a sandwich but that does not mean I can hold a job

    They agreed to an onset date when I applied* Now I got a letter to only giving me one year back pay and they are paying lump sum in quarterly time no lump sum all at once

    I was approved for SSDI in under five months without a lawyer. Did all my paperwork myself, did everything i was asked to do and submitted all requirements. Side note: i do have a qualifying disability under SSA guidelines. With that said, I’d rather be working without a disease.

      @@ssdattorney that happened to my fiancé. He was very young when he began receiving SSD. About 39 years old he had a stroke and a heart attack at the same time. He went to maybe 2 or 3 doctors and was approved instantly. It was sad and depressing for him too. He wanted to work too..

    I would like to commend you for helping the people...I have a question ..I was heard by ALJ and was given a fully favorable decision on July 26 2016, with an Oct 2014 application and an onset date of Sep 5 2014 ...Just recently I recieved one check from ssi for 488.00 and a notice one week later for Disabled widow's benefits which started Sept ...They are withholding Aug 2015 to Aug 2016 in backpay ...what happened to the year before that I was declared disabled by the Judge ?

    I fell off a roof 20ft broke my back 3 places. I had a head injury and real bad depression. this all happened in 2006. I have not worked since then. I have a good disability lawyer and got approved yesterday. I was told by my W/C lawyer ( he didn't have a clue) not to apply for disability until the case was settled. Anyway my new lawyer said he was wrong. I was denied 2 times before I got my disability approved. How far back do you believe they will go back? My lawyer said he had to prove I was disabled before 2011, but my doctor wrote many letters to whom ever and said I have been disabled since the fall in 2006. Thanks need more lawyers like you

      I was disabled in the same year...2006... ALSO FOR HORRIBLE BACK AND SPINAL INJURIES, and I truly hope that you are doing better than you were even a month ago.     I was approved in February; I have gotten 2 monthly checks since then. I was approved for SSDI but denied the SSI. I just spoke to someone regarding my back pay, I was told it got to the payment center on the 10th and it is usually 7 days before the monies is released, and 2 days before it hits my account. I am hoping in the next 10 days my monies is in my account. Thank you sir for all you do helping those of us.

      Did you receive your backpay yet? If so how long after approval did you receive it? It’s almost 4 months for me and I haven’t received monthly payments or backpay. I finally got approved after waiting 5 years.

    If I'm awarded SSDI at my upcoming hearing my SSDI monthly benefit will be greater than the monthly LTD I am receiving now. Do I still have to give my LTD company my back pay?? Thank you for all your videos! I wish you were my lawyer!

    so excited to get money for life thanks the last thing they sent was my proof of income the disability examiner didn't find a physical disability but my diagnosis sticks so I was disapproved Only for ssi. the benefits have not came yet but my paper work is interesting and been mailed the ssa Rep 25% is worth it. #forlife

    I won my case. Judge called my lawyer before I never got a letter. And lawyer called me. I had my onset date of Aug. But my Dr said onset date of Jan.. So social security went with my Dr and said onset was jan. Not a big deal.

      Note maybe because there's a five-month waiting period yes is sick yourself and with a disability but social security wants to withhold 5 months just to see if you can get better and go back to work you sit and we pay into it and their social security harass us discourage a shame us for using the money we paid into the system absolute rubbish 🚮

    Had my hearing, got approved for ssdi to start in October this year but no back pay. Lawyer said it was because I turned 55 a week before my hearing. So now he doesn't get paid and I am still stuck where I a
    Always was. So disappointing. Everyone else I know didn't have this problem. They all got tons of back pay. My lawyer said not to appeal becAuse the judge could change her mind and say no altogether. Still....Very disappointing seeing i have lost everything and was looking forward to getting back on my feet. Hope everyone else fairs better. Thanks always for the videos!!

      That makes no sense. You turning 55 has nothing to do with your back pay. There must have been another reason the judge denied you retro pay. What you got was a partially favorable decision.

    I appreciate your interest in informing the public about the SSDI/SSI programs! I wish that I had forced myself to pursue disability sooner than I did because I believe that I lost a significant amount of money by waiting. I was curious if you believe that there would be any reason to attempt to pursue action in back benefits in my odd situation. I never had a lawyer handle my SSDI case and I was last working in November of 2007, and it was because I was about to lose my job because of my disability. I lasted a week. I filed for my MetLife Long term disability and was denied for not yet having filed for SSDI. I wonder if there’s any chance that they might owe me money because I did obtain Disability. I had received my retirement credits at age 24, I was injured by others severely in a car accident in 2006, and I was not willing to admit to myself that I was not going to be able to work again because of my age and my belief in freakish miracles LOL... I WONDER HOW MUCH MORE MONEY I WOULD HAVE EARNED IF I HAD CZcams ATTORNEYS LIKE YOU, SIR, TO HELP ME THROUGH THIS PRIDEFULLY STUPID LACK OF ACTION! My own attorneys were of no consequence in this matter, and I never had to see a judge or undergo any interviews because I had excellent physicians and my medical insurance was stellar. Although I was never on COBRA, I had coverage paid for by a family member and they kept me on my insurance at my main job, which was a miracle at that time. I was offered executive management in my department store for my sales records and because I was able to satisfy customers even as I returned to work with a walker, I received many letters then online testimonials from satisfied customers and The company didn’t want to lose me. I was the top department salespeople of all employees and I was offered this promotion in 2007 after crawling back to full time and was still the top salesperson, even with a disability. Thanks to my insurance, I was under the care of the best doctors in my area in rehabilitation medicine. I hired a law firm for my rear end collision accident, in which I was the victim of two very bad drivers who forgot that “red =stop” and my attorneys had no hand in helping with much of ANYTHING. They did not take any interest in my case and I never asked them for help. THEY EVEN SCREWED ME OUT OF MY MED PAY, WHICH WAS SIGNIFICANT DUE TO THE FACT THAT I WAS A REALTOR (AND ALSO A MAKEUP ARTIST FOR THE LARGEST DEPARTMENT STORE ON THE USA), and had to carry high limit insurance because customers were often in my car. I finally applied for disability when I was completely bedridden by my injuries under the age of 30. I think there’s a possibility that I might be owed back money. I had no idea how the process worked and I was just heartbroken to admit that I felt defective because I had my life ripped away from me. I was only forced to see one government Doctor and he had no doubt upon meeting me that I was disabled. I WAS APPROVED IN 2009 and received a back check in 2010 in January. I lost everything in my life that I had put my heart into, and I was taking a year off school to work in Real Estate as well as my full time job, in order to save and earn money for Law School. I have a full scholarship as a member of Phi Theta Kappa, honor society for those who obtain a 4.0 in their first two full years of college. I had more credits than needed for graduation yet needed to finish a few of my core requirements after taking many interesting yet ultimately uncounted classes along with filling much of my bachelors degree requirements (AND THEN SOME...), and have been too ill to do so since I was last able to scrape back to work for a while in 2007. Do you believe that I have any chance of any recovery from Met Life for my Long Term disability insurance? Is it worth looking into? I also wonder if there’s any chance of recovery of monies that I would have earned had I filed sooner? Are there exceptions to the 1year rule you speak of? Thanks for being such a great friend to the public and helping those who like me, do not know what to do when severely injured and putting off disability application in hopes of returning to work. I worked as many hours as was legal and more even though I could have taken loans out, I was hell bent on making it all on my own, and worked overtime as much as possible in my working life (my 16-26 year old work time period). I was destroyed in every way possible by my disability and I still don’t have a normal life to this day. For reference, I live in Illinois in suburban Chicago.     Never received the $600 2nd stimulus. Filed and mailed my federal tax rebate form on May 17. 2021. Call every month since and results??? What can I do? I call every week and wait over an hour or more just to be told nothing ?😥

    I've been awarded over 8 months ago n just now got my SSDI monthly benefit n every time I call to ask about my lump sum I get a diff answer n one lady told me that it would be another 6 months b4 I see my lump sum now how can that be possible that I half to wait 14 months to see my back pay when everyone else gets it in a week or 60 days at most ?????

    I'm in PA and have been on SSDI since 2016.I filed for SSDI in 2012 or 2013 (have to look again) and kept getting denied till the last time and after my 3rd back surgery.I have been waiting on the back pay since,I have called and called SSDI,and,my lawyer.
    No one can give an answer as to what's going on or why it still hasn't been sent out.
    The lawyer was paid in 2017 though,they got their money to hell with me.
    I also just recently had to go for a reevaluation and now SSDI claims I can return to work.
    There's no way I can.I'm pretty much stuck to a recliner or bed 90% of the time.Even after my 3rd back surgery it's still crippling and is getting worse as time goes by.It's hard to even walk,stairs...forget it.
    I can't afford insurance other than the medicare and I can't afford doctor bills all the time.Last one was $65 for an unrelated medical issue and I have to scrape to pay for what that doesn't cover.Since I can't go to the doctor because of the bills they say I'm not feeling bad enough that I can work.....
    Now I can't even get a lawyer to fight my appeal because I had the previous lawyer and the previous lawyer claim they do not handle this part of it....
    Gov. always sticking the shaft deeper and deeper to the working person,yet hand it out to those that never worked to pay in or those immigrating...

    if your waiting for a hearing and your mental five months till a hearing is no money yet but approved boo. i filed. I was disabled a year ago but just got this positive news. I'm contacting lufkin Monday and getting a lawyer form in the mail. it will hopefully you an otr approach technical medical evidence. I have awarded depression and social anxiety. its November my proof of income was beautiful.

    Question I apply for SSDI 2018 and I got awarded may16 2021 I just had my second payment but my question is I didn’t have backpay I’m kind of confused because when my attorney got my case he told me that he only gonna get pay if I win the case but now they said that I don’t have no backpay so it’s mean he’s not going to get pay..

    I apply in 2013, didn't get my SSI till 2017, say I wasn't disable enough, Drs didn't
    t catch the 2 fracture dic in my lower back, medical records show where u went to physical therapy and chiropractor, plus having ostopenia, early signs of scoliosis, , should I get a lawyer to see if I can get any back pay from 1st time I filed to whenit was approved in November of 2017

    Q? Once You win an Adjudicator decision, Do You get Your 7-8 Month back pay first before Your 5 month waiting period, or does that come after the 5 month waiting period?

    When I applied for disability in 2015 I stated I was disabled in 2008. The alj's decision stated I was found to be disabled in 2011 and I don't know why there not paying back to 2011. Is it set in writing that they only go back 12 months prior to the date of the application?? Or am I missing something

      I filed before 2015 but was denied so I hired an attorney in 2015 and won. Just lost on if they could have went back to the date I first filed because as of now there going on the date of 2015??

    I worked nation wide 7 days a week and got a paycheck for food, miles, and 18 hours a day.Does that change the amount of what I should of received biweekly? and the back pay they took all back stating it was an overpayment by dropping my monthly payments 500$ less the lawyer only took the one work check and it wasn`t my highest average. and I settled with comp but kept a full medical open but they never sent ssd the papers stating I wasn`t getting money from them but I went there personaly and did it but I`m still getting taxed on it every year so my property taxes are real high because they the town thinks I`m receiving that money from comp. any thoughts?

    If you started case with ss on June 2016, but stopped working on Jan 2016 due to termination base on poor performance, I should claim those 6 months too? Jan thru Jun even if I received unemployment for 3 month?

    Throwing this out there in case someone else may be experiencing it as well. After several years of a battle I was awarded a fully favorable decision buy the judge in 2018. My onset date is may 1st 2015.. so the 6 month rule makes it October 1st 2015. SSDI owes me several years back pay for me and my family. We are now getting close to year 2020. And I still have not received any back pay. Approx 1yr and 7 months I been waiting. I recieve no help at my local office. They advise me my case is in review stage... same answer I get constantly. I ask them to pick a phone up call a supervisor or the main Social security office . Find out something for me... they are so lazy and not fun to deal with. So I basically have no idea where 3 plus years of back pay is and it's very frustrating for me and my family

      Mr Ginsberg, I appreciate your response. I have been a long time subscriber to your videos as well as your emails. I advise everyone to watch and take notes. They helped me tremendously.
      I haven't reached out to either of my senators or congressman. I didn't want to do that thinking it wouldn't be much help. But at this point now it may be my only option. My attorney has not returned my calls. Yes she was paid shortly after my trial. I'm paid my monthly SSDI check since December 2018 was my first check. I been waiting now patiently for all the back pay. Again hearing was in August 2018 fully favorable decision. 3 yrs back pay plus had 2 kids in high school at that time. Do you believe there is a chance a local congressman or senator may be able to help in this case. It's starting to put a hardship on us now with some unexpected bills piling up. Could reall use that back pay. Again thanks

    I have a question about past due benefits. I just got approved and literally they put the information on the website yesterday. Are they supposed to put the past due amount in your verification in the online document? I do not see any. I was recognized by the judge to be disabled Jan 2018 and Applied date March 2020. I used an attorney service that has to get paid out of part of that but I'm not seeing anything about past due amounts that would add up.

      SSA will not put any information about past due benefits on the website. It will only show your monthly benefit amount.

    Mr.Ginsberg,I filed in 2012 and was denied in 2014. I did not reapply until 2015 ,I'm awaiting a hearing next month,can my original file date in 2012 be reopened?

      Judy, if your 2015 application was filed within 12 months of the date on your 2014 denial, you could possibly reopen. You would need to show that there was relevant evidence not considered in the 2012 application that could have been considered.

    my son was awarded 36 months retro from Nov 4 2011 thru Nov 4 2014 the date of his death. I received $42,000 retro pay as his mother. do I have to pay state and/or federal taxes as inheritance taxes??

    I stopped working in 2020 applied for benefits in April 2020 . Got denied once ,won on my appeal in January 2022. And got awarded 1150 a month. My back pay should have been according to their website from the date that I started applying until the day that I was awarded my disability they awarded me 2 months from November of 2021 to when I got my money and they said that's it and no it's from the day I applied I was on my appeal I'm trying to get a hold of my lawyer who closed her case cuz she thinks that it's all done now and I've got a senator looking into it because that's what he's being paid for but seriously I'm all I got was it 1600 here you go and that's it you know what dude I'm still living in my car and I'm still homeless and 11:50 a month is not pay for anything

    I applied in 2013, I just got approved in Nov 2018. I only got back pay for 2 years. That is enough for the attorney to get his max pay of 6k. What incentive does the attorney have to appeal the back pay? It's more work, more resources, but he doesn't get paid any more then he already has been. I see no incentive for the lawyer to do any more work then necessary to get the 6k.. The only incentive would be maybe to make his stats look good, or to feel good about going above and beyond for the client. Other then that, once he has made his 6 grand, I see no reason to spend anymore time or resources on me to get the back pay. Does this sound like I'm on the logical path? I don't see any reason to work harder once theyve made the full amount.

      Simon, I am assuming that the issue is that the judge approved your case but changed the onset date to eliminate 2 or 3 years of past due benefits. Generally speaking I am not a fan of appealing a favorable decision in the hope of recovering extra past due benefits. Once you appeal, you are putting every issue on the table. If the Appeals Council remands, the judge (and it could be the same or a different judge) could rule against you. Re the fees, if an attorney obtains a favorable decision then appeals the onset, then is successful in recovering more past due benefits, the attorney can and should file a fee petition to ask for more than $6,000.

    My disability claim was classified critical on Novemeber 22nd. I have type 2 diabetes and have had 3 amputations in less than a year. My last one was a leg amputation just below the left knee. I was wondering does critical means I will get approved ? and if so how long will I have 2 wait before I get my backpay and my monthly disability check? thank you for your time and opinion.

      I'm not familiar with the term "critical." It does sound your claim is being fast-tracked, which, based on what you say, it should be.

      My attorney filed a letter of dire need with SSA. I have also lost my place I was renting and I will not have any way 2 purchase my medicine when released from my rehab facility.     Is it unusual that I have been approved end of November 2023 and starting getting monthly payments on January 2024 but have not gotten the back pay that is owed to me yet the lawyer representing me for SSDI was paid their portion in December? What could possibly be the hold up? Several calls have just produced it's processing check back next month if there is any change. How long do I have to wait for my money that I assume will have no interest paid to me for each month it's pass a certain time?

    I received ssdi and was stopped due to gainful employment. tried to get my benefits reinstated when my income dropped below the allowed amount and was denied on appeal they have recently been reinstated can I go back a couple of years if there is proof that my income was nothing?

    My husband is 31 with end stage renal disease and going to dialysis 3 days a week. I applied for SSD for him 9/17/18, his last day of work was 9/11/18. My husband received a call from social security that he has been approved and he will start receiving SSD checks 3/3/2019. Will my husband be paid back pay from 9/17/18?

      In an SSDI case, there is a "waiting period" of 5 full months. In this case, if he is approved as of 9/11/18, the waiting period will include the rest of September, 2018, then October, 2018 thru February, 2019. That's why the first payment is in March, 2019.

      Probably in 30 to 60 days - it depends on how fast SSA processes the approved claim.

They said it's at the processing center social security office can't tell you anything I've read articles saying that your lawyer can find out where it is that's not even true once it goes to the processing you can't get an answer at all.     I was approved for SSDI on March the 9th. Have received 4 SSDI payments but for whatever reason, I still have not received my backpay. The first time I called the SSA they told me it's currently taking about 5 months to get backpay processed and just recently when I called again they said they'd contact my local office and I should hear something within 45 days. Still waiting.

    you mentioned the re opening of a case. I applied in 2010, was denied, reappplied in 2011 and was approved, and have been getting benefits since 2011. Now here is my question. I have learned over the last week, that an application was filed for me by the dr that first treated me for mental illness in 1996 is now being processed. This application was not considered during the time I was approved in 2011. Does this mean that I could possibly have back pay due me from 1996, the first time I was hospitalized? Or is this more of a problem for me?

      If SSA messed up and did not process your 1996 application and the medical evidence documents a severe impairment then you might have money coming your way. I have never heard of this type of reopening but there are occasionally cases where SSA made a significant procedural error and impacted claimants do recover funds. You might want to talk to a lawyer in your area for help in figuring out what is going on.

      They will be paid automatically. You should make sure that SSA knows you have dependents and are seeking auxiliary benefits for them as well.

    I became unable to work in 2013. I actually was put on ssi for years. Then my health continued to decline and became disabled. I could no longer be on ssi due to getting married . They count my husband's income and assets. So at social security building they said since I don't qualify for ssi because of this that they need to switch me to ssdi disability. They filed it there and then I had more documents I received from ss to fill out and return. I did everything they asked and was denied twice. I then went to Keller and Keller ss disability attorneys and they filed appeals which where denied. Then I had a hearing. In which was suppose to be in person but they did it over the phone . The judge wouldn't allow my attorney to speak and kept cutting him off. The judge denied me. I received her decision by mail and her explanation was ridiculous. I have medical records showing my disability. So then my attorneys appealed her decision. I had to wait for a hearing for 2 and half years . The decision after my attorney appealed the judge was denied. The decision stated it was because I didn't have enough work credit in the past 10 years to qualify. And that I no longer am allowed to file for disability again. I don't understand this, I completely rely on my husband to dress, shower, cook , laundry and get me to doc appts. I'm on narcotic pain medications all day and muscle relaxers. I have to be in a wheel chair most of time to go anywhere. I can not be up and about for more than 20 30 mins. I have to lay down to lessen the pain. I was put on ssi because I could not work and earn a living . I'm 41 years old now. My lawyer said the judge I got usually denies all claims for those whom are younger. It's been almost 2 years since my lawyer then said there was nothing we can do now. So I'm 100% disabled and I have doctor records showing that. I even had a doctor write a letter explaining it. So is there anything I can do? I live in Indiana.

      Trista I don't think that there is any question that you are disabled but if your disability did not begin before your earnings credits ran out then I can't think of any options.

    Like to see an update on this blog, i first applied 2021 and was denied and .re-apply and hired an new attorney and and applied and have been denied and now i am in appeal and have an appeal with an judge on May 2024

      @ssdattorney the back pay vs lump sum , retroactive go back to first time I applied and your site says go back retroactive to the first time and do an amendment, if I do an amendment will it hurt me. My first date was nov 2021 and denied and hired and attorney here in kentucky. 2022 Mr Baker and I were denied 2023 and he has filed an appeal and I have a hearing in May 2024. If I do or he does an ammendment and go back to 2021 will it hurt me

    So I had to go to 2 days a week from 5 days a week. I have told work I have bills like everyone does. So I've have had a Dr for 3 years now. For the pain I have. I've been up 2 times. And did not get it. One Becouse I did not have a Dr at the time and2 because I was not over 50. I slipped and fell very hard. Messed up my back and neck. Also have bad knee pain from acl surgery. Still have a bolt in my leg. All this happens in 2010. So what should I do at this point????

      My old attorney told me to go file an appeal after they denied me then in 2017 I won the onset day they gave was 9/23/13 but my attorney had to leave my case so I hired a different attorney all he did was put my appeal in and went to court the day of my hearing I had all my paperwork set after the case was one he got his money. I called the office to ask about a garnishments his paralegal told me that they did there job and that was that.the attorney hasn't even help me with my back pay part of my case.the garnishments were sent to them in February 2010 2012 2019 which was a huge mistake because the case was closed and that was not to be active come to find out. I was garnished for 5 years placed on a wpe and a offset. I called the ssa to ask why I was placed on a offset and they said I was taken off and I should be getting a letter from them telling me the amount. Last week this happened. So I call my local office and the claims rep was so rude to me I asked for her supervisor she told me that she would give her the message Oh I asked if I can set an appointment to go over my claim because of the garnishment and she denied the appointment telling me that they don't discuss our file with us because it's against policy and it's against policy to give the last name of a supervisor. I was just asking about my back pay. That claims rep said I had no back pay and that I didn't make enough money for back pay. I asked her if I could speak to her supervisor she again snapped at me telling me that I keep repeating myself and I asked if I could have some kind of documentation of her denieing me of the services I asked for she said that the information I was asking for will be mailed out so I asked to speake with her supervisor because she was so upset because I was want to to talk to her supervisor and she hung up on me. So Im still wanting for the supervisor to call me back. This happened on Monday February 1, 2021.

    I recieved SSI backpay but then 2 weeks later I got ssdi benefits do I get backpay for ssdi?

      It depends on the onset date as determined by SSA.

      Not sure what you mean by the onset date. But they found me disabled July 24, 2017 i filed on January 13, 2018. I received the SSI backpay in may.

    Social Security approved my disability claim, deposited $4,000 to my bank account. Now SS says I am not eligible for monthly benefit because I have over $2000 in assets. Please address this catch-22.

      +fairuseparody - it would appear that you were approved for SSI, not SSDI. SSI will disqualify you if you have income or assets over a certain amount.

      You can only collect SSDI 12 months prior to the date of application, even if the onset of your disability was years before. This may have been what happened here.

    You just said Ssdi backpay cant go past a year from the day you applied. Then you said if you were injured 3 years ago, you can get back pay for 3 years... ssdi gives you backpay only a year back from the date you applied

      You can only recover backpay for up to 12 months prior to your date of application even if you are found disabled many years prior to your date of application.

      The people who get 3 years worth of back pay are the ones who waited 2+ years after being denied to get in front of the judge. So they are getting majority of back pay for the time AFTER they filed.
