      @@GabMacedoo They can't prove a lost of revenue with it though, because they shut the thing down that was generating that revenue, so it's more of in a gray area than it is illegal.
      Nintendo rarely if at all goes after websites that provide roms for free anyway, it's usually the ones charging money they go after frequently since they are making money off their IPs. People shouldn't be concerned with piracy being illegal when they shut down the store-front that made it accessible to begin with, as long as you aren't pirating Nintendo Switch games, Nintendo cares less.

    I want people to start saying, "You can't steal from a store that doesn't exist." This isn't like movies or music where you can buy all of it through different mediums. There is literally no place to buy these games where the publishers and developers see that money.

    I think the SECOND any media goes out of production (ie. The company can't make any more money on it since they stopped support/ making copies etc.) It should be free to do whatever with.

      I feel like it should be noted that production and sale are two separate areas. To give a more modern example, Xenoblade 2 was "out of production" at release, as there was never a reprint for the first two years after its release in the west. This was a pretty big issue around the DS era for certain games. The etrian odyssey series was known for being heavily inflated at resale due to limited reprints.

      You won't regret it. Just follow the guide carefully, double check your work, and you'll have it done in about an hour. There's several handy apps you should get after the fact that make the console so much better. Like a theme manager for custom themes, or an FTP to transfer files between your 3ds and another device without having to remove the SD card. Also things like amiibo emulators/unlockers for several games. And of course, twilight menu++ and an NDS forwarder to put downloaded DS games right on your 3DS home menu with the added benefit of having access to cheats. Most of these aren't covered in the guide because they're not necessary to jailbreak, but they're must-haves in my opinion.

    Gabe Newell got it absolutely right when he said that piracy is a service problem. When I want a game, the first place I check is Steam. I have a lot of wishlisted Steam games that I'm waiting for a sale on. I could probably spend hours figuring out how to download some of them, but I'm okay with waiting a few weeks and buying the games for cheap if it means that I can get the convenience of Steam. If developers like Nintendo embraced emulation and made an online storefront so I could buy their games on PC for a few dollars, I might even use that instead.
    But for games I wouldn't be able to play legally due to exclusivity..

      Yet keeping a storefront like that open won’t give much. Nintendo is a business that has to keep profits stable, and if something is taking more money than it’s earning they have to cut it off.
      That’s exactly why the 3DS/WiiU eshop shut down, because they’re old consoles that went out of date. Even if they allowed things to be emulated on switch, emulation is a hard thing. It took years for something like dolphin to emulate some games on a device that’s 10 years old.
      Even Microsoft’s new generation Xbox’ have a limited list of old games, because emulation is hard, and it gets more complicated for each game.
      Steam is great because PCs are a whole other ecosystem, and are essentially on the same ecosystem, like with directX or OpenGL, or Vulkan. A modern PC could still play something from the 90s, and MSDos games are soo old, anything can emulate them.
      And If Nintendo starts releasing old games on something like steam, no one will buy their consoles.

      ​@Thewaterspirit57 I highly, highly doubt that the 3DS/WiiU eShops costed more to operate than they generated in revenue. Besides, they're still open, just with no ability to buy.
      They shut them down purely to keep people from having access to the shops instead of using the Switch. It also was a convenient way to kill virtual console so they could push the subscription on Switch.

      @@GoldenSun3DS literally revenue has been going down for the 3DS/WiiU since the switch’s launch, then it got to the point where they couldn’t maintain the servers on that revenue alone.
      Literally the only time they got a good amount of revenue, was when they announced the shop was closing, which was a quick little flicker in their revenue over the years for those systems. Also you forget that the Wii U had really poor sales, so be happy they kept it open for this long.

    This type of piracy isn’t even considered illegal anymore, many regions started saying that if you can’t buy digital media from their original seller, you are free to pirate without breaking any laws.

      Sadly, it's still a tug of war in some regions. I was recently shocked to learn that the UK still considers personal backups as piracy. I guess they made it legal a few years back, the music industry pitched a fit, and now it's illegal again. Not that the average person knows or cares. When you make something like copying your music CDs to your phone illegal, the only thing that changes is the number of criminals you have.

      Finally GTA3 on my tiny 3ds. Also a recently released competent fan translation of EX Troopers a Japanese only release.
      And I know it was already reviewed on this channel how ps1 emulation through retroarch isn’t too great on the n3ds. However I’m still using a previous version of that emulator-I don’t recall the development number-but it runs most games just fine at or near 60 fps. It’s surprisingly great.

      Funnily enough GBA games in the 3DS are not virtual console, they're not emulated. They run on real hardware, with zero latency, in a special BIOS mode that handles the second screen and the interaction with the OS. Only some things like the cartridge port are emulated.

    I'll give my two cents about piracy.
    I live in a 3rd world country, and is also a country with a LOT of anime fans.
    We where weaboos even before this was popular in the US.
    But Most Anime and Manga never got a national release (and when it did, it was either heavily censored or cancelled midway)
    Brasilian Anime community survived and grew solely on scanlations and fansubed DVD rips.
    Today it is one of the biggest anime markets out of japan
    Piracy can be good

    This might be a hot take, but the reasons others don't talk about this is not only because they don't want to get in trouble, but to also not get sites/apps like the hshop in the spotlight and in trouble by people like Nintendo. I'm glad more people are finding out about stuff like the hshop, emulation, and how piracy is usually okay, but putting these kinds of sites/apps in the spotlight by making videos or writing articles about them can do as much harm as good. Especially once the info starts becoming mainstream

    I am very pro piracy, especially if there is no legal way to buy it. What I do is pirate things, play them, and if I ended up really enjoying them I find different games from the same publisher and buy them on steam to show them some support.

      @@jamespond-jl4oq not necessarily. It is a “we problem”. I’m pro piracy as well, but my take is that the mtx whales makes it worse for the rest of us. I pirate because I don’t like mtx in games, and I doubt any sane person who enjoys a single player story driven game or even a multiplayer story driven game would say otherwise. There’s a reason bg3 sold like it did while payday 3 got dumped in trash. It is an industry wide problem that the gaming sector is slowing shifting games to a software as a service model, rendering both hardware and software useless once their servers get shutdown.

      Piracy is also justified when companies force intrusive DRM onto customers. DRM doesn't punish pirates, it only punishes the honest, if you implement harsh DRM into your game, well "you get what you fucking deserve."

      Exactly. Piracy is now the only way to access the DLC for, say, Fantasy Life, unless you've already got it. And to lose access to that would be a great loss - Fantasy Life is an amazing game and the DLC adds so much. I did everything I possibly could in the base game before I got the DLC and by the time i had dome everything I could with the DLC, I had half again the playtime I'd had when I had finished the base game. That's a lot of extra content for a DLC

    I was a 2000s kid but missed out on all the tech and media that came out during the 2000s/2010s because games and TV were off-limits in my family. Now that I’m an adult, I decided I wanted to catch up on all that I missed, and I bought my New 3DS XL just a few months ago! Naturally, the eShop closing down so soon was pretty upsetting, as well as the fact that much of the 3DS’s network functionality is gone.       I just dug out my old 3DS after seven years thanks to the recent Etrian Odyssey rereleases only to find out support was recently dropped, really sucks. Feels like I barely got much out of the console besides 1000 hours in MH4U and now it's obsoleted.

      @@NGRevenant That does suck 😒 I hope you haven’t installed the latest update-I don’t know for sure, but I’ve heard it was supposed to make consoles that hadn’t been modded yet harder to hack.
      Modding your 3DS is a lot easier than you’d think. I’m not at all technical, but I followed some tutorials and was able to do it successfully on my first try. The 3DS Hacks Guide is probably the best and safest way to go if you want to try it. 😊

      Been maintaining and customizing my 3DS for 4 years now and is sure feels great to not be constrained by whatever Nintendo pulls, another great thing to note is that CFW has reached such a point in which bricking your 3DS is almost impossible now, so I welcome anyone who's interested into giving it a chance, is as easy as following a step by step guide.

      yep, and the truly immoral act is the large publisher-aggregators taking all the credit and all the rights, paying the actual artists and programmers peanuts in comparison. don't forget the subscription services, too! as for rewarding nintendo and the likes for putting up even a few games digitally, over and over again? uh, nope... HARD no. you're by extension rewarding the literal crusades they wage not just against pirates, but loyal/dedicated fans. also, 15 years is already too long for a reasonable copyright term, especially one not controlled by the actual artists, who were contractually forced to hand-over their rights [even their LIVES] to soulless corporations because it was the only way to even make a living pursuing that career.

    i don't have a 3ds but watching this video helped shed some light to emulation. i only know about it from emulating GBA and NDS on PC but my phone lets me do GBA just fine. And I've been watching a lot of your videos where you show us devices from 3rd parties and devices in general that run homebrew and it's all just wild. thank you for your videos. they're binge friendly.

    14:34 Yes, some games _are_ available elsewhere. But given how incredibly simple and safe it is to download them on a 3DS, I now have a method of test running games that I otherwise wouldn't have bought before. So that if I ultimately enjoy the games that I played, I will most likely purchase them later down the line via whatever official means I can. This is how I was introduced to the Azure Strike Gunvolt series.

      the devs don't control their games half the time. publisher-aggregators hold all the rights and the creators get fucked. copyright hasn't been serving the artists' interest in a while. and in the digital insta-copy era, is a fruitless effort. lest we actually want SOPA/PIPA/ACTA to pass some day, they're not the system going out of control but kicking and screaming because it doesn't want to die.

    My opinion on piracy is that it absolutely is not theft. Think about it, if you steal a car for example, that car is now in your possession but no longer in the possession of the person you stole it from. If you pirate a piece of software however, all you are doing is copying something from one place to another, so nobody actually loses anything. At most you could say that the company misses out on profit if you pirate something, but if it's something you can't even buy brand new anyway then that argument is void.

    I bought a 3ds literally 2 years ago. As a kid, my parents never had the money to afford luxury goods like it. The only console I had was a Gameboy, when PSPs were the go to choice. My parents bought me knock off GBA cartridges from dodgy shops just so I could have an entertaining childhood and I love them for it.
    Now that I'm in my 20s, and have some disposable income, I've been buying things I always wanted to experience. The 3DS was one of those things, when I heard it was getting discontinued.
    I would love to spend the money I now have, and buy these games properly. But I can't. I'm years late on the topic, but I'm finally ready now. I don't want to just put it down when I KNOW I can experience some of the most amazing things ever created.
    So I pirate. I homebrewed. People might call me a thief or whatever, and I won't shirk away from it. At the end of the day, if I were to be tried in court, I would be facing criminal charges.
    Do I regret it though? No. I'm experiencing the childhood I never got to experience.

    I homebrewed my New 3DS XL recently, and it was sooooo easy. I did what the guide said, and whenever something wasn't working, that case was already considered and there was a solution. Overall, a really satisfying experience.

    Ever since I got my 3DS, it was strictly a Pokemon system because I was a broke college student who had a tiny budget for gaming. By the time I had a decent career, I just grew out of the 3DS. But with the shop closing, I decided to hack my 3DS to grab hShop and man, it's been the best thing I've done in awhile. I haven't played my 3DS this much in years and it's so cool to finally check out all of the games I never had the chance to play.

Being on Linux myself, I don't have to worry about malware, but I still make sure I at least get roms from sources I know I trust in the very unlikely chance there actually is some Linux malware in a file. I typically go to The Internet Archive first and only download things from other sources if TIA doesn't have what I'm looking for.

    I’ve found that fan translations are the most wonderful use of my time in the open seas. I’ve got an ode in my Saturn, and there are so many great games that we just never got in the west that have been lovingly translated by an awesome community. It’s wild to play grandia, or shining force 3 (the other acts) or policenauts or any number of games I read about as a kid. I was always disappointed in the Saturn (it was the first console I spent my own hard earned money on) but now I adore it. That’s really the best case for this stuff imho. It opens doors that really enhance appreciation of these great consoles

    Good video. Personally I have emulated most of the console games i have played because back in my childhood my family never had enough money to buy lots of games nor consoles, my last home console was a Wii (both Gamecube backwards compability model and the newer model due to the previous one breaking). With that being said, Thanks to efforts to preserve older games and emulation, there are many classics i wouldn't have experienced.

    What I can't help but notice is that they didn't have to disable the ability to buy games there. _The server is still up to ensure that people can update games and redownload games that they own._ This is still true for the DSi and Wii shops, too! Everything is there, all of the game files are in the database, and the servers are running. Nintendo just switched off the ability to buy anything. Seriously, they even could've made it so that the only way to buy them is from the website using your linked account (which was possible before the "shutdown"). That would be annoying, but still not as bad as what they did. It was unnecessary.

      That’s because it costs nothing to keep up less than half the servers needed to allow for redownloading stuff.
      Nintendo and other companies have lots of servers for digital game shops, not just the one in the companies country origin like most people think.
      Nintendo, Microsoft, Sony, and Valve have servers all around the world for their games.
      But Nintendo couldn’t keep Wii U and 3DS Eshops open due to lowered sales over time, and security risks. Old games never go off sale on steam, because it’s a unified platform.

And if they want to shut off a lot of the servers, that's fine, since traffic on that platform has slowed down substantially. I just don't understand why we can't still buy games from the website with our accounts, even if we can't buy directly from the consoles anymore. I'm pretty sure that's what Sony did with the PSP.

      The problem isn’t having the servers to host the games. The problem is the running costs of operating a storefront in pretty much every country in the world, complying with all the different regulations continuously, invoicing, license agreements, etc. They were likely losing money on it. I’m a big fan of the Wii U, but how much Wii U software do you think they sold in the last months before they announced the shutdown?

. The sales of software on each system had been slowly going down since the switches release, with some 3DS games keeping it going somewhat, but still dwindling.
      The 3DS was discontinued in 2019, which marked the end of the thing.

      One word of advice, while I was able to get a Pokémon all the way through to Pokémon Sheild from White 2, don't try to use bank or home with obviously modified Pokémon. So a shiny Victini, which is still impossible without hacking, will almost definitely get you flagged on bank and/or Home. Just wanted to put that out there.

    Section on pirates and spending is so true. I love Super Robot Wars. Most of them aren't available in the west. I imported 3 of them for the Switch, waited months for them to show up, and had to navigate through the eshop on both japanese and taiwanese accounts to get my preorder dlc for them. I will be getting a bunch of accessories, new sd card, etc and homebrewing it, because if I just got this thing after wanting one for what feels like forever, I am gonna make it last, I will keep it usable. I especially tend to love games that don't end up super popular so this is going to be super useful for me personally. I will get physical copies where and when I can but as you said theyre ridiculously expensive now.

Also the same guys run myrient, which has games for every single console I can imagine, including nintendo ones(except switch since theyre scared), so tyat could draw even more attention from nintendo

    I remember wanting to buy Pokémon crystal 3ds boxed version cause it was one of my favorites games and I really wanted a physical copy, but then i found out it was just a box with a download code inside, it was really disappointing. Why can't they just sell the physical copies of this games?! People would buy them.

      Logistics of printing physical games, especially one as small in file size as a game boy game, is absolutely not worth it for the publisher. That there was even a box sold is a "gift," as they 100% did not have to do that

    My take: Give us an avenue to obtain it legit or people will generally find their own avenue for better or worse.
    Piracy has its negatives, like not giving money to the creators (not like they get any however through resale), but it also has its positives.
    One very prominent positive is preservation, as many a product, video game or otherwise, would be dead and gone if not for people pirating certain games.
    Another one is to show that something has a market or still has a market, as something wouldn't be pirated unless people actually cared about it. Heck, a huge reason why anime became so popular over in the west was piracy and fan subs. It showed that something like that could actually have a global market.

    Some years ago, the MCU was putting out this 'chest' that had every movie up to that point in it, I think it might have been 'The Infinity Saga Collector's Edition' (it came out the day after the release of Pokémon Sword and Shield). Mind you, I owned some of these movies already but because I bought like that weird Iron-Man special edition (the plastic case that looks like the helmet, those were weird times) I wanted a nice uniform look, plus all in 4k Bluray! Anywho, it was a BestBuy exclusive and was like $600+. So I showed up at my local BestBuy right as they opened hoping to get one. None of the employees knew what it was and the BestBuy website listing now showed sold out. So I went out and sailed the seas to get every movie. I had the money to give, I wanted to give them the money... they spammed articles about this thing but it was basically scalpers only.

      honestly i think the solution is that people create a self aware AI that hires AI employees that just keeps preserving the hshop and the creators abandon ship and give the AI full control eliminating all liability, because I don't think anyone can sue an AI itself

    I wanna thank you for always having subtitles on your videos. I always use subs and so many big creators only have the autogenerated ones. Which, kudos to CZcams, they’re usually not awful? But they’re not 100% accurate and if someone has a less common accent, they lose the plot completely.
    I recently hacked my 3DS and having access to any 3DS game is great but it’s also too easy imo? Like it doesn’t feel quite the same. I still prefer to buy the physical copies when I can coz I prefer to hold it in my hands. But it’s much easier to just. Download the games than try to find a good deal on it.

    I’m sad that the Eshop is gone. As a monster hunter fan a LOT of the best games in the franchise are stranded on both the 3DS and wiiU so it’s only makes it harder for new fans to play older games that they might love

    It's in line with the flow of the video, but I ended up pausing half way through the video a few hours ago and actually hacking my 3ds finally thanks to you. Ended up finishing the video as it booted up to the home brew menu. Pretty simple and I'm looking forwards to my 3ds providing entertainment a bit longer.

    10:50 you don't even need to download it through your microsd card, if you click "remote install" then "scan QR code", you can just scan the QR code seen on screen and then hShop is on your 3DS; turned a 1 minute ordeal into a 30 second ordeal :D

      The only unfortunate thing is that the 3ds has a limited data intake so it slows down the downloads a lot compared to getting it in your SD Card then installing through FBI

    Pirating Harvest Moon 64 out of curiosity as a kid, is why I'm so nostalgic for the franchise and why I went on to buy virtually every Harvest Moon and Rune Factory game since then.
    I've bought way more games thanks to piracy than I ever would have otherwise. And that's on top of owning the Snes classic, a Nintendo Online subscription, etc. Had it not been for piracy, I likely would have "grown out of" video games growing up. It was piracy that helped fuel my passion for gaming, and why my collection has grown as large as it has. There wouldn't be Nintendo Switch games on my shelf like there are now if it hadn't been for piracy.

    They've even preserved some behind-the-scenes apps not normally accessible to the public, like the Mew Trading App for Gen1/2 Mew distribution, or even local WiFi event distribution apps for Gens 6 and 7. These are powerful tools that it's absolutely possible to use to distribute your own custom events with, if you know how to set them up.

    Honestly, I really appreciate you talking about this. This is legitimately a huge issue with the gaming marketplace right now, especially as we continue moving into a "digital-only" space. Hell, the PS5 even has a model that ONLY supports digital games.
    It's only a matter of time until this goes to court again. Just a matter of when. Hopefully major publishers will recognize the value in making their games available long-term.

    I just got back into handheld gaming because life was too busy for any other form of gaming. Between all my commuting and studying while i am home those in between times before and after class are my game times. I bought an Anbernic RG35XX and love it. I dug up my old gameboy advance, ds, and my 3ds that i barely even used. They even still had a charge after spending years in a box! During summer break i plan on updating my 3ds because its sad to hear that i can't access the shop now that I've gotten back into it.
