The President can not make or change the law only congress can legislate (Article 1 Section 1) . President Trump on the other hand is using his Constitutional powers to enforce the law as written by congress. (Article 4 section 4)
President Obama was also utilizing the same constitutional powers. The hypocrisy of the Republicans is hilarious.

With Trump's emergency declaration, he is fulfilling his primary duty to protect and defend America. He is using money that has been appropriated by Congress but which hadn't been committed to something else. The law is on his side, in spades.

Quick note: it’s actually hilarious how the so called conservative, alpha males, anti-snowflakes literally demand for the firing of anyone who dares offend them by asking them to defend a prior statement or to answer a question.
More importantly though it’s a horrific thing when because a journalist attempts to do their job, journalism, and push people they interview on their show regardless if they agree with them or not the comment section is filled with comments demanding that Chris Wallace go or be fired. Claims that either he’s still butthurt because trump won’t give him an interview or because he never liked trump.
Why is it the second that someone disagrees with or even just merely questions the stance or opinion of the Trump administration they immediately become an enemy. Even if they previously whole heartedly supported, advocated for and defended Trump.
It doesn’t matter how many times you stick your neck out for Trump, what you’ve risked or lost in supporting trump, whether or not you’ll rot in prison the rest of your life because you helped him with illegal acts. The only thing that matters is:
“Have you ever went against the president in anyway possible?”

As Pelosi said this week, invoking a national emergency and sidestepping congress will lead to a liberal president calling for a national emergency that follows Trump’s precedent-perhaps for gun control. There is a good chance that Trump will be out of office in 2020 as he has played to his base for far too long to pick up many votes from independents. If the 2018 turnouts suggested anything it is that liberals will not be skipping the polls like in 2016.
